CITY OF ALAMEDA RESOLUTION NO.
AUTHORIZING THE CITY MANAGER TO EXECUTE AND RECORD
TWO GRANTS OF EASEMENTS TO EAST BAY MUNICIPAL
UTILITY DISTRICT OVER CITY-OWNED LAND; AND TO EXECUTE
AND RECORD TWO AMENDED AND RESTATED PARTIAL
ASSIGNMENTS OF NON -EXCLUSIVE EASEMENTS AND GRANT
OF NON -EXCLUSIVE EASEMENT OVER NAVY-OWNED LAND;
AND TO EXECUTE ANY AND ALL ANCILLARY DOCUMENTS
WHEREAS, the City owns the water distribution facilities at Alameda Point, which connect to East Bay Municipal Utility Distric t’s (EBMUD) system at four master meters; and
WHEREAS, the City is a party to the Grant of Non-Exclusive Easement for Access and Maintenance of Utility Systems at The Former NAS Alameda, recorded in 2013, which granted the City a non- exclusive easement over the Navy land where EBMUD easements are required; and
WHEREAS, the City’s easement allows the City to assign or transfer an interest in the easement to EBMUD; and
WHEREAS, on June 6, 2017, the City Council approved a Ten- Year Water Infrastructure Agreement (Agreement) between the City and EBMUD to address the incremental development and phased infrastructure implementation in the Alameda Point Reuse Area; and
WHEREAS, the Agreement requires the City to build out the water system in the Reuse Area, and pursuant to the Agreement, construction of backbone infrastructure is advancing in Alameda Point’s Reuse Area under the City’s Capital Improvements Project; and
WHEREAS, recordation of the necessary easements and assignments of easements for the new EBMUD facilities is required for construction to proceed, the location of such easements and assignments of easements as generally shown in Exhibit A to this Resolution.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Alameda that the City Manager is authorized to execute the following: two Grants of E asement over City-owned land to EBMUD; two Amended and Restated Partial Assignments of Non-Exclusive Easements and Grant of Non- Exclusive Easement over Navy -owned land; and any and all ancillary documents.
