RESOLUTION NO. 26-08
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ADELANTO, COUNTY OF
SAN BERNARDINO, CALIFORNIA, CONFIRMING THE DETACHMENT OF CERTAIN
CITY-OWNED PROPERTIES
Council Member Evans explained that she pulled the item because she wanted to raise concerns and pose rhetorical questions about the City's loss of jurisdiction over the property. She stated that when the property was sold in 2014, it should have been removed from Adelanto's sphere of influence at that time. She expressed concern that, because this did not occur, the City of Victorville was able to make land use decisions on property that she believed should have remained under Adelanto's jurisdiction. She described this as another example of Adelanto losing land and opportunities, referring to it as a "big bank takes little bank" situation. Although she voiced concerns about the history of the property and the circumstances surrounding its detachment, she indicated she was still supportive of approving the resolution, recognizing it as the appropriate action to formally correct the jurisdictional issue.

AND HIDALGO ENERGY STORAGE LLC FOR DEVELOPMENT OF THE
PROPERTY LOCATED AT THE NORTHEAST CORNER OF RACCOON ROAD AND HOLLY ROAD, ASSESSOR’S PARCEL NUMBER 3128-081-01-0000
City staff presented the proposed Hidalgo Energy Storage Project, explaining that the project consisted of a 400-megawatt battery energy storage facility on approximately 40 acres within the City's industrial zone. Staff outlined the associated Development Agreement, Conditional Use Permit, environmental exemption, and operational requirements, including decommissioning standards, environmental remediation requirements, performance bonding, and long-term site restoration obligations. Staff also explained that negotiations with the developer had resulted in revisions to the Development Agreement from what had previously been approved by the Planning Commission, including modifications to development impact fee provisions.
Council members questioned staff extensively regarding the negotiated terms of the Development Agreement, the reduction of the originally proposed $1 million development impact fee, the newly negotiated $100,000 expedited processing fee, environmental safeguards, financial protections for future site cleanup, and the absence of an existing City policy governing expedited processing fees. Staff explained that the fee resulted from negotiations to meet the developer's accelerated project timeline and acknowledged that the City currently did not have a formal expedited processing policy. Staff further emphasized that the agreement included performance bond requirements, environmental testing, and decommissioning obligations designed to ensure the City would not inherit future environmental liabilities. Council members also discussed the economic development benefits of attracting new energy infrastructure while balancing environmental protections and ensuring appropriate public benefits for the City. After discussion, the Council approved the first reading of Ordinance No. 664 and related entitlements, with the City Attorney requesting an amendment clarifying that approval of the land use entitlements would be contingent upon execution of the Development Agreement.
MOTION: Moved by Mayor Reyes seconded by Mayor Pro Tem Ramos to introduce the first reading of Ordinance No. 664, approving the Development Agreement between Hidalgo Energy Storage, LLC and the City of Adelanto; adopt Resolution No. 26-07 approving the findings, Location and Development Plan 24-07, Conditional Use Permit 24-07, and the CEQA Guidelines Section 15183 exemption, with the additional condition requested by the City Attorney that approval of the Location and Development Plan and Conditional Use Permit be contingent upon the execution of the Development Agreement.

Finance Manager Gunn presented the staff report
Staff introduced a revision to the financial structure contained in the staff report related to the PSCC Project Grant. The original amount reflected for project management services was corrected after review by staff and SGI representatives. Staff clarified that the project management services amount should be revised to zero because community-based nonprofit organizations would be participating in project management activities, while SGI would be handling management and fiscal oversight services.
Additional clarification was provided regarding the City’s potential participation in the E3P3 public-private partnership model. Staff explained that a future SGI board meeting would include consideration of a resolution for the City to become an E3P3 city. The associated participation cost was clarified as $12,000, reflecting a discounted amount from the original $24,000 fee.
Staff further explained that Attachment A, Item No. 7, outlined the proposed GAAP funding schedule and reimbursement structure. The schedule demonstrated how state or outside entity funding would be deployed to SGI to support the timely startup of the project and how reimbursement to the City would occur following project completion to ensure accountability and proper financial reconciliation.
