City Clerk

REPORT TO CITY COUNCIL
DATE: JULY 12, 2023
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: NATHAN HAMBURGER, CITY MANAGER
BY: JESSICA FORTE, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER SUBJECT: REJECT ALL BIDS FOR FISCAL YEAR 2023-24 ANNUAL CONCRETE REPAIR PROJECT; NIB 23-02
On April 26, 2023, the City Council authorized staff to seek bids for the Fiscal Year 2023- 24 Concrete Repair Project; NIB 23-02. The scope of work consists of repairing damaged concrete sidewalks, curb, gutters, and removing/replacing ADA ramps throughout the City. The Notice Inviting Bids (NIB) was advertised for two weeks, as required by California Law, in the Acorn newspaper on May 19, 2023 and May 26, 2023.

On June 15, 2023, the City of Agoura Hills received two (2) bids as follows:

Contractor Total Bid Amount
FS Contractors, Inc. $128,476.50
Dash Construction Company, Inc. $152,454.00
The lowest bid received must be rejected, as it did not comply with the bid requirements for two reasons:

1. FS Contractors, Inc. did not electronically upload the completed bid package via PlanetBids, as required in the bid documents.

2. FS Contractors, Inc. submitted the physical bid package by the required deadline, however; the bid tabulation sheet contained numerical errors and the total bid price was shown as $163,676.50 which, when calculated, equaled more than their submitted bid of $128,476.50.

The second bid, submitted by Dash Construction Company, Inc. met the bidding requirements, however, due to the high cost, staff recommends rejecting this bid as well.

Staff intends to review the scope of work, incorporate feedback from the concrete assessment authorized by City Council on June 7, 2023, and return to City Council later in the fiscal year to request authorization to bid.

RECOMMENDATION
Staff respectfully recommends the City Council reject all bids for the 2023-24 Annual Concrete Repair Project.
