Analytical test results meet all requirements of the associated regulatory program listed on the Accreditation/Certification Summary Page unless otherwise noted under the individual analysis. Data qualifiers and/or narrative comments are included to explain any exceptions, if applicable.
· Matrix QC may not be reported if insufficient sample is provided or site-specific QC samples were not submitted. In these situations, to demonstrate precision and accuracy at a batch level, a LCS/LCSD may be performed, unless otherwise specified in the method.
· Surrogate and/or isotope dilution analyte recoveries (if applicable) which are outside of the QC window are confirmed unless attributed to a dilution or otherwise noted in the narrative.

Regulated compliance samples (e.g. SDWA, NPDES) must comply with the associated agency requirements/permits.

Receipt
The sample was received on 1/3/2025 12:23 PM. Unless otherwise noted below, the sample arrived in good condition, and, where required, properly preserved and on ice. The temperature of the cooler at receipt time was 1.5°C.

General Chemistry
Method 7196A: The matrix spike / matrix spike duplicate (MS/MSD) and matrix spike insoluble (MSI) recoveries for the following sample associated with preparation batch 570-520605 and analytical batch 570-520875 were outside control limits: C5A0149-01 (570-212842-1), (570-212842-A-1-B MS), (570-212842-A-1-C MSD) and (570-212842-A-1-D MSI). The associated laboratory control sample (LCS) recovery met acceptance criteria.

Method 7196A: The following samples were diluted due to sample color interference: C5A0149-01 (570-212842-1), (570-212842- A-1-B MS) and (570-212842-A-1-C MSD).

Method 7196A: The post digestion spike % recovery for Cr (VI) associated with batch 570-520875 was outside of control limits.

The associated sample is: (570-212842-A-1-E PDS). Sample matrix interference and/or non-homogeneity are suspected because the associated laboratory control sample (LCS) recovery is within acceptance limits.

No additional analytical or quality issues were noted, other than those described above or in the Definitions/ Glossary page.

SUBJECT: SPECIAL ASSESSMENTS FOR COLLECTING DELINQUENT ADMINISTRATIVE FINES FOR

VIOLATIONS
STAFF RECOMMENDATION:

It is recommended that the City Council adopt Resolution 25-08 to:

1. Certify the delinquent fines as special assessments against the properties listed in Attachment

1. 2. Direct the City Treasurer to take necessary actions to record and collect the special assessments in accordance with Government Code Section 53069.4.

BACKGROUND:

In accordance with Chapter 1, Section 1.20.010 of the Adelanto Municipal Code, administrative citations are issued to individuals who violate the city's regulations. The citations impose fines, which, in some cases, remain unpaid. Government Code Section 53069.4 provides the City of Adelanto the authority to collect these delinquent fines, interest, and penalties as part of nuisance abatement procedures.

As per the requirements outlined in AMC 3.05.010, the City has followed due process to notify the owners of properties where public nuisance violations occurred, informing them of the public hearing held on February 26, 2025. This hearing was conducted for the purpose of certifying the special assessments for delinquent fines.

FINDINGS:

1. Certified Mailings: On January 28, 2025 Community Safety sent out certified letters to the property owners and any mortgage company listed on the property profile. These letters included a letter of demand, Statement of Cost and Hearing request form.

2. Public Hearing: On February 26, 2025, the City Council held a properly noticed public hearing, pursuant to Government Code Section 53069.4, to certify special assessments against properties with unresolved fines for public nuisances.

3. Certification of Delinquent Fines: The delinquent fines, interest, and penalties, as specified in Attachment 1, have been reviewed and certified by the City Council for collection as special assessments.

4. Authority for Collection: The special assessments will be processed and collected by the San Bernardino County Tax Collector, as per Government Code Section 53069.4. The City Treasurer is authorized to record notices and obtain collections for these assessments.

5. Release of Liens: Upon full payment of these assessments, the City Treasurer is authorized to file releases with the San Bernardino County Recorder to clear the liens on the properties.

FISCAL IMPACT:

The collection of these delinquent fines as special assessments will result in a direct benefit to the City’s finances by recovering outstanding administrative fines that have not been paid by property owners.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ADELANTO,

CALIFORNIA,CERTIFYING SPECIAL ASSESSMENTS FOR COLLECTING DELINQUENT

ADMINISTRATIVE FINES FOR VIOLATIONS OF THE CITY OF ADELANTO MUNICIPAL CODE

THE CITY COUNCIL OF THE CITY OF ADELANTO DOES HEREBY FIND AND RESOLVE AS FOLLOWES:

WHEREAS, the City Council has adopted Chapter 1 section 1.20.010 of the Adelanto Municipal Code, which authorizes the issuance of administrative citations tat impose fines upon persons who violate the provisions of the Adelanto Municipal Code (“AMC”); and WHEREAS certain administrative citations have been issued an the administrative fines imposed thereby have not been paid by the responsible persons who committed the AMC violations; and
WHEREAS Government Code section 53069.4 authorizes the City of Adelanto to collect delinquent fines, interest, and penalties as part of nuisance abatement procedures; and WHEREAS, the City’s procedures to collect delinquent fines, interest, and penalties are set forth in AMC 3.05.010 which procedures have been followed, including but not limited to providing notice to each of the owners of real property of the public hearing held by the City Council on February 26, 2025 for the purpose of certifying special assessments against properties where public nuisance has occurred: and
WHEREAS the City Council wishes to certify those certain fines, interest, and penalties as delinquent and have them collected as special assessments against the real property involved pursuant to the provisions of Government Code 53069.4
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Adelanto as follows:

1. The City Council held a public hearing on February 26, 2025 which was properly noticed as required by Government Code section 53069.4, for the purpose of certifying special assessments against properties where public nuisances have occurred.

2. The special assessments designated on Attachment No. 1, incorporated herein by this reference, are hereby certified as being delinquent civil fines, interest and penalties owing to the City of Adelanto and qualified for collection as special assessments under the Government Code.

3. The City Council orders that these delinquent fines, interest and penalties and to be collected as special assessments against the respective properties shown on Attachment 1 pursuant to the provision of Government Code section 53069.4 703

4. Pursuant to such authority, the City Treasurer is directed to take the requested steps for recording notice of such assessments against the respective properties in the property records of the County of San Bernardino and for obtaining the collection of such assessments by the Tax Collector of San Bernardino.

5. The City Treasurer is also authorized to take the necessary steps to have releases filed with the County Recorder when any such special assessments have been paid.

1.22.010 Cost Recovery Program.

This Chapter is intended to create a comprehensive cost recovery program as authorized by law for the abatement of public nuisances. The provisions of this Chapter shall supersede and replace any inconsistent provisions contained within this Code.

1.22.020 Definitions.

A. “City Manager’s Designee” shall refer to the City Manager or the person designated by the City Manager to fulfill the responsibilities required by this Chapter.

B. “Decision” shall refer to the decision of the Hearing Officer at the conclusion of an administrative hearing held in accordance with this Chapter.

C. “Hearing Officer” shall refer to the neutral and impartial hearing officer appointed to hold and conduct a hearing in accordance with this Chapter.

D. “Interested Party” or “Interested Parties” shall refer to each person or entity with a recorded interest in the nuisance property that is the subject of a nuisance abatement action.

E. “Invoice” shall refer to the invoice identifying all nuisance abatement costs that the city is entitled to recover related to a nuisance abatement action.

F. “Nuisance” and “Public Nuisance” shall include any violations of this Code, state and federal law, or any other unlawful condition.

G. “Nuisance Abatement Action” shall refer to any code enforcement activity or nuisance abatement activity taken by the City including but not limited to, any legal action, administrative action, criminal action, or civil action intended to cause or compel compliance with, or to enforce any, provisions of this Code, any adopted codes, or any applicable State or federal laws.

H. “Nuisance Abatement Costs” shall refer to all fines, costs, expenses, and fees, including, but not limited to, all administrative expenses, administrative fines, civil fines, penalties, staff time, variable costs, fixed costs, inspection costs, investigation costs, enforcement costs, abatement costs, litigation fees, litigation costs, attorneys’ fees and costs, and all other costs and expenses related to, arising out of, or incurred by the city in connection with any nuisance abatement action.

I. “Nuisance Property” shall refer to the property containing nuisance conditions that is the subject of a nuisance abatement action.

J. “Responsible Party” or “Responsible Parties” shall refer to all parties responsible for causing, allowing, or maintaining a public nuisance including, but not limited to, the owners, managers, tenants, and occupants of the nuisance property upon which a public nuisance was caused, allowed, or maintained. 1.22.030 Nuisance Abatement Cost Recovery.

The City is entitled, and is hereby authorized, to recover all nuisance abatement costs related to, arising out of, or incurred 709
by the City as a result of any nuisance abatement action. Each responsible party shall be jointly and severally liable to the City for all of the City’s nuisance abatement costs.

1.22.040 Attorneys’ Fees and Costs.

The prevailing party in any nuisance abatement action may recover its reasonable litigation costs and attorneys’ fees from any non-prevailing party. In no case, however, shall an award of attorneys’ fees to the prevailing party exceed the amount of reasonable attorneys’ fees incurred by the City. Non-prevailing parties shall be jointly and severally liable for all attorneys’ fees and costs owed to the prevailing party. The City shall be deemed the prevailing party in a nuisance abatement action if a nuisance condition is proven to have existed on a nuisance property when the City initiated its nuisance abatement action even if the nuisance condition is cured prior to the conclusion of the nuisance abatement action. 1.22.050 Collection Remedies.

In addition to any other remedy set forth in this Code or provided by law, the City is authorized to initiate any administrative or civil action to recover all nuisance abatement costs. Each of the responsible parties shall be jointly and severally liable for ail nuisance abatement costs. Unpaid nuisance abatement costs may be recovered as a lien or special assessment against the nuisance property, as provided in this Chapter.

1.22.060 Administrative Procedure for Recovering Nuisance Abatement Costs.

A. The administrative cost recovery procedures provided in this section are in addition to all other remedies and cost recovery options available to the City by law or in equity.

B. In accordance with this Chapter, the City shall serve upon each responsible party and each interested party an invoice identifying all nuisance abatement costs related to a nuisance abatement action.

C. Any responsible party or interested party to whom an invoice has been issued shall have 45 calendar days from the date of the Invoice to remit full payment of the Invoice to the City. Payment shall be submitted to the City as specified in the Invoice. The Invoice shall further indicate that any unpaid amounts may become a lien and special assessment against the nuisance property.

D. Any responsible party or interested party to whom an invoice has been issued may, within 15 calendar days from the date of the invoice, request a hearing on the amount of nuisance abatement costs. A request for hearing must be made in writing to the City Clerk and contain the following information:

1. The requestor’s full legal name.

2. The requestor’s valid mailing address for service.

3. The requestor’s phone number.

4. The amount of nuisance abatement costs disputed.

5. The specific legal and factual grounds for all disputes of the invoice and nuisance abatement costs.

E. The failure of any party to properly and timely request a hearing shall constitute a waiver of the right to contest the Invoice, a waiver of the right to a hearing, a failure to exhaust administrative remedies, and a bar to any further challenge to the City’s invoice and nuisance abatement costs.

1.22.070 Nuisance Abatement Costs Hearing.

A. If a hearing is timely and properly requested, the City Manager’s designee shall appoint a neutral and impartial Hearing Officer to hold and conduct an administrative hearing in accordance with this section. The employment, performance evaluation, compensation, and benefits of the Hearing Officer, if any, shall not be directly or indirectly conditioned upon the decision of the Hearing Officer.

B. The City shall set a hearing to take place before the Hearing Officer within 60 calendar days from the date that a timely and proper hearing request is filed, or upon any other date mutually agreed upon by all parties to the hearing. The City shall provide notice of the date, time, and location of the hearing to all responsible parties and interested parties at least 10 calendar days prior to the hearing. The hearing notice shall specify that failure to appear at the hearing will constitute a waiver of the right to dispute the invoice and the nuisance abatement costs, a failure to exhaust administrative remedies, and a bar to any further challenge to the Invoice or the nuisance abatement costs.

C. The Hearing Officer shall hold an informal administrative hearing. Formal rules of evidence shall not apply to this hearing; however, there shall be an opportunity to present testimony, documentary evidence, and other evidence to the Hearing Officer, and to cross-examine witnesses. Only the specific parties that requested the hearing, and the City, may participate in the hearing.

D. The Hearing Officer may continue the hearing and request additional information as is reasonable and necessary.

E. At the conclusion of the hearing, or within 5 days thereafter, the Hearing Officer shall issue a decision approving, denying, or modifying the amount of the nuisance abatement costs that the City is entitled to recover. The Hearing Officer’s decision shall be final. The City shall serve notice of the Hearing Officer’s Decision in accordance with this Chapter.

F. All costs of the hearing, including attorneys’ fees, shall be borne by the non-prevailing parties. If any cost recovery is upheld, even in part, the City shall be the prevailing party. If cost recovery is entirely denied, the requesting parties shall be the prevailing parties.

G. If the City is the prevailing party, the Hearing Officer’s decision shall order the responsible parties to pay the confirmed nuisance abatement costs to the City within 30 calendar days, and shall specify that any confirmed nuisance abatement costs not paid within 30 calendar days shall become a lien and special assessment against the nuisance property. 1.22.080 Service.

A. All notices and documents required to be served under this Chapter shall be served by certified mail with return receipt requested.

B. Service shall be deemed effective on the date of mailing.

C. The failure of a party to receive any notice or document properly served pursuant to this Chapter shall not affect the validity of the notice or document, the validity of its service, or the City’s cost recovery rights.

D. Unless otherwise provided in the invoice, all notices and documents required to be served on the City pursuant to this Chapter must be personally served or mailed to the City Clerk’s office. The notice or document must be received by the City within the time specified for service.

1.22.090 Nuisance Abatement Lien.

B. Prior to recording a lien, the City shall serve notice of the lien on all persons or entities with a recorded interest in the nuisance property. In addition, the owner of record shall be served in accordance with Government Code section 38773.1.

C. In the event that the lien is discharged, released, or satisfied, then notice of the discharge, release, or satisfaction shall be recorded on the nuisance properly.

D. If the lien is not satisfied within 90 calendar days, the City may foreclose on the lien. [Ord. No. 568, Section 2, 5/10/17.]

1.22.100 Special Assessment.

A. If the nuisance abatement costs are upheld, in full or in part, by the Hearing Officer, or if the time for requesting a hearing has elapsed and the invoice has not been paid in full within the time designated by this Chapter, the City may levy a special assessment against the nuisance property for any unpaid nuisance abatement costs. The special assessment may also be recorded against the nuisance property. The recording shall specify that the nuisance property may be sold after three years by the tax collector for the unpaid delinquent assessments.

B. Prior to recording, the City shall serve notice of the special assessment on all persons or entities with a recorded interest in the nuisance property. In addition, the nuisance property owner shall be served in accordance with Government Code section 38773.5.

C. Notice of the special assessment shall be provided to the tax collector for the county to add the amount of the special assessment to the next regular tax bill levied against the nuisance property, and it shall be collected at the same time and in the same manner as ordinary taxes are collected, subject to the same penalties and procedures under foreclosure and sale in case of delinquency as provided for other taxes.

D. After recordation, the special assessment may be foreclosed on as a lien in the manner and means provided by law. [Ord. No. 568, Section 2, 5/10/17.]

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ADELANTO,

COUNTY OF SAN BERNARDINO, CALIFORNIA, PROVIDING FOR AN

APPOINTMENT TO THE PLANNING COMMISSION
WHEREAS, the Adelanto City Charter, Article XI, Section 1103. Appointment and Removal of Members provides that members of all commissions and boards of the City shall be appointed by the City Council and shall serve at the pleasure of said City Council.

Such appointment shall be made by resolution, adopted by the affirmative vote of not less than three (3) members of the City Council. Any vacancy on any board or commission, from whatsoever cause arising, shall be filled by resolution, carried by not less than three (3) affirmative votes of the City Council. Upon a vacancy occurring leaving an unexpired portion of a term, any appointment to fill such vacancy shall be for the unexpired portion of such terms.

WHEREAS, Mayor Reyes has nominated to the Planning
Commission, for a term concurrent to the Council Members term.
