Hi there-
RE: Recommendation to Authorize the City Manager to Execute a Fifth Amendment to the Exclusive Negotiating Agreement between the City of Alameda and Brookfield Bay Area Development Holdings LLC and Catellus Development Corporation for the West Midway Project by 14 Days to July 19, 2023. (Base Reuse 29061810)" Please take this item off the consent calendar and move the item for public comment on the next meeting so the Public may have adequate opportunity to review and comment on the significant changes made to the West Midway and RESHAP projects after November 2022.

The Alameda Point EIR already contains instructions for project compliance as well as mitigation measures and suggestions for projects that dont conform to the Plan limits. Any element that is a variance from the relevant Plans and has been "Streamlined" should have mitigation that reduces the impacts from those to less than significant.

The Alameda Point EIR also requires further review by the local planning agency for any impacts/variances to ensure they are mitigated to less than significant. Additionally, for any variances that are The Project design also must comply with the AMC design standards for compatible historic architectural and landscape elements that apply to all new development in order to be approved.

Thes
The information requested above is not readily accessible in a public record, if it exists, therefore the Public has not had adequate review (per the Sunshine Ordinance).

An accessible and complete public record should therefore include documentation of:
mitigation measures for any Plan element that is not in compliance with the Main St Plan and AMC design standards, including
significant increase in use and density in excess of the Plan limits, use of (over) maximum building heights throughout the entire parcel, inadequate open space,
lack of mixed use in mixed use designated parcel
the rationale for any overriding considerations given for those variances (required per the CEQA`streamline" approval process)
demonstration that the Project conforms to architecture and neighborhood design that is compatible with the existing neighborhood.
acceptable rationale for location change of the RESHAP from the "ideal" parcel, and demonstration that the Plan Goals are still as easily achievable. achievable ample mixed use civic and commercial uses in this designated mixed-use zone connected street patterns and design,
traffic impacts from high density housing with double the approved units a demonstration of suitable architectural and landscape design and overall design consistent with the Vision of the Main St Neighborhood, especially in the vicinity of the Historic District. to also be review by the Historic Advisory Board. cumulative impacts due to the changes in acceptable use, density and design The City Attorney's office also has a duty to ensure Projects are compliant with land use plans and AMC design standards and have had adequate public review prior to approval as a members of the State Bar and as a matter of professional ethics.
