Subject: Encinal Terminals Second Reading
Since publication of the Council packet for the second reading of the Encinal Terminals ordinances on February 1, 2022, staff has received questions about the location of the two changes in the documents for second reading that were requested by the City Council.
The two changes requested by the City Council address home ownership requirements and window design. Therefore those changes were added to the Master Plan in the appropriate sections on pages 31 and 32 of the Master Plan.
To ensure that any future changes to these two provisions would require a super majority vote of the City Council, the two provisions were also added to the Disposition and Development Agreement (DDA) in new Section 9.2 to the DDA.
The graphics below show the location o f the new text with the Master Plan and in the DDA. The underlined text shown in the attachments to this memorandum is identical to the text included in the second reading documents published with the Council packet.
