Re: Del Monte Warehouse Project—Transfer of City Parcel
Dear Andrew and Celena:
I am writing on behalf of Alta Buena Vista Owner, LLC (ABVO) to request that the City complete two actions required by the Development Agreement for the Del Monte Warehouse Project, entered into January 15, 2015, and as subsequently amended (DA).
1. Certificate of Acceptance for Clement Extension Improvements ABVO recently completed the Clement Extension improvements as required by DA § 6(b).
ABVO and/or its predecessor previously submitted an offer to dedicate these improvements to the City. We now request that the City Attorney’s Office prepare the certificate of acceptance and that the City formally accept the improvements.
2. Transfer of AHA Remnant Parcel
As you will recall, the Affordable Housing Agency (AHA) agreed to return to the City a small piece of property located near the driveway of Littlejohn Commons, commonly known as the “Remnant Parcel.” In turn, the City agreed to convey the Remnant Parcel to ABVO within 15 days after accepting the Clement Extension. This is memorialized in DA § 7(c) and in the “Confirmation of Entitlement Status” letter, dated October 1, 2019, at § 9.
DA § 7(c) provides that the City will convey the Remnant Parcel by quitclaim deed, following City Council authorization “by ordinance at a public meeting.” We request that the City Attorney’s Office prepare the quitclaim deed, along with any other documents needed to effectuate the transfer, and provide us with copies to review. If a further City Council hearing is required, we request that it be scheduled as soon as possible.
