DATE: April 8, 2026
TO: Honorable Mayor and City Council Members
FROM: Jessie Flores, City Manager
BY: Saba Engineer, Grant Administrator
SUBJECT: Resolution Adopting List of Projects and SB1 2026/2027 Road Maintenance Program
STAFF RECOMMENDATION:

Staff recommends that the City Council approve Resolution No. 26-06.

BACKGROUND:

On April 28, 2017, the Governor signed Senate Bill (SB) 1 (Beall, Chapter 5, Statutes of 2017), which is known as the Road Repair and Accountability Act of 2017. To address basic road maintenance, rehabilitation, and critical safety needs on both State and local roads, SB 1 increases per-gallon fuel excise taxes, diesel fuel sales taxes and vehicle registration fees, and provides for inflationary adjustments to tax rates in future years.

Beginning November 1, 2018, the State Controller (Controller) began depositing this new funding into the newly created Road Maintenance and Rehabilitation Account (RMRA). A percentage of this new RMRA funding is annually apportioned to eligible cities and counties pursuant to Streets and Highways Code (SHC) Section 2032(h) for basic road maintenance, rehabilitation, and critical safety projects on the local streets and roads system.

Annually, the City of Adelanto, along with all other eligible California agencies, submits a work plan to the California Transportation Commission (CTC) committing the following fiscal years RMRA funding to a specific pavement preservation project in the coming year or in a future year if the City so desires. The submission of the work plan maintains the City's eligibility to garner RMRA funding during the forthcoming fiscal year. Without this commitment to RMRA funds the City loses its eligibility to collect RMRA funding through the State Controller's Office (SCO).

All agencies must submit their proposed SB 1/RMRA FY 2026/27 project lists to the California Transportation Commission annually. City Council action is required to designate projects for the allocation of RMRA funding.

The City expects to receive an allocation of $950,000 in FY 2026/27 that can be used for road maintenance and rehabilitation, safety projects, complete street components, or traffic control devices.

After a comprehensive review of the assessment results, staff identified following street segment to be included on the upcoming fiscal year SB1/RMRA projects. Staff’s basis for the recommendation was to ensure SB1 revenues are being used on the highest-priority and most cost-effective projects that also meet the community’s priorities for transportation investment. 32 FISCAL IMPACT:

There is no fiscal impact to General funds associated with this action. The applicant will pay for any cost incurred in the process.

WHEREAS, Senate Bill 1 (SB 1), the Road Repair and Accountability Act of 2017 (Chapter 5, Statutes of 2017) was passed by the Legislature and Signed into law by the Governor in April 2017 to address the significant multi-modal transportation funding shortfalls statewide; and

WHEREAS, this is the nineth year in which the City is receiving SB 1 funding and will enable the City to continue essential road maintenance and rehabilitation projects, safety improvements, repairing and replacing aging bridges, and increasing access and mobility options for the traveling public that would not have otherwise been possible without SB 1; and WHEREAS, the City has undergone a robust public process to ensure public input into our community’s transportation priorities/the project list; and WHEREAS, the City strives to ensure SB-1 revenues are being used on the most cost- effective projects, primarily in residential zones that also meet the communities priorities for transportation investment; and
WHEREAS, the funding from SB1 will help the City maintain and rehabilitate streets, roads, bridges, add active transportation infrastructure throughout the City this year and similar projects into the future; and

SUBJECT: GENERAL PLAN ANNUAL PROGRESS REPORT FOR 2025
STAFF RECOMMENDATION:

Staff recommends that the City Council:

1. Approve the 2025 General Plan Annual Progress Report; and

2. Direct staff to submit the report to the Governor’s Office of Land Use and Climate Innovation (LCI) and the California Department of Housing and Community Development (HCD), as required by Government Code Section 65400.

BACKGROUND:

Government Code Section 65400 requires each city and county to prepare and provide an annual report to its legislative body, the Governor’s Office of Land Use and Climate Innovation, and the California Department of Housing and Community Development regarding the status of the General Plan and progress in its implementation. This annual report must include the City’s progress in implementing the General Plan and the status of housing-related actions undertaken during the reporting period.

The City of Adelanto last updated its General Plan in 2022. The attached 2025 General Plan Annual Progress Report summarizes actions taken during the reporting period to implement the Adelanto North 2035 Comprehensive Sustainable Plan. The report identifies key legislative actions, planning activities, development approvals, and ordinance updates that advanced implementation of the General Plan.

ANALYSIS:

During 2025, the City continued implementation of the General Plan through land use, zoning, and housing-related actions. Major implementation efforts included approval of the Northeast Mixed Use Overlay Zone, initiation of a High Density Overlay Zone, and updates to the City’s ADU and JADU regulations to maintain consistency with State housing law. These actions were intended to expand housing opportunities, support mixed-use development, address nonconforming land use conditions, and promote economic development in targeted areas of the city. 38 The report also identifies development activity that supports General Plan implementation. In 2025, the City entitled a 132-unit affordable housing project and multiple residential subdivision projects totaling 243 units, which advanced the City’s housing production goals and broader land use objectives.

The City also continued to advance implementation of the Housing Element during 2025. The City reported 40 permitted units in 2025 and has permitted a total of 170 housing units through 2025, representing approximately 4.5 percent of its total RHNA obligation of 3,763 units.

ENVIRONMENTAL IMPACT:

There are no anticipated environmental impacts associated with the submission of this report.

FISCAL IMPACT:

There is no fiscal impact resulting from the submission of this report.

1. Introduction.

This Annual Progress Report summarizes actions taken by the City of Adelanto during the reporting period to implement the Adelanto North 2035 Comprehensive Sustainable Plan General Plan. The report identifies key legislative actions, planning activities, development approvals, and ordinance updates that advanced General Plan implementation, including land use amendments, zoning text updates, and housing-related code revisions.

2. Date of presentation/acceptance by the local legislative body (agenda item or resolution).

The City Council considered General Plan Amendment No. GPA 25-01 and Zone Text Amendment No. ZTA 25-01 on October 22, 2025, through Resolution No. 25-59, and Ordinance No. 658 was subsequently adopted on November 12, 2025.

3. The date of the last update to the General Plan.

October 2022

4. Measures associated with the implementation of the general plan with specific reference to an individual element.

The City advanced implementation of the Land Use Element through approval of General Plan Amendment No. GPA 25-01 and Zone Text Amendment No. ZTA 25-01, which amended the General Plan Land Use and Zoning Map and revised Appendix A of the Zoning Code to establish the Northeast Mixed Use Overlay Zone. This action was intended to increase residential and commercial density, expand opportunities for housing and mixed-use development, eliminate nonconforming uses, and promote economic development opportunities in the northeast portion of the city. The amendment also supports multimodal land use patterns and reduced vehicle miles traveled consistent with State Senate Bill 743.

5. Housing Element APR reporting requirements
The Housing Element Annual Progress Report was submitted separately. For the 6th Cycle Housing Element, the City has permitted a total of 170 housing units through 2025, which represents approximately 4.5 percent of its total RHNA obligation of 3,763 units. Of the units permitted to date, 12 units were reported in the low-income category, 1 unit in the moderateincome category, and 157 units in the above moderate-income category, based on the table below. In 2025, the City reported 40 permitted units. Staff is also working with HCD to revise the City’s 2021 permitted unit count so that the City’s Housing Element APR more accurately reflects permit activity during the current planning period. 40 General Plan Annual Progress Report

6. The degree to which the General Plan complies with LCI’s General Plan Guidelines, including environmental justice considerations, collaborative planning with military lands and facilities, and consultation with tribal communities.

The City continues to implement the General Plan through coordinated land use, housing, and zoning updates. The record for GPA 25-01 and related amendments demonstrates consistency findings with the General Plan, consideration of environmental review under CEQA, and public hearing processes before the Planning Commission and City Council.

7. Priorities for land use decision-making that have been established by the local legislative body (e.g., the passage of moratoria or emergency ordinances).

The City prioritized land use decisions that would increase housing opportunities, allow greater development flexibility, address nonconforming land use conditions created by prior amendments, and support broader economic development objectives. City-initiated General Plan and zoning amendments focused on expanding mixed-use and higher-density residential opportunities in strategic areas of the city, while also updating local regulations to maintain consistency with state housing law.

8. Goals, policies, objectives, standards, or other plan proposals that need to be added or were deleted, amended or otherwise adjusted.

The City initiated updates to its Accessory Dwelling Unit (ADU) and Junior Accessory Dwelling Unit (JADU) regulations to ensure consistency with current state law, including Government Code section 66326 and recent legislative changes such as SB 1211. This update repeals and replaces the existing ADU/JADU provisions in Section 17.20.080 of the Municipal Code and establishes revised standards and procedures for ministerial review, development standards, processing timelines, and related implementation requirements. 41 General Plan Annual Progress Report
3 | P a g e
The Planning Commission recommended the amendments on February 4, 2026, and the City Council considered Ordinance No. 660 on March 11, 2026.

9. One or more lists of the following, including reference to the specific general plan element or policy, status (i.e., approved/denied, initiated/ongoing/completed, etc.), and a brief comment on how each advanced the implementation of the General Plan during the past year:
a. Planning activities initiated – These may include but are not limited to, master plans, specific plans, master environmental assessments, annexation studies, and other studies or plans.

The City initiated a General Plan Amendment and Zone Text Amendment to establish a High Density Overlay Zone intended to increase housing density, address ongoing housing shortages, provide flexible land use regulations, and encourage affordable housing opportunities in designated areas. The proposal would amend the Adelanto North 2035 Comprehensive Sustainable Plan, the Land Use Plan, the General Plan Land Use and Zoning Map, and Appendix A of the Zoning Matrix.
b. General Plan amendments – These may include agency-driven as well as applicantdriven amendments.

The City approved a General Plan Amendment and Zone Text Amendment establishing the Northeast Mixed Use Overlay Zone (attached below). The amendment revised the General Plan Land Use and Zoning Map and Appendix A of the Zoning Code to increase residential and commercial density, expand mixed-use and housing opportunities, and support economic development in the northeast area of Adelanto. The City Council first considered the matter on October 22, 2025, and Ordinance No. 658 was adopted on November 12, 2025. c. Major development applications processed.

In 2025, the City entitled a 132-unit affordable housing project and multiple residential subdivision projects totaling 243 units. These approvals advanced the City’s housing production goals and implementation of the General Plan’s land use and housing objectives. 42 ORDINANCE NO. 658

TO: Honorable Mayor and City Council Members
FROM: Jessie Flores, City Manager
BY: Todd Litfin, City Attorney
SUBJECT: ORDINANCE AMENDING CHAPTER 5.08 OF THE ADELANTO MUNICIPAL CODE (GARAGE AND YARD SALES)
STAFF RECOMMENDATION:

Staff recommends that the City Council:

1. Introduce and waive the first reading of an ordinance amending Chapter 5.08 of the Adelanto Municipal Code to allow up to two (2) yard or garage sales per month per residential property, and

2. Establish a permit fee of ten dollars ($10.00) per permit.

BACKGROUND:

Chapter 5.08 of the Adelanto Municipal Code regulates garage and yard sales within the City to prevent excessive commercial activity in residential neighborhoods while allowing residents to conduct occasional sales of personal property. The ordinance establishes permit requirements, limits on sale duration, and inspection authority to protect public health, safety, and neighborhood quality of life.

The current permit fee of one dollar ($1.00) has remained unchanged for decades and no longer reflects the administrative costs associated with processing permits. Additionally, the ordinance restricts yard and garage sales by requiring a significant time gap between events at the same location.

The proposed amendment updates these regulations by allowing up to two (2) yard or garage sales per month per residential property and increasing the permit fee to ten dollars ($10.00), while maintaining existing safety, duration, and enforcement provisions.

FISCAL IMPACT:

The updated permit fee of ten dollars ($10.00) will generate minor revenue to offset administrative costs associated with processing permits. No additional staffing or budget adjustments are required.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ADELANTO, COUNTY OF SAN BERNARDINO, CALIFORNIA, AMENDING CHAPTER 5.08 (GARAGE AND

YARD SALES) OF THE ADELANTO MUNICIPAL CODE TO ALLOW UP TO TWO (2) YARD OR GARAGE SALES PER MONTH AND TO ESTABLISH A TEN DOLLAR ($10.00) PERMIT FEE
WHEREAS, the City of Adelanto is a municipal corporation organized and existing under the laws of the State of California; and
WHEREAS, Chapter 5.08 of the Adelanto Municipal Code regulates garage and yard sales in order to protect the public health, safety, and welfare; and WHEREAS, the City Council desires to provide residents with additional flexibility to conduct yard and garage sales while maintaining reasonable regulations; and WHEREAS, the City Council finds that updating the frequency and permit fee for yard and garage sales is necessary to reflect current community needs and administrative costs.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ADELANTO DOES HEREBY ORDAIN AS FOLLOWS:

SECTION 1
Amendment to Chapter 5.08 – Garage and Yard Sales.

Chapter 5.08 of the Adelanto Municipal Code is hereby amended to read as follows:

Chapter 5.08

GARAGE AND YARD SALES

5.08.010 Definition.
“Yard Sale” or “Garage Sale,” for the purposes of this Chapter, shall mean any event which is advertised by any means whatsoever as a place or location to which members of the public may come and purchase identifiable or tangible personal property; provided, however, it shall not include any such event which constitutes a sales activity, wholesale or retail, by any business that holds a current business license issued by the City.
74 5.08.020 Permit Required – Issuance Conditions.

It shall be unlawful for any person, corporation, partnership, joint venture, association, or any other form of organization to organize, conduct, establish, or operate a yard sale or garage sale in the City without first obtaining a permit from the Collector or his or her authorized representative.

B. The applicant has submitted satisfactory evidence that adequate and safe parking accommodations will be provided; and
C. The location at which the proposed yard sale or garage sale is not at a location at which a yard sale or garage sale has been conducted within six (6) months immediately preceding the date of filing the pending application has not exceeded the maximum number of permitted sales as set forth in Section 5.08.030; and D. The applicant has paid the application fee as provided in Section 5.08.040.

5.08.030 Permit – Duration and Frequency.

A. Any permit issued hereunder shall be for a period not exceeding five (5) consecutive calendar days from the date of issuance. All advertising carried on in conjunction with the sale shall be removed after completion of the sale.

B. A maximum of two (2) yard sales or garage sales per calendar month shall be permitted per residential property.

C. The maximum number of yard sales or garage sales permitted for any multi-family residence shall be one (1) per calendar year per occupied unit. Tenants of multi-family residences shall obtain written permission from the property owner prior to applying for a permit and shall submit such authorization at the time of application. Only the occupant of the multi-family residential unit shall be permitted to apply for and obtain a permit.

5.08.040 Permit – Application – Fee.

Application for a yard sale or garage sale permit shall be made to the City Clerk on forms provided by the City and shall be accompanied by a fee of one dollar ($1.00)

Permits shall be displayed at the site of the sale at all times during the permitted event.

5.08.050 Inspection.

All identifiable and tangible personal property exhibited for sale at a yard sale or garage sale shall be made accessible by the permittee to law enforcement officials at all times for review and inspection. During any such sale, the location shall be open to all fire prevention and health officers of the City for inspection to ensure compliance with City and State of California fire prevention and health regulations.

5.08.060 Misdemeanor.

Any person or organization that violates any provision of this Chapter shall be guilty of a misdemeanor, punishable by a fine not exceeding five hundred dollars ($500.00), imprisonment for a period not exceeding six (6) months, or by both such fine and imprisonment.

SECTION 2
Severability.

If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this Ordinance.
76 SECTION 3
Effective Date.

This Ordinance shall take effect thirty (30) days after its adoption.
