6 5. DISCUSSION - NATIONAL LEAGUE OF CITIES LEGISLATIVE CONFERENCE IN DC ON MARCH 16-18, 2026. (JESSIE)
RECOMMENDATION: Staff recommends that the City Council discuss and provide direction to staff.

Magda Torrellas ensure that taxpayer funds are used responsibly when attending conferences or meetings. The speaker encouraged Council Members to attend the sessions, training sessions, and meetings associated with such events and to return with information and benefits that positively impact the City. The speaker also referenced past situations where some officials allegedly did not fully participate in conference activities and emphasized the importance of accountability and making sure public funds are spent appropriately.

Diana Esmeralda raised concerns about the use of taxpayer funds for City Council travel and conference attendance, questioning the value of sending Council Members to the National League of Cities conference based on what she described as limited benefits from past conferences. She also referenced allegations involving the use of city vehicles, fuel receipts, and FPPC fines.

During her comments, the Mayor asked her to remain focused on the agenda item, and she responded that her remarks were relevant because they related to past conference participation and its benefit to taxpayers.

The City Council directed staff to enroll the City as a member of the National League of Cities, register Council Members to attend the Congressional Conference in Washington, D.C., and coordinate the necessary hotel accommodations and airfare.

7. DISCUSSION – GARAGE/YARD SALE APPLICATION (TODD)
RECOMMENDATION: Staff recommends that the City Council discuss and provide direction to staff.

Mayor Reyes opened Public Comment at 12:32 p.m.

Magda Torrellas shared concerns about proposed restrictions and fees related to yard sales, stating that many residents rely on yard sales to earn extra money when they are struggling financially.

He suggested that limiting yard sales to three times per year and charging a $20 fee is too restrictive and unfair to residents trying to make ends meet. The speaker recommended reducing 15 City Council Minutes
Regular Meeting
January 14, 2026
7 the fee and allowing flexibility for residents who work on weekends. He also emphasized that most people keep their areas clean and should not be assumed to create problems.

Shad Boyd commented that the City should consider how yard sale regulations would be enforced, including what penalties would apply if residents fail to obtain permits or clean up afterward. He questioned whether enforcement would rely on neighbors reporting one another and noted that monitoring compliance could require additional staff resources. While stating he would support whatever decision the Council makes, he encouraged them to carefully consider enforcement costs and penalty structures.

Diana Esmeralda stated that the proposed garage sale permit fee is too high and agreed with previous speakers who raised similar concerns. She suggested using the stadium parking lot for occasional swap meet nights where residents could sell items without needing a seller’s permit initially. She also noted that the proposed permit requirements could create additional workload for Code Enforcement and recommended keeping the permit fee lower.

Mayor Reyes closed Public Comment at 12:38 p.m.

City Council and staff discussed, the City Council directed staff to increase the cost of the yard sale permit from $1 to $20. Yard sales will also be limited to two per month.

2 D. CITY MANAGERS ANNOUNCEMENTS AND REPORTS
City Manager Jessie Flores- The City Manager reported on key initiatives, including issuing an RFP for no-cost home water filtration systems, announcing a free spay and neuter clinic, and promoting an upcoming Citywide Safety-Action Plan workshop. Updates also included receipt of CDBG reimbursement funds and continued progress on audits and fiscal accountability efforts.

E. CITY COUNCIL ANNOUNCEMENTS AND REPORTS
Council Member Evans- I attended the Regional Steering Committee meeting, where an upcoming election for chair and co-chair positions will take place, and noted being nominated for co-chair. She also participated in a special meeting to establish goals for the next two years, which will be shared via survey for input before final adoption. Additionally, she attended the Mojave Desert Air Quality Management District meeting and will continue serving on its budget and executive committees.

Council Member Uptergrove- I have no major updates but noted that he and the Mayor Pro Tem will be hosting the California League of Cities in Adelanto on Friday and will provide updates afterward.

Council Member Meza- Councilmember Meza provided several updates, highlighting the importance of regional and state engagement in securing resources for Adelanto, including the upcoming water filtration program. He shared that he is recovering from a recent car accident and thanked the community for their support. He also discussed a potential partnership with Safe Soil to repurpose clean dirt at no cost to improve local dirt roads, particularly in areas impacted by recent rains. I have serious concerns about recent youth violence in the High Desert, including the loss of local youth, and emphasized the need for community involvement, mentorship, and programs to support at-risk youth. He shared efforts to engage local students, connect them with educational opportunities such as Victor Valley College, and promote workforce pathways like trade programs. He encouraged residents to be proactive in supporting youth within their own circles and announced an upcoming service for a local youth, Jeremy Rosales.

Mayor Pro Tem- Mayor Pro Tem provided updates on recent meetings and regional engagement, including participation in SCAG workshops, discussions on bringing VA medical services to the High Desert, and attendance at community events such as the MLK tribute. He highlighted the importance of representing Adelanto at state and regional levels, noting key outcomes from a Sacramento trip, including progress on a sales tax measure that could increase City revenue, securing a support letter for the Highway 395 access amendment, and receiving commitment from the Assemblyman for funding to advance the City’s water infrastructure and filtration efforts.

Additional updates included participation in SBCTA and SCAG meetings, discussions with the State Treasurer on funding opportunities, and a visit to Lancaster’s stadium for redevelopment ideas. He also announced upcoming community engagement opportunities, including the “Safe Streets for All” workshop, encouraged residents to report graffiti through the city app, and shared 21 City Council Minutes

3 his appointment to a regional Emergency Resilience Center committee focused on strengthening infrastructure and disaster preparedness. The Mayor Pro Tem concluded by thanking staff and partners and emphasizing continued efforts to bring resources and improvements to Adelanto.

Mayor Reyes - The Mayor shared that although they could not attend the VVTA ribbon cutting due to a City Council meeting, they highlighted a major milestone: the unveiling of new hydrogen fuel cell buses and a fueling station in Hesperia, marking a significant step forward for regional transit. They congratulated Mayor Liz Becerra (VVTA Chair) and Councilwoman Allison Lee (Co-Chair), and thanked James Noble for his service. Several upcoming free transit ride days were announced (e.g., Transit Equity Day, Earth Day, Dump the Pump Day, Car-Free Day, California Clean Air Day). The speaker acknowledged efforts in Sacramento advocacy, thanking the Mayor Pro Tem for engaging with state legislators. A major concern discussed was Caltrans restrictions from a 1985 agreement, which continue to limit economic development along Highway 395 in Adelanto—unlike neighboring cities. Efforts are ongoing to remove these barriers, which could significantly boost growth and revenue. The recent tax revenue increase (including online sales like Amazon) is expected to benefit the city and help address infrastructure needs. The speaker also expressed concern about rising gun violence, mentioning recent local tragedies and thanking law enforcement for their work. Additional updates will be shared at a future City Council meeting.

F. PRESENTATIONS
Council Member Uptergrove presented a certificate of Recognition to Walmart Store #4392.

G. PUBLIC COMMUNICATIONS
Mayor Reyes opened public comment at 11:48 a.m.

Daniel Ramos- Good morning, Mayor, City Council, City Manager, and everyone in attendance.

My name is Daniel Ramos, and I am a resident of the city.

I’d like to take a moment to thank the Council and the residents for continuing to support opportunities for our elected officials to attend meetings and conferences in places like Sacramento, Washington, D.C., Salt Lake City, and League of California Cities policy committee meetings. As we heard at the last meeting, some residents questioned what was being brought back and what work was being done.

As a resident, I want to express my appreciation. The proof is in the results. It is important for me to see our Mayor and Council actively involved and engaged in conversations that matter, conversations that may not show immediate results but will benefit our city in the years to come. 22 City Council Minutes

E. WORKSHOP PRESENTAION

1. SAFE STREETS FOR ALL COMMUNITY WORKSHOP ALTA PLANNING + DESIGN, INC.

Katlin Scott presented the Safety Action Plan.

Mayor Pro Tem Ramos opening remarks, he thanked the Mayor, City Council, staff, residents, and stakeholders for their leadership, participation, and commitment to improving Adelanto. He emphasized that community input is essential in shaping policies, priorities, and investments. He recognized Alta Planning and Design for their expertise in supporting the City’s safety study. He explained that the workshop is part of the Citywide Safety Action Plan, funded by a $240,000 federal grant, focused on improving traffic safety for all users. The study aims to identify street improvements and safety needs for drivers, pedestrians, bicyclists, and others. He highlighted that safer streets would lead to fewer accidents, better mobility, improved connectivity, and enhanced quality of life. The results will help guide future infrastructure investments and secure additional funding opportunities.

Community comments:

Tina Capilos- I previously raised concerns about road conditions near Adelanto High School and followed up with the superintendent’s office. I was told that improving/paving the road near the high school will require coordination between the City of Adelanto and San Bernardino County, and responsibility largely falls on those agencies. The issue is outside the City’s General Plan, so progress depends on working with the County. I urge the city officials to engage directly with San Bernardino County to address safety concerns. Also paving Adelanto Road, repairing sidewalks on Bartlett and Pearmain, fixing another dangerous road near Don Bradach Elementary School. I hope grant funding can help accelerate these improvements.

Due to health issues, I have been unable to attend County meetings but plan to continue advocating.

Jennifer Garcia- I speak on behalf of the community about safety concerns around Adelanto High School. She emphasized the need for sidewalks, better traffic control (stop signs, flashing lights, speed-activated signals), and improved street lighting. She highlighted the importance of bike safety, including clearly marked bike lanes and maintained crosswalks. Key problems include Aster Road and Mojave Road, especially during school dismissal, where students cross without guidance or safety personnel. Mojave Road is considered a high-risk 30 City Council Minutes
Workshop Meeting

3 roadway, yet students and parents rely on it daily. She noted concerns about insufficient access (only one way in/out), which poses risks during emergencies. She stressed that many students are new drivers, making proper road markings and safety measures even more critical. Overall, she urged the city to listen to the community and take action to improve infrastructure and ensure student safety.

City Council Closing Remarks:

Mayor Reyes praised the presentation and ongoing efforts to improve traffic safety measures, including stop signs and related projects. He commended staff for securing funding, noting it will significantly benefit the community. He explained that completed studies (traffic, feasibility, etc.) strengthen the City’s ability to compete for funding by making projects more “shovel ready.” These preparations help the city secure resources when advocating in Sacramento and Washington, D.C. He encouraged greater community participation and engagement, noting increased involvement and urging continued growth. He encouraged residents to promote participation, especially by having others complete the City’s survey if they cannot attend meetings. He emphasized that the survey is important for gathering community input and supporting City efforts. He noted the need to provide accessible ways for residents to engage, such as through the city website. He thanked everyone for attending and participating.

Council Member Meza thank you staff and community members for attending and showing unity and commitment to improving the city. He encouraged residents to actively advocate for change, including sharing emails and spreading awareness among other parents in the area. He suggested building a community-driven movement, especially among parents near the school who share similar concerns. He emphasized that many people have concerns but may not know how to voice them, and community leadership can help drive action forward.

The City Council and Alta Planning discussed, and all questions were answered.

F. ADJOURNMENT
The next Regular Meeting of the City Council will be held on February 11, 2026, at 11:00 a.m.

ORDINANCE NO. 661

AN ORDINANCE OF THE CITY OF ADELANTO

PERTAINING TO THE MAINTENANCE OF VACANT LAND

OR PROPERTY
WHEREAS, the City Council of the City of Adelanto (“City”) finds that vacant land and property left unmaintained creates public nuisances including blight, accumulation of trash and debris, fire hazards, vermin infestation, vandalism, and adverse impacts on property values and public health; and
WHEREAS, such conditions negatively impact surrounding neighborhoods and impose direct and indirect costs on the City, including inspection, enforcement, administrative processing, monitoring, and increased public safety response; and WHEREAS, the City has the police power under Article XI, Section 7 of the California Constitution to regulate land use and abate nuisances to protect the public health, safety, and welfare; and

SUBJECT: CONSIDERATION OF APPROVAL OF THE PURCHASE OF 251 ACRE-FEET OF 1)

CARRYOVER RIGHT WATER FROM LHC ALLIGATOR, LLC IN THE AMOUNT OF $130,771 AND 2) MAKEUP OBLIGATION THROUGH MRM WATER
STAFF RECOMMENDATION:

Staff recommends that the Adelanto Public Utility Authority (APUA) Board approve the Request for Assignment of Carryover Right agreement and authorize the purchase of 251 acre-feet of Carryover Right water from LHC Alligator, LLC in the amount of One Hundred Thirty Thousand Seven Hundred SeventyOne Dollars ($130,771) and authorize the Executive Director to execute the agreement and any related documents. Additionally, staff recommends that the APUA Board approve the transfer of 80 Acre Feet of Makeup Obligations through MRM Water.

BACKGROUND:

Water rights in the Mojave Basin Area are administered under the judgment in City of Barstow, et al. v.

City of Adelanto, et al., which established a physical solution for managing groundwater production in the basin. Under that judgment, the Mojave Basin Area Watermaster and the Riverside County Superior Court oversee production, replacement obligations, and certain makeup transfers of water rights.

Available carryover rights may be used, subject to Watermaster approval and applicable procedures, in lieu of direct payment of replacement water assessments. Accordingly, 1) the Adelanto Public Utility Authority has negotiated successfully directly with a seller and seeks to purchase 251 acre-feet of Carryover Right from LHC Alligator, LLC. 2) The APUA has contracted with MRM as the Authority’s broker to obtain an additional 40 Acre Feet of Makeup obligations.

The attached agreement provides for the transfer of 251 acre-feet of Carryover Right to the Authority at a price of $521.00 per acre-foot, for a total of $130,771. Additionally, the authority is buying 80 acre feet at $55 through MRM water. Approval of this item would allow the Authority to secure additional water supply flexibility and address its water management obligations. 61 FISCAL IMPACT:

The fiscal impact of this item is $130,771 + $4,575= $13,475 to Adelanto Public Utility Authority.

The savings to the APUA through this purchase vs direct payment to the watermaster is $11,044+ $17,979.80= $29,023.80
ATTACHMENT:

2. Request for Assignment of Carryover Right in Lieu of Payment of Replacement Water Assessments

SUBJECT: City of Adelanto 2025-26 Water Year Makeup Obligation Assessments to the Mojave Basin Area Watermaster.

This memorandum summarizes the City of Adelanto’s 2025-26 Water Year makeup obligation assessment and presents the proposed transfer intended to satisfy that obligation in lieu of payment of the Mojave Basin Area Watermaster assessment. Supporting documentation summarizing the transfer and associated lease costs is enclosed.
2025-26 WATER YEAR MAKE-UP OBLIGATION ASSESSMENTS
From the 2024-2025 Water Year, the City of Adelanto incurred a makeup water obligation in the Centro Subarea. Makeup obligations in Centro arise when there is a deficit in the natural flow of water from the Alto Subarea to the Centro Subarea. The deficit is allocated among producing parties based on each party’s proportional share of production relative to the Free Production Allowance produced during that water year.

These deficit and proportional share calculations are performed by the Mojave Basin Area Watermaster in arrears and are assessed to all parties that produce Free Production Allowance during that water year. To satisfy makeup obligations to the Centro Subarea, the Judgment and the Watermaster Rules and Regulations allow Alto Subarea producers to assign Centro Free Production Allowance or Carryover through temporary transfers. The required assignment ratio is two acre-feet for every one acre-foot of makeup obligation, commonly referred to as the 2 to 1 requirement.

Based on the current Watermaster assessment rate, the total avoided costs is $17,979.80.

SUMMARY
During the 2024-25 Water Year, the City of Adelanto incurred a 39.92 acre foot makeup obligation to the Centro Subarea. To address this obligation, Mojave Resource Management, LLC coordinated the sourcing of a temporary water right assignment to satisfy the required makeup obligation through a Carryover transfer.

This transfer is being presented for Adelanto’s review and approval. Upon approval, the transaction will be submitted to the Mojave Basin Area Watermaster to satisfy the makeup obligation through the assignment of Carryover water rights in lieu of payment of the Watermaster makeup assessment rates.

Please review the enclosed transactions and provide confirmation no later than March 25, 2026. If you have any questions or require additional information, please contact me at (760) 985-6261 or at [email protected].

SUBJECT: CONSIDERATION OF ACCEPTANCE AND PUBLICATION OF THE ADELANTO WATER

MASTER PLAN
STAFF RECOMMENDATION:

Staff recommends that the Adelanto Public Utility Authority Board accept and authorize publication of the Adelanto Water Master Plan.

BACKGROUND:

The Adelanto Public Utility Authority retained a consultant to prepare a Water Master Plan for the Authority’s water system. The Water Master Plan has been completed and reviewed by the Engineering Department.

The Water Master Plan is a long-term planning document that evaluates the Authority’s existing water system, identifies system conditions and capacity, assesses future demand, and outlines improvements needed to support existing users and future growth. The Plan provides the Authority with important information regarding system capacity, facility conditions, operational constraints, and improvement needs. It is intended to support reliable and safe water service, assist with capital planning, and help position the Authority for continued growth and future infrastructure investment.

Publication of the Water Master Plan will provide the Authority with a formal planning document to guide long-range decision-making, estimate capital improvement needs, and support service expansion and system reliability. The Plan will also serve as a reference for future capital programming, system upgrades, and funding opportunities.

FISCAL IMPACT:

There is no fiscal impact associated with acceptance and publication of the Water Master Plan.

OVERVIEW
What is a Water Master Plan?
A Water Master Plan is a long-term strategic document that evaluates the City’s existing water system and plans for future needs. It identifies current system conditions, future water demands, and infrastructure improvements needed to serve residents, businesses, and growth.

Ensures reliable and safe water service for existing and future development.

Identifies system deficiencies before they become
emergencies.

Supports fire protection, public health, and economic
development.

Provides a roadmap for prioritizing capital investments.

Positions the City to pursue state and federal infrastructure funding.

Why is it important?

EXISTING WATER

FACILITIES
The City’s water system consists of wells, tanks,
pump stations, pressure zones, and transmission
pipelines distributed throughout the City. Facilities
are designed to serve areas with different
elevations and pressure needs.

This map shows how water is currently supplied,
stored, and distributed. It highlights the geographic
extent of the system and service areas.

KEY NEAR-TERM IMPROVEMENTS
228
Key Long-Term
Improvements
Additional water storage on the west end
of the City for each pressure zone.

A new pressure zone for the higher
elevation lots proposed at the northwest
corner of the City.

New well field and/or water treatment
plant at the southwest end of the City as
well as an upgrade to the existing well
field and treatment plant.

Various large diameter transmission
mains to convey water from the supply
source to the storage tanks.
229
Water Quality:

The city has 3 sources of water :
70%: Adelanto Public Utility wells located throughout the city.

Most pumped water comes f rom aquifers that supplied by the Mojave r iver .
30%: Mojave Water Agency connection- water coming f rom wells located at I15
Emergency Standby connection with Victorville- when one of the sources is not available.

Well water gets t reated for pur ity and hardness at our t reatment plant on turner road.

Water f rom Mojave water agency is in potable condition and gets blended into ci rculation.

Over the last year , the city implemented a system of proactive flushing of fi re hydrants.

That ensures that water does not sit too long in the pipes and helps with color /smell concerns.

The state mandates constant testing of the water for known substances such as Arsenic, Fluor ide, Chlor ide, I ron, etc.

The 2024 Water Quality repor t compared results of Adelanto testing to Victorville and Mojave water agency- highlighting Adelanto’s better water quality on several specific measures (most notably Arsenic, Chromium, and nit rate contents) .

SUBJECT: AN ORDINANCE OF THE CITY OF ADELANTO AMENDING CHAPTER 2.08 OF THE

ADELANTO MUNICIPAL CODE TO REMOVE THE BOND REQUIREMENT FOR THE CITY

CLERK AND RENUMBER SUBSEQUENT SECTIONS
STAFF RECOMMENDATION:

Staff recommends:

1. City Council introduce and conduct the first reading of Ordinance No. 662 to approve AN ORDINANCE OF THE CITY OF ADELANTO AMENDING CHAPTER 2.08 OF THE ADELANTO MUNICIPAL CODE TO REMOVE THE BOND REQUIREMENT FOR THE CITY CLERK AND RENUMBER SUBSEQUENT SECTIONS.

2. City Council schedule the second reading of Ordinance No. 662 for the next regularly scheduled Council meeting.

BACKGROUND:

Chapter 2.08 of the Adelanto Municipal Code establishes the office, duties, and compensation of the City Clerk.

Section 2.08.020 currently requires the City Clerk to execute a bond upon entry into the duties of the office.

The Municipal Code currently requires the City Clerk to carry bond insurance to provide protection in the event of omissions or errors in the performance of official duties. However, State law does not require charter cities to maintain a bond requirement for the City Clerk.

The City has determined that the bond requirement is no longer necessary and that removing the requirement will simplify administrative procedures and eliminate an unnecessary administrative cost.

The proposed Ordinance repeals Section 2.08.020 of the Adelanto Municipal Code, which requires the City Clerk to execute a bond. In addition, the Ordinance renumbers the remaining sections of Chapter 2.08 to maintain an orderly structure within the Municipal Code. The amendment does not change the duties, authority, or responsibilities of the City Clerk. The Ordinance only removes the administrative requirement related to the bond.

FISCAL IMPACT:

Removal of the bond requirement will eliminate the cost associated with maintaining the City Clerk bond. The savings will accrue to the City’s General Fund.
