THE COUNTY OF ALAMEDA
THIS FIRST AMENDMENT, entered into on the 20th day of September 2022 modifies the Contract (No. 22249) entered into on the 29
th day of June 2021 (Item No. 25) between the
COUNTY OF ALAMEDA, a body corporate and politic of the State of California, hereinafter referred to as “COUNTY” and the CITY OF ALAMEDA for HOME funds and eligible projects.
WHEREAS, on June 29, 2021, the COUNTY and the CITY OF ALAMEDA entered into the Contract (No. 22249) for HOME funds (the “Agreement”);
WHEREAS, the County has received a grant from the United States Department of Housing and Urban Development (HUD), for $11,016,270 from the American Recovery Plan Act (ARPA) to the Alameda County HOME Consortium for use in assisting homeless individuals and families to access permanent supportive housing;
WHEREAS, the activities of the CITY OF AL AMEDA under this Agreement with the COUNTY shall be governed by the conditions of the Grant Agreement between the COUNTY and the United States Department of Housing and Urban Development including 2 CFR 200.320(f)(2);
WHEREAS, the Parties have reviewed the CI TY OF ALAMEDA’S proposed project and have determined that the project is HOME ARPA elig ible in accordance with HUD regulations and the conditions of the HOME ARPA Grant Agreement;
WHEREAS, the COUNTY and the CITY OF ALAMEDA desire to amend the Agreement to amend the terms, scope of work and add funds for the CITY OF ALAMEDA to be reimbursed for an operating subsidy for Dignity Village, an affordable rental housing development project targeting chronically homeless individuals and families.
THEREFORE, for valuable consideration, the receipt and sufficiency of which are hereby acknowledged, COUNTY and the CITY OF ALAMEDA agree as follows:
A. Section A of the Agreement is amended so that the first sentence shall be: “The Term of this Agreement shall be from July 1, 2021 until June 30, 2028,…”
B. Section B. 2. of the Agreement is amended so that after the first sentence, “The maximum amount of HOME funds covered by this Agreement shall be two million, six hundred seventy- six thousand seven hundred twenty-nine dollars and ninety-three cents ($2,676,729.93) ($2,350,000 HOME ARPA ($322,729.93) ($224,884 entitlement and $97,845.93 program income), for both the administrative and project costs set forth in Exhibit A.”
C. Exhibit A –Scope of Work/Budget to the Agreement is replaced with the Scope of Work/Budget in EXHIBIT A (rev. 8/15/2022), attached hereto.
D. Except as provided for in this First Amendment, all other terms and conditions of the Agreement, remain in full force and effect.
