REPORT TO CITY COUNCIL
DATE: JULY 8, 2026
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: NATHAN HAMBURGER, CITY MANAGER
BY:
KELLY FISHER, DEPUTY DIRECTOR OF PUBLIC WORKS
CHARMAINE YAMBAO, DIRECTOR OF PUBLIC WORKS / CITY ENGINEER SUBJECT:
APPROVE DESIGN PROFESSIONAL CONSULTANT SERVICES AGREEMENT, WITH BKF
ENGINEERS, FOR CONSTRUCTION MANAGEMENT SERVICES RELATED TO THE LOW FLOW
STORM DRAIN DIVERSION PROJECT
On September 27, 2024, the City initiated the solicitation process for construction management services related to the Low Flow Storm Drain Diversion Project. The project consists of constructing six (6) precast manhole structures in order to re-direct the urban water from the storm drains to the adjacent public sewer lines during the dry weather season, as well as, the first tenth of an inch of flow from the first storm of the wet-weather season, which can carry pollutants that are harmful to the environment. The sewer systems would then convey the flows to the Tapia Water Reclamation Facility for treatment.
Construction management services are required to support City staff during the construction phase and to help ensure the project is completed in accordance with the contract documents, approved schedule, budget, and all applicable regulatory requirements. Services shall include, but are not limited to, the following:
Monitor construction schedule and coordinate contract execution.
Provide public outreach and stakeholder coordination, as needed.
Ensure compliance with all applicable permits and regulatory requirements.
Coordinate with utility companies and other affected agencies.
Review and process contractor progress payment applications.
Manage contract change orders.
Provide construction observation, inspection, and materials and soils testing.
Review contractor traffic control plans and monitor traffic management activities.
Facilitate regular construction progress meetings and prepare meeting documentation.
Prepare the final punch list, review record (as-built) drawings, and oversee project closeout.
Provide claims analysis and assistance, as needed.
On November 4, 2024, the City received proposals from two firms: MNS Engineers, Inc. (MNS), and Willdan Engineering.
A selection committee comprised of City staff reviewed and evaluated each proposal based on the following proposal criteria:
Completeness and thoroughness of proposal.
Grasp of the scope and services to be performed.
Qualifications and experience of key personnel.
Related experience working with public agencies.
Approach to performing the work.
Following its evaluation, the selection committee unanimously determined that MNS was the most qualified firm and best suited to provide the requested services. However, due to delays in the approval of the Measure W Safe, Clean Water Program Regional Transfer Agreement (Transfer Agreement), the project could not move forward as planned. During this period, MNS merged with BKF Engineers (BKF) in March 2026. As a result, the recommended consultant is now BKF, as the successor firm to MNS.
Following the County of Los Angeles' recent execution of the Transfer Agreement, staff contacted BKF to confirm that the proposed key personnel remained available for the project. Upon receiving confirmation, staff invited BKF to submit a revised proposal.
BKF previously provided construction management services for the City on the U.S. 101/Palo Comado Interchange Project and the Roadside Drive Bridge Widening Project, delivering both projects with excellent results.
The project is expected to start construction this summer for a total length of four (4) months, with no work during holidays.
FISCAL IMPACT
The proposed agreement contains a not-to-exceed amount of $366,108 which has been accounted for in the Low Flow Diversion Project budget which includes $1,195,134 of Proposition 1 Round 1 Integrated Regional Water Management Funds, $970,503 of Measure W (Regional) Funds, $109,000 of Measure W (Local) Funds, and $970,610 of City Storm Water Capital Project Funds, for a total budget of $3,245,247.
RECOMMENDATION
Staff respectfully recommends the City Council approve the Design Professional Consultant Services Agreement with BKF Engineers for construction management services related to the Low Flow Storm Drain Diversion Project.
