10 CITY COUNCIL AGENDA REPORT
DATE: April 24, 2024
TO: Honorable Mayor and City Council Members
FROM: Jessie Flores, City Manager
BY: City Attorney’s Office
SUBJECT: Declaration of Surplus Property Under The Surplus Property Act – The Community Center/Senior Center/City Hall and Surrounding Property At 11555 and 11565 Cortez Avenue and a portion of 11600 Air Expressway, Adelanto, CA (APN 0459-221-06) STAFF RECOMMENDATION:
Staff recommends that the City Council adopt the attached Resolution and declare the property identified as 11555 and 11565 Cortez Avenue and a portion of 11600 Air Expressway, Adelanto, CA (APN 0459- 221-06) as Surplus Land that is no longer necessary for the City’s use and direct the City Manager to follow the procedures set forth in the Surplus Land Act.
BACKGROUND:
The City Adelanto (“City”) owns and controls real property at 11555 and 11565 Cortez Avenue and a portion of 11600 Air Expressway, Adelanto, CA (APN 0459-221-06)(the “Property”). The Property totals approximately 10.82 acres and is improved with the Community Center, Senior Center, and City Hall buildings and surrounding fields. The Property is currently zoned Mixed Use. See Exhibit 2 for an overhead photo and map of the property.
The California Surplus Land Act requires all local agencies to prioritize affordable housing, parks, and open space when disposing of Surplus Land. To proceed with an eventual disposition of the Property, the City Council must comply with the Surplus Land Act.
The Surplus Land Act requires that before a local agency takes any action to dispose of land, the land must first be declared either “Surplus Land” or “exempt Surplus Land”, and such declarations must be supported by written findings. (Gov. Code § 54221 (b)(1).) “Surplus Land” is defined as “land owned in fee simple by any local agency for which the local agency’s governing body takes formal action in a regular public meeting declaring that the land is Surplus and is not necessary for the agency’s use.” (Gov. Code § 54221 (b)(1).)
In short, the City Council must first take formal action declaring that the Property is Surplus property.
Adoption of the attached Resolution would satisfy that requirement.
If and when the City Council adopts the attached Resolution, the procedures set forth in Government Code section 54220 et seq., must be followed to dispose of the property. More specifically, the 11 procedures require that the City offer the sale or lease of the property to certain public entities for a period of sixty (60) days by transmitting a written notice of availability to those entities including:
1. A written notice of availability to any “local public entity” (Health & Safety Code § 50079) within whose jurisdiction the Surplus Land is located and to “housing Sponsors” that have notified the California Department of Housing and Community Development (“HCD”) of their interest in Surplus Land.
2. A written notice of availability of the Surplus Land to local park districts.
3. A written notice of availability to any other public entities with jurisdiction over the Surplus Land.
If the City receives correspondence expressing interest from any of the above entities, the City Council is required to enter into good faith negotiations concerning the price and terms of the disposition with that entity for a period of ninety (90) days. If the price and terms cannot be agreed upon after ninety (90) days or if no entity gives notice of interest, then the City may dispose of the Surplus Land without further regard to the Surplus Land procedures.
CONCLUSION:
The City Council should adopt the attached Resolution to comply with the Surplus Lands Act and declare the Property as Surplus property.
FISCAL IMPACT:
No fiscal impact at this time.

In the past 10 years, the City of Adelanto’s population has grown by more than 25% (U.S. Census).

The following is a summary of the needed repairs and updates (Type 1 and Type 2) associated with the water system, the estimated cost and status. These repairs and updates are essential to the future of Adelanto’s water supply. Below is an updated list of the CIP items:

Iron and Manganese (I & M) Treatment Plant Activity Summary During the month of March, state certified treatment operations staff operated the Iron and Manganese treatment plant. Detailed information regarding the operation is below:
The Adelanto water treatment plant treated 50.651 million gallons of raw water. All effluent samples from the I & M plant were within operational guidelines for Iron and Manganese.
Weekly samples were collected and sent to a certified laboratory. Daily grab samples were analyzed for:
o Iron
o Manganese
o Chlorine residual (compared to online chlorine sensor) o Turbidity
Current Issues with the Iron and Manganese (I & M) System These issues need to be given priority as they are essential to water system function and water quality.
The chlorine storage tanks need to be replaced as chlorine in liquid form degenerates rapidly
Both raw and finished water tanks have been inspected and are both severely corroded and need to be replaced.
1200 Booster #1 switchgear is not to code and needs to be replaced. 29 City of Adelanto Adelanto Iron and Manganese Filtration Plant System Number 3610001

NOTES AND INSTRUCTIONS:
1. Routine samples include:
a. Samples required pursuant to 22 CCR Section 64423 and any additional samples required by an approved routine sample siting plan established pursuant to 22 CCR Section 64422. b. Extra samples are required for systems collecting less than five routine samples per month that had one or more total coliform positives in previous month; c.Extra samples for systems with high source water turbidities that are using surface water or groundwater under direct influence of surface water and do not practice filtration in compliance with regulations;
2. Note: For a repeat sample following a total coliform positive sample, any E.coli positive repeat (boxed entry) constitutes an MCL violation and requires immediate notification to the Division (22, CCR, Section 64426.1).
3. Note: For repeat sample following a E.coli positive sample, any total coliform positive repeat (boxed entry) constitutes an MCL violation and requires immediate notification to the Division (22, CCR, Section 64426.1).
4. Note: Failure to take all required repeat samples following an E. coli positive routine sample (22, CCR, Section 64426.1) constitutes an MCL violation and requires immediate notification to the Division (22, CCR, Section 64426.1).
5. Note: Failure to test for E. coli when any repoeat sample tests postive for total coliform (22, CCR, Section 64426.1) constitutes an MCL violation and requires immediate notification to the Division (22, CCR, Section 64426.1).
6. Note: Second Level 1 treatment technique trigger in a rolling 12-month period.
7. Total coliform Treatment Technique (TT) Violation (Notify Department within 24 hours of TT violation):
a. For systems collecting less than 40 samples, if two or more samples are total coliform positive, then the TT is violated and a Level 1 Assessment is required. b. For systems collecting 40 or more samples, if more than 5.0 percent of samples collected are total coliform positive, then the TT is violated and a Level 1 Assessment is required.
8. Contact the Division as soon as practical to arrange for the division to conduct a Level 2 Assessment of the water system. The water system shall complete a Level 2 Assessment and sumbit it to the Division within 30 days of learning of the trigger exceedance.

Adelanto Wastewater Treatment System
Executive Summary
The Adelanto WWTP received 91 million, 893 thousand gallons of raw sewage and successfully treated 91 million, 893 thousand gallons during the month of March 2024, making the total treated amount of water recycled at the Adelanto WWTP about 10.632 billion gallons (since operating services began in April 2012). The characteristics of the water entering and exiting the plant last month are detailed in the section titled “Flows and Laboratory Results.” Secondary effluent form the Facility was discharged to percolation basins 1, 4, 5, & 9 per the discharge requirements for this period. No flow was diverted to VVWRA.
During March, the daily influent flow recorded averaged 2.964 million gallons per day. The facility is permitted for 4 MGD, the capacity is 3 MGD, and current flows and loading are at or exceeding design capacity.
Effluent flow is being calculated by subtracting the treated flow minus the Waste Activated Sludge (WAS) flow for each day and the daily calculated effluent flow averaged 2.899 million gallons per day.
Throughout the month, PERC Water’s Asset Management Team performed daily process control sampling and analysis, trend analysis, equipment verification checks, compliance sampling, housekeeping, process adjustments, and solids processing. Please see “Plant Staffing” for details about PERC Water’s dedicated Adelanto WWTP team. There were no injuries, accidents, facility tours, regulatory meetings, odor complaints, or security issues this month. No flow was diverted to VVWRA.
The following sections outline the characteristics of the operations of the plant, specifically detailing the influent and effluent quality for the prior month. Questions regarding the quality of the water entering and/or exiting the plant can be directed to David Kachelski via his direct line. We look forward to another month of serving the City of Adelanto, CA.

ADELANTO PUBLIC UTILITY AUTHORITY
A D E L A N T O G O V E R N M E N T A L C E N T E R | 1 1 6 0 0 A I R E X P R E S S W A Y DATE: April 24, 2024
TO: Honorable Chairman and Public Utility Authority Members FROM: Jessie Flores, Executive Director
BY: Jessie Flores, City Manager
SUBJECT: CONSIDERATION OF AGREEMENTS FOR THE LEASE AND TRANSFER OF WATER
RIGHTS AND MAKE-UP OBLIGATION TO THE MOJAVE BASIN AREA
WATERMASTER.
STAFF RECOMMENDATION:
It is recommended that the Adelanto Public Utility Authority Board:
(1) authorize the Executive Director to execute all agreements for the lease and transfer of 1640 acre-feet of Free Production Rights in the Alto Subarea (“Alto”) of the Mojave Basin Area; and BACKGROUND:
Base Annual Production rights in the Alto Subarea originated from the adjudication of groundwater rights in the Mojave Basin Area (City of Barstow, et al. v. City of Adelanto, et al.). The adjudication resulted in a physical solution which allows the Mojave Basin Area Watermaster (“Watermaster”) and the Riverside County Superior Court to manage water use to insure a stable water supply, address overdraft in the area and import water as needed. This is accomplished by limiting the amount of “free” water pumped in specific subareas. The Mojave Basin Judgment assigned Base Annual Production (“BAP”) rights to each producer, based on historical production during the period 1986-1990. These rights are transferable within the Subarea in which they originated.
Parties to the Judgment are assigned a variable Free Production Allowance (“FPA”), which is a percentage of the BAP set for each Subarea each year by the Watermaster. The BAP is reduced or “ramped-down” over time until the basin’s total FPA comes within 5 percent of the Production Safe Yield (“PSY”) of the basin as defined by the Judgment. The FPA is the maximum amount of water a producer may pump in one year without incurring a replacement obligation. The following table shows the current permanent water right holdings for the Adelanto Public Utility Authority (“Authority”) in the Alto Subarea and the 5-year pumping average.
102
Base Annual Production
Right (Acre-Feet Per Year)
Free Production
Allowance (Acre-Feet
Per Year)
Watermaster
Rampdown Rate
City of Adelanto 5,182 2,612 50.4%
Parities to the Judgement may address their replacement obligations by either leasing FPA annually from other parties, purchasing their water obligations from Watermaster annually at the current price per acre-foot or through the purchase of additional permanent water rights.
During the last water year (October 2022 – September 2023) the Authority produced or pumped 4,460 acre-feet of water in the Mojave Alto Basin. The Authority, due to the purchase of water rights was able to pump 2,851 acre-feet of water. The Authority is required to offset the over production of water, which is 1,640 acre-feet, with purchases from the Watermaster or through the transfer of unused water rights from within the Alto Subarea.
Due to the record rainfall in the Victor Valley, the downstream make-up obligation for the Alto Subarea is zero Acre-feet. Therefore, Adelanto will not incur a make-up obligation assessment from the Watermaster, resulting in additional savings of approximately $15,000.
FISCAL IMPACT:
The Authority may offset its replacement obligation in one of two ways. The Authority can purchase the water from the Mojave Basin Area Watermaster or lease unused FPA from water rights holders in the Mojave Basin Alto Subarea.
1. Watermaster Replacement rate $565.00 per acre foot for a total cost of $926,600.00
2. Replacement obligation leases through MRM about $539.52 per acre foot for a total cost of $864,140.00
3. The cost savings to the Authority would be $62,460 by leasing the Make-up obligation through MRM ATTACHMENTS:
1. Mojave Resource Management Memorandum
2. Obligation Transfer documents
3. Watermaster letter

DATE: April 24, 2024
TO: Honorable Mayor and City Council Members
FROM: Jessie Flores, City Manager
BY: Erica L. Vega, Esq., Burke, Williams & Sorensen, LLP, Special Counsel SUBJECT: INTRODUCTION AND FIRST READING OF AN ORDINANCE UPDATING THE CITY’S
CANNABIS RETAILER REGULATIONS
STAFF RECOMMENDATION:
Staff recommends that the City Council introduce and conduct the first reading of Ordinance No. 650, entitled:
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ADELANTO, REPEALING SECTION 17.80.130 AND AMENDING SECTIONS 8.60.030,
17.200.140, AND 17.80.120 OF THE ADELANTO MUNICIPAL CODE UPDATING THE CITY’S CANNABIS RETAILER REGULATIONS
BACKGROUND AND DISCUSSION:
The City of Adelanto allows the full range of cannabis businesses to operate within the City, subject to State and local regulation and taxation. For cannabis retailers, the City has permitted storefront retailers (dispensaries) through a competitive process with a limited number of retailers permitted to operate in the City. As such, the City is not presently accepting applications for new storefront cannabis retailers. New applications for non-storefront cannabis retail (delivery only with a physical location within the City) are currently being accepted. Current City regulations require both storefront and non-storefront cannabis retailers to obtain a Retail Permit and a Conditional Use Permit from the City and subject the businesses to similar operational requirements, such as hours of operation, security, and signage. Despite the significant overlap in how storefront and non-storefront retail is regulated, the regulations are housed in separate sections of the Zoning Code (Sections 17.80.120 and 17.80.130).
The proposed Ordinance combines the regulations for storefront and non-storefront cannabis retailers into one code section (Section 17.80.120) and lifts the prohibition on new applications for storefront cannabis retail. The competitive process for storefront retail has been eliminated, allowing applications to be accepted on a rolling basis just as with any other legal business that 135

desires to open a location in the City. All cannabis retailers will still be required to obtain a Retail Permit to operate in the City as well as a Conditional Use Permit for the location. Retail permits have a one-year term and must be renewed. The Retail Permit is the mechanism through which the City regulates business operations and ensures compliance with those regulations. A retail permit will be renewed if the business is operational and in compliance with all applicable State and local regulations. Non-operational businesses may have their permit renewed if there is good cause for the business not being operational (e.g., a building is under construction, State license hasn’t issued yet). The Conditional Use Permit runs with the land, meaning that if a retailer obtains a Conditional Use Permit to operate cannabis retail at a location and then shuts down, a subsequent retailer can utilize that location without having to obtain a new Conditional Use Permit. The subsequent retailer would, however, have to obtain a Retail Permit.
The proposed Ordinance also allows a storefront retailer to operate a consumption lounge. All products consumed on-site must have been sold by the retailer (no BYO cannabis consumption is allowed) and any leftover product must be repackaged as if it were originally purchased for “to go” consumption if it is to leave the premises. The proposed Ordinance also requires an odor control system to be installed and for the retailer to ensure that cannabis odor is not detectable from public spaces.
The regulations on the operation of cannabis retail are largely similar to the existing regulations imposed by the City. However, there have been a couple of noteworthy changes, including elimination of the requirement that the business’s operations not be visible from exterior public spaces. Allowing visibility into the interior of the business creates a more welcoming retail environment and encourages a higher level of design for the interior of the business. Another existing regulation that is proposed for elimination is the requirement that a permittee for nonstorefront retail also hold a permit from the City for a different type of cannabis business (cultivation, manufacturing, etc.). This change opens up the pool of potential applicants.
FISCAL IMPACT:
All sales of cannabis within the City are subject to the City’s cannabis tax, including sales by nonstorefront retailers with a physical location in the City that make deliveries into another jurisdiction. Since few jurisdictions in the vicinity allow cannabis retail, the City’s storefront and non-storefront retailers will serve the cannabis demand for a large geographic area. It is anticipated that this will have a positive fiscal impact on the City, but the magnitude of that impact cannot be estimated at this time.

ORDINANCE NO. 650
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF ADELANTO, REPEALING SECTION
17.80.130 AND AMENDING SECTIONS 8.60.030,
17.200.140, AND 17.80.120 OF THE ADELANTO
MUNICIPAL CODE UPDATING THE CITY’S
CANNABIS RETAILER REGULATIONS
FACTS
1. In 1996, the voters of the State of California approved Proposition 215, which was codified as Health and Safety Code Section 11362 et seq., and entitled the Compassionate Use Act of 1996, which intended to enable seriously ill Californians to legally possess, use, and cultivate marijuana for medical use under limited, specified circumstances; and
2. In 2004, the California legislature enacted Senate Bill 420, the Medicinal Marijuana Program (the “MMP”), which, as codified in California Health and Safety Code Section 11362.7 et seq., was intended to clarify the CUA’s scope and immunize from criminal prosecution, under specified state laws, certain activities and conduct related to the provision of medicinal marijuana to qualified patients; and
3. On November 8, 2016, the voters of the State of California approved Proposition 64, entitled the “Control, Regulate and Tax Adult Use of Marijuana Act,” which legalizes and regulates recreational marijuana in California; and,
4. The State has established an integrated licensing and regulatory system for both medicinal and recreational marijuana businesses consistent with Propositions 215 and 64 entitled the Medicinal and Adult-Use Cannabis Regulation and Safety Act (“MAUCRSA”), codified in Business and Professions Code section 26000 et seq.; and
5. Business and Professions Code section 26200 expressly recognizes the ability of cities to completely prohibit all medicinal and recreational cannabis businesses or to allow and regulate such businesses; and,
6. The City of Adelanto allows both storefront and non-storefront cannabis retailers to operate within the City and the purpose of this ordinance is to update those regulations to help cannabis retailers thrive in the City while protecting the public from potential negative impacts of these businesses.
NOW, THEREFORE, THE COUNCIL OF THE CITY OF ADELANTO DOES ORDAIN AS FOLLOWS:
SECTION 1. The foregoing Facts are adopted as findings of the City Council as though set forth in fully within the body of this ordinance.
SECTION 2. The City Council finds that the proposed Zoning Code amendment is consistent with the goals, policies, and objectives of the General Plan. More specifically, the amendment is consistent with Chapter 3, Economic Development, because it helps to implement the City’s economic development goals and policies, including job creation, infrastructure expansion, and revenue generation. The City Council further finds that the Zone Code amendment will not affect compatibility of existing uses.
137
SECTION 3. The City Council finds that the adoption of this Ordinance is exempt from review under the California Environmental Quality Act (CEQA) pursuant to the common sense exemption (CEQA Guideline 15061(b)(3)) because it can be see with certainty that there is no possibility that permitting one cannabis retail location to operate within the City may have a significant effect on the environment. Cannabis retail operations are small footprint and retailers are likely to operate within an existing vacant location rather than engage in new construction, and would likely qualify for the in-fill development exemption (CEQA Guideline 15332). In the event the sole retailer permitted in Adelanto does not qualify for the in-fill development exemption or another CEQA exemption, CEQA review would be conducted concurrently with project processing, ensuring that any environmental impacts are less than significant.
SECTION 4. Adelanto Municipal Code Section 17.80.120 is amended in its entirety to read as shown in Exhibit A to this Ordinance.
SECTION 5. Adelanto Municipal Code Section 17.80.130 is repealed in its entirety.
SECTION 6. Adelanto Municipal Code Section 17.200.140 is amended to delete the definition of “medical marijuana dispensary.”
SECTION 7. Adelanto Municipal Code Section 8.60.030 is amended in its entirety to read as follows:
“8.60.030 Commercial Non-Medical Cannabis Activities Prohibited.
All commercial non-medical cannabis activities within the City are prohibited except in full compliance with all applicable requirements of Chapter 17.80 of this Code.” SECTION 8. Severability. If any provision, section, paragraph, sentence, clause or phrase of this ordinance, or any part thereof, or the application thereof to any person or circumstance is for any reason held to be invalid or unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance, or any part thereof, or its application to other persons or circumstances. The City Council hereby declares that it would have passed and adopted each provision, section, paragraph, subparagraph, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, paragraphs, subparagraphs, sentences, clauses or phrases, or the application thereof to any person or circumstance, be declared invalid or unconstitutional.
SECTION 9. This ordinance shall become effective on the thirtieth (30th) day following passage and adoption hereof.

The City shall approve the change in ownership unless one or more of the grounds to deny a retail permit listed in Subsection A above are present.
F. A Retail Permit shall expire and be null and void 12 months after issuance to the Retail Permittee unless properly renewed. Upon payment of the applicable Retail Permit fees, and passing any requisite retail inspections, a Retail Permittee that is fully operational and engaging in retail sales to the public shall be entitled to renew their Retail Permit, provided that the permittee maintained compliance with all City, State, and other applicable cannabis and business-related laws during the term of their permit, and subject to all prevailing laws at the time of renewal. A Retail Permittee that is not fully operational and engaging in retail sales to the public may apply for a renewal of their Retail Permit but a renewal shall only be approved if the City finds that there is good cause for the permittee’s failure to be fully operational.
G. To the fullest extent permitted by law, the City does not assume any liability, and expressly does not waive sovereign immunity, with respect to any cannabis retail activities, or for the activities of any cannabis Retailer.

(5) Any person in violation of any provision of this Section shall be punishable by an administrative fine of up to $1,000 per offense per day. Aggregate daily fines shall not exceed $10,000.00 per day if administrative fines are imposed immediately without prior issuance of a Notice of Violation.

tenant prohibits commercial cannabis activity, and iii) the property owner or agent did not know the tenant was engaging in illegal commercial cannabis activity and no complaint, property inspection, or other information alerted the rental property owner or agent to the illegal commercial cannabis activity.

SUBJECT: ADELANTO WWTP – AERZEN TURBO BLOWER ADDITION
STAFF RECOMMENDATION:
Staff recommends that the City of Adelanto purchases the Single Stage Highspeed Centrifugal Turbo Blower manufactured by Aerzen. The new blower will be added to the existing three blowers of the same manufacturer currently being used at the sewer treatment plant and will be compatible to the existing blowers. By adding this particular blower and a few other upgrades we anticipate to increase the plant capacity from 3.0 million gallon to about 4 million gallons per day. The supplied blower system shall include blower, premium efficiency motor, variable frequency drive, control panel, CPU, inlet filter and silencer, blow off valve, blow off valve silencer, check valve, discharge isolation valve, expansion joint, connectors and other appurtenances as shown on the Drawings and as specified herein for a complete and operational system.
BACKGROUND:
The City of Adelanto’s sewer treatment plant latest upgrade was designed for 3.0 million gallon per day. Due to the City’s growth we must increase the plant capacity to meet the current flow demand. By adding an additional blower, the sewer treatment plant capacity should be expanded to about 4 million gallon per day.
FISCAL IMPACT:
The funds will be paid for by the APUA, with no impact on the General Fund. The Aerzen Blower price comes out to be $179,730.44.
