CITY COUNCIL AGENDA REPORT
DATE: July 26, 2023
TO: Honorable Mayor and City Council Members
FROM: Jessie Flores, City Manager
BY: Angel Castellanos, Director of Finance, Derik Despain, Senior Accountant SUBJECT: OPEN A PUBLIC HEARING AND ADOPT RESOLUTION 23-63 ORDERING THE LEVY

AND COLLECTION OF SOLID WASTE CHARGES ON THE PROPERY TAX ROLL FOR FISCAL YEAR 2023-24.

STAFF RECOMMENDATION:

It is recommended that the City Council open a public hearing and adopt Resolution 23-63 ordering the levy and collection of solid waste charges on the property tax roll for Fiscal Year 2023-2024.

BACKGROUND:

Beginning in Fiscal Year 2010-11 the City began placing the annual charges for solid waste collection services in accordance with Ordinance 499, which amended Chapter 8 of the Adelanto Municipal Code to allow for collection of those charges on the County tax rolls. In FY2016-17 annual street sweeping charges were also added to that annual tax levy.

The annual tax roll billing method has significant cost advantages, which translate into lower rates to City residents. One advantage is lower administrative processing costs of approximately 8,000 bills on a monthly basis and another advantage is lower delinquency and collection costs. The benefit to our residents is lower trash rates because of the reduced administrative costs of providing the service.

Attached for the Council's adoption is Resolution No. 23-63, ordering the levy and collection of solid waste charges assessments on the property tax roll for Fiscal Year 2023-2024.

STATE IMPOSED ORGANIC RECYCLING INCREASES
Included in the proposed charges are rates related to new organic waste recycling requirements that have been imposed by the State pursuant to SB 1383 and its implementing regulations. SB 1383 not only requires that organic waste be processed so as to keep it out of the landfill, but also imposes significant and costly implementation requirements for things such as record keeping, route auditing, container contamination monitoring, edible food waste recovery. Staff is working with Burrtec on an amendment to the solid waste franchise to implement these State mandated requirements, with a goal of having the amendment complete and programs implemented in October. 326
RESOLUTION NO. 23-63
The actual cost of implementing the State mandated organic recycling programs cannot be determined until the final amendment language is arrived at, but it is expected to be $4.92 per residential customer per month. The costs that Burrtec will incur in connection with implementing the requirements of SB 1383 will include, among other things, purchasing approximately 8,500 new trash carts, 10,000 new cart lids, and a new collection vehicle.

In order to lessen the impact of the costs of the programs mandated by the State on residents, Burrtec has agreed to phase in costs over a 4 year period. This year’s rates include only 1/3 of the actual costs, equal to $1.64 per residential customer per month. To further lessen the impact on residents, Burrtec has proposed to freeze residential rates in 2024-2025 with no increase. This includes Burrtec forgoing the CPI increase to which it is entitled under the current franchise, which will likely be a savings of a 6% increase. The remaining 2/3’s of the cost increase is proposed to be implemented 1/3 at a time in each of FY’s 25-26 and 26-27. Although some of these proposals will not be final until the amendment to the franchise is completed, Burrtec has as a good faith gesture in its negotiations with staff agreed to only implement the 1/3 increase noted above for FY 23-24.

STREET SWEEPING
In staffs negotiations with Burrtec concerns about street sweeping were addressed. Burrtec has been subcontracting this service to a third party, and is dissatisfied with the level of service being provided.

Recognizing the service has not met the City’s expectations Burrtec has invested in its own street sweeping truck and will be taking on that service itself going forward. In recognition that the service provided by its subcontractor have not been at a level it and the City expect, the rates in Resolution 23- 63 have not included a component for a CPI increase related to street sweeping service, to which Burrtec is entitled under the terms of the Franchise.

FISCAL IMPACT:

City General Fund receives approximately $1,000,000 annually in Franchise Fees on Residential, Commercial, Recycling and Roll-off services.

CITY COUNCIL AGENDA REPORT
DATE: July 26, 2023
TO: Honorable Mayor and City Council Members
FROM: Jessie Flores, City Manager
BY: Saba Engineer, City Engineer
SUBJECT: APPROVAL OF RESOLUTION NO. 23-67 TO VACATE STREET EASEMENTS ON

PORTIONS OF STEVENS STREET, AVALON AVENUE, NICHOLS ROAD, CORONADO

AVENUE, AND DESOTO ROAD
STAFF RECOMMENDATION:

Staff recommends that the City Council approve Resolution No. 23-67 and vacate various street easements on portions of Stevens Street, Avalon Avenue, Nichols Road, Coronado Avenue, and DeSoto Road as specifically identified in Resolution No. 23-67.

BACKGROUND:

At the June 28, 2023, Council Meeting, staff was authorized to proceed with an investigation and analysis for the vacation of the following streets:
• Sections of Stevens Street between El Mirage Road and Calleja Avenue • Avalon Avenue between Stevens Street and Aster Road
• Nichols Road between Stevens Street and Aster Road
• Coronado Avenue between Racoon Avenue and Stevens Street • DeSoto Road between Racoon Avenue and Stevens Street
The underlying property where the roadways are located is owned by the property owner. The City was previously granted an easement to put the above listed roads over the property to support future development. The term “vacation” simply means that the City would be giving up its rights to have public roads over the property in the identified areas. The locations of the “streets” to be vacated is shown on Attachment C.

The area in question contains the Silver Peak solar project as previously approved by the City. It was anticipated at the time of the approval of the Silver Peak project that these roadways would be vacated.

The Silver Peak project is one contiguous piece of property and the property owner desires to fence the property for security reasons. However, in order to do so the City would need to vacate the street easements so that the property owner could fence the property and place the anticipated solar panels throughout the property.
333
A number of these “streets” do not even exist – they consist of undeveloped dirt and are just an easement right held by the City for a potential street in the future. The remaining “streets” are generally not passable streets and have not been maintained by the City. The vacation of these “streets” does not cut off access to other properties to public streets. The streets are not necessary for current or prospective future use. If for some reason there were to be a different type of development on the property in the future, as part of the entitlement process for any future development the City would have the opportunity to require the developer to dedicate to the City new street easements to facilitate access to the development.

FISCAL IMPACT:

There is no fiscal impact to General fund associated with this action. The applicant will pay for any cost incurred in the process.

4.10 As to the duties to indemnify under Sections 4.1 and 4.2 of this Article, above, CITY shall have the right to offset against the amount of any compensation due CONSULTANT under this Agreement any amount due CITY from CONSULTANT as a result of CONSULTANT’s failure to pay CITY promptly any indemnification arising under this Article and related to CONSULTANT’s failure to either (i) pay taxes on amounts received pursuant to this Agreement, or (ii) comply with applicable workers’ compensation laws.

4.11 As to the duties to indemnify under Sections 4.1 and 4.2 of this Article, above, the obligations of CONSULTANT under this Article will not be limited by the provisions of any workers’ compensation act or similar act. This hold harmless and indemnification provision shall apply regardless of whether or not any insurance policies are determined to be applicable to the claim, demand, damage, liability, loss, cost or expense.

4.14 As to the duties to indemnify under Sections 4.1 and 4.2 of this Article, above, the duties to indemnify, defend and hold harmless as set forth under this Section, shall survive the early termination or normal expiration of this Agreement and shall be in addition to any other rights or remedies which the CITY may have at law or in equity.

5.2 EVENTS OF DEFAULT; BREACH OF AGREEMENT:

A. In the event either Party fails to perform any duty, obligation, service or task in the performance of this Agreement. In the event CONSULTANT fails to obtain such indemnity obligations from others as required herein, CONSULTANT agrees to be fully responsible and indemnify, hold harmless and defend CITY and CITY’s elected and appointed officials, officers, employees, agents and authorized volunteers from and against any and all claims and losses, costs or expenses for any damage due to death or injury to any person and injury to any property resulting from any alleged intentional, reckless, negligent, or otherwise wrongful acts, errors or omissions of CONSULTANT’s subcontractors or any other person or entity involved by, for, with or on behalf of CONSULTANT in the performance of this Agreement. Such costs and expenses shall include reasonable attorneys’ fees incurred by counsel of CITY’s choice.
373
14 set forth under this Agreement (or fails to timely perform or properly perform any such duty, obligation, service or task set forth under this Agreement), an event of default (hereinafter, “Event of Default”) will occur. For all Events of Default, the Party alleging an Event of Default will give written notice to the defaulting Party (hereinafter referred to as a “Default Notice”) which will specify: (i) the nature of the Event of Default; (ii) the action required to cure the Event of Default; (iii) a date by which the Event of Default will be cured, which will not be less than the applicable cure period set forth under Sections 5.2B and 5.2C, below, or if a cure is not reasonably possible within the applicable cure period, to begin such cure and diligently prosecute such cure to completion. The Event of Default will constitute a breach of this Agreement if the defaulting Party fails to cure the Event of Default within the applicable cure period or any extended cure period allowed under this Agreement.

B. CONSULTANT will cure the Event of Default within the following time periods:
i. Within ten (10) business days of CITY’s issuance of a Default Notice for any failure of CONSULTANT to timely provide CITY or CITY’s employees or agents with any information and/or written reports, documentation or work product which CONSULTANT is obligated to provide to CITY or CITY’s employees or agents under this Agreement.

Prior to the expiration of the 10-day cure period, CONSULTANT may submit a written request for additional time to cure the Event of Default upon a showing that CONSULTANT has commenced efforts to cure the Event of Default and that the Event of Default cannot be reasonably cured within the 10-day cure period. The foregoing notwithstanding, CITY will be under no obligation to grant additional time for the cure of an Event of Default under this Section 5.2B.i. that exceeds seven (7) calendar days from the end of the initial 10-day cure period; or ii. Within fourteen (14) calendar days of CITY’s issuance of a Default Notice for any other Event of Default under this Agreement. Prior to the expiration of the 14-day cure period, CONSULTANT may submit a written request for additional time to cure the Event of Default upon a showing that CONSULTANT has commenced efforts to cure the Event of Default and that the Event of Default cannot be reasonably cured within the 14-day cure period. The foregoing notwithstanding, CITY will be under no obligation to grant additional time for the cure of an Event of Default under this Section 5.2B.ii that exceeds thirty (30) calendar days from the end of the initial 14-day cure period.

In addition to any other failure on the part of CONSULTANT to perform any duty, obligation, service or task set forth under this Agreement (or the failure to timely perform or properly perform any such duty, obligation, service or task), an Event of Default on the part of CONSULTANT will include, but will not be limited to the following: (i) CONSULTANT’s refusal or failure to perform any of the services or tasks called for under the Scope of Work; (ii) CONSULTANT’s failure to fulfill or 374
15 perform its obligations under this Agreement within the specified time or if no time is specified, within a reasonable time; (iii) CONSULTANT’s and/or its employees’ disregard or violation of any federal, state, local law, rule, procedure or regulation; (iv) the initiation of proceedings under any bankruptcy, insolvency, receivership, reorganization, or similar legislation as relates to CONSULTANT, whether voluntary of involuntary; (v) CONSULTANT’s refusal or failure to perform or observe any covenant, condition, obligation or provision of this Agreement; and/or (vii) CITY’s discovery that a statement representation or warranty by CONSULTANT relating to this Agreement is false, misleading or erroneous in any material respect.

C. CITY will cure any Event of Default asserted by CONSULTANT within fortyfive (45) calendar days of CONSULTANT’s issuance of a Default Notice, unless the Event of Default cannot reasonably be cured within the 45-day cure period. Prior to the expiration of the 45-day cure period, CITY may submit a written request for additional time to cure the Event of Default upon a showing that CITY has commenced its efforts to cure the Event of Default and that the Event of Default cannot be reasonably cured within the 45-day cure period. The foregoing notwithstanding, an Event of Default dealing with CITY’s failure to timely pay any undisputed sums to CONSULTANT as provided under Section 1.4, above, will be cured by CITY within five (5) calendar days from the date of CONSULTANT’s Default Notice to CITY.

D. CITY, in its sole and absolute discretion, may also immediately suspend CONSULTANT’s performance under this Agreement pending
CONSULTANT’s cure of any Event of Default by giving CONSULTANT written notice of CITY’s intent to suspend CONSULTANT’s performance (hereinafter, a “Suspension Notice”). CITY may issue the Suspension Notice at any time upon the occurrence of an Event of Default. Upon such suspension, CONSULTANT will be compensated only for those services and tasks which have been rendered by CONSULTANT to the reasonable satisfaction of CITY up to the effective date of the suspension. No actual or asserted breach of this Agreement on the part of CITY will operate to prohibit or otherwise restrict CITY’s ability to suspend this Agreement as provided herein.

E. No waiver of any Event of Default or breach under this Agreement will constitute a waiver of any other or subsequent Event of Default or breach.

No waiver, benefit, privilege, or service voluntarily given or performed by a Party will give the other Party any contractual rights by custom, estoppel, or otherwise.

F. The duties and obligations imposed under this Agreement and the rights and remedies available hereunder will be in addition to and not a limitation of any duties, obligations, rights and remedies otherwise imposed or available by law. In addition to any other remedies available to CITY at law or under this Agreement in the event of any breach of this Agreement, CITY, in its sole and absolute discretion, may also pursue any one or more of the following remedies:
375
16 i. Upon written notice to CONSULTANT, the CITY may immediately terminate this Agreement in whole or in part;

iii. The CITY may proceed by appropriate court action to enforce the terms of the Agreement to recover damages for CONSULTANT’s breach of the Agreement or to terminate the Agreement; or
iv. The CITY may exercise any other available and lawful right orremedy.

CONSULTANT will be liable for all legal fees plus other costs and expenses that CITY incurs upon a breach of this Agreement or in the CITY’s exercise of its remedies under this Agreement.

G. In the event CITY is in breach of this Agreement, CONSULTANT’s sole remedy will be the suspension or termination of this Agreement and/or the recovery of any unpaid sums lawfully owed to CONSULTANT under this Agreement for completed services and tasks.

5.3 SCOPE OF WAIVER: No waiver of any default or breach under this Agreement will constitute a waiver of any other default or breach, whether of the same or other covenant, warranty, agreement, term, condition, duty or requirement contained in this Agreement. No waiver, benefit, privilege, or service voluntarily given or performed by a Party will give the other Party any contractual rights by custom, estoppel, or otherwise.

5.4 SURVIVING ARTICLES, SECTIONS AND PROVISIONS: The termination of this Agreement pursuant to any provision of this Article or by normal expiration of its term or any extension thereto will not operate to terminate any Article, Section or provision contained herein which provides that it will survive the termination or normal expiration of this Agreement.

Subject: Request for Proposal Koala Road Rehabilitation Project Dear Mr. Castellanos:

TKE Engineering, Inc. (TKE) is pleased to provide a proposal for professional design services to the City of Adelanto (City) for the Koala Road Repaving Project. The project limits are along Koala Road from El Mirage Road to Chamberlaine Way. TKE has researched this location to determine the improvements will include removal and replacement of existing asphalt paving, repaving new asphalt and a “mill & fill” treatment where appropriate. TKE’s Scope of Services and Fee are presented in the following paragraphs:

SCOPE OF SERVICES
TKE will provide project management and design services in three progressive phases, 65% Level Completion, 95% Level Completion and 100% Level Completion.

TKE’s scope of services is presented in the following paragraphs:

Task No. 1. Initial ‘Kick Off’ Meeting
Prior to commencement of services, we propose to meet City staff to review project obligations and to discuss all project requirements in detail. TKE’s Project Manager will attend the meeting to determine project protocol and obtain City record drawings.

Task No. 2. Records Research
We will thoroughly research existing utility records and acquire copies of all available records. The purpose of the research is to assemble survey records to establish locations of street centerlines, street rights-of-way and determine locations of all existing utilities and improvements.

The research will consist of assembling copies of assessors’ maps, tract maps, parcel maps, monument ties, benchmark data, corner records, street improvement plans, and utility drawings. We will request the City provide copies of available pertinent City records, such as survey ties, benchmarks, and street, and/or drain improvement plans.

We will notify Underground Service Alert to acquire a complete list of underground utility purveyors. The utility drawings will include existing drawings from the City, 385

drawings and/or atlas maps from all private utility companies, and/or agencies. We will confer and coordinate with the following agencies as well as any additional agencies listed in the Underground Service Alert:
 City of Adelanto Water Department (PERC)
 Verizon (GTE) Telephone
 Southern California Gas Co.
 Southern California Edison
 Cable Television Agencies (Adelphia/Time Warner)
We will send first utility notice letters to all listed utility companies and agencies requesting their data. We will maintain copies of the letters and correspondence for future reference. We shall also provide the City with a complete copy of correspondence with all utility companies. We will prepare a brief outline of all utility relocation costs to be incurred by the City, as well as impacts to the project schedule for any utility relocations and include it with our utility correspondence package.

Task No. 3. Design Surveying
TKE will conduct a conventional design survey. Our field survey crew will locate existing street centerline monuments. The crew will measure the horizontal angle, horizontal distance, and vertical elevation difference between monuments. We will complete a traverse for each survey to ensure closure. Elevations will be tied to existing City benchmarks. We will collect appropriate detail as required including crown, edge of pavement, gutter lip, top of curb, walkways, sidewalks, driveways, gutters, cross gutters, fire hydrants, water valves, manholes, water meters, signs, street lights, power poles, fences, channel structure, culverts, striping and all other visible features.

Our crews will set 100-foot stationing and measure existing topography at 50-foot intervals to extend a minimum of 10 feet beyond existing right-of-way and further where necessary and a minimum of 100-feet beyond the project limits to verify proposed design is consistent with existing conditions. The crew will set temporary benchmarks within the project limits that will be shown on the drawings.

In addition, TKE’s survey crew will field walk all areas of existing curb, gutter, ramps and sidewalk improvements and determine locations of damaged, raised, or sunken improvements which cause water ponding or tripping hazards. We will identify all curb and gutter with a vertical displacement of 1” or greater and all sidewalk with a vertical displacement of ¾” or greater. Non-compliant ramps, if any, will also be identified. Results of the survey will be provided to the City in digital and hard copy format.

Task No. 4. Base Construction Drawings
The base drawings will be prepared at a map scale of 1” =20’. We will prepare the base construction drawings on 24” by 36” sheets with the City’s standard title block using AutoCAD 2015 software. The base construction drawings will include a plan view and we will add the sheet north arrow, existing improvements and utilities (based on City provided data), Assessor’s Parcel Number, property lines, public and 386
Mr. Angel Castellanos
City of Adelanto Koala Road Repaving Project (Continued) July 5, 2023 Page 3 of 4
private right-of-way, street centerline, street names and survey data to the plan view portion of the drawings.

Task No. 5. 65% Design
65% Design will include preparation of preliminary construction drawings and preliminary construction estimates.

Construction drawings will show proposed pavement improvements including removal and replacement limits plus areas of “mill & fill” repaving. Proposed improvements will be designed in accordance with the City’s current street design standards and following recommendations of the geotechnical investigation.

Plan sheets will be drawn at 1” =20’ scale.

We will amend the City Standards Technical Provisions as required for this project.

Construction specifications will be prepared in Microsoft Word format in accordance with City standards.

In addition, we will prepare quantity estimates for all proposed improvements using an excel spreadsheet showing an itemized construction cost breakdown.

Descriptions of work, unit prices, and quantities will be included in the spreadsheet. 65% Design (construction drawings, technical specifications, and construction estimates) will be submitted with a project summary memorandum together with an updated project schedule.

Task No. 6. Coordination with Agencies/ Utilities
After 65% design is complete, plans will be sent to agencies having facilities in the project area requesting verification their facilities are shown correctly and that they furnish any construction requirements. We will highlight each agency’s facilities and advise each of potential conflicts and relocation requirements. We will request a response within two weeks and we will follow up with telephone calls to confirm all agency requirements have been incorporated. We will document all conferences with utilities and agencies and copy the City via e-mail.

Task No. 7. 65% Design Review Meeting
After the City has completed its review, we will meet with City staff to acquire Staff’s comments.

Task No. 8. 95% Design
90% design will include incorporation of City comments, revised plans, specifications and estimates.

Task No. 9. 95% Design Review Meeting
After the City has completed its review, we will meet with City staff to acquire Staff’s comments.

Task No. 10. 100% Design
100% design will include incorporation of City comments, final plans and estimates, ready for public bidding. Final documents will include mylars with signatures and electronic copies of final documents.

Task No. 11. Final Coordination with Agencies/Utilities After the final drawings are approved by the City, we will again submit to all agencies/utilities having underground facilities in the project area to request 387
Mr. Angel Castellanos

verification that their facilities are shown correctly. We will advise them of the project construction schedule and relocation requirements, if any. We will document all meetings and conferences with utilities and agencies.

Schedule
TKE is committed to meet the City’s schedule on the project. TKE will provide services necessary to meet the City’s required submittal timelines for project completion.

Fee
TKE’s fee to provide the scope of service described above is shown in the attached fee table breakdown. TKE will invoice monthly in accordance with our rate schedule and will not exceed our fee without prior approval from the City.

Again, thank you for the opportunity to submit our proposal to provide professional design services. If you have any questions, please contact me at (951) 680-0440.

Sincerely,
Terry Renner, P.E., Q.S.D.
