Hi Trish,

I referenced the areas in the Legislative Agenda where I think we could lend the City’s support for Prop 36, however I think our stated support for police reform measures, especially as it relates to disconnecting mental health issues from the police department, put the measure into somewhat of a gray area. If I receive a request for support that is not clearly supported by the adopted Legislative Agenda, I always bring it to Council for direction.

Later this year, I’ll be drafting an update to the Legislative Agenda for 2025 and 2026.

At that time, I am very happy to make updates that would strengthen our support for crime prevention measures, or your referral could also include a change in the Legislative Agenda to explicitly support Prop 36.

Many thanks,
Sarah

Thank you for your response. Can you please provide citations, preferably to the proposition, that support your comments?

Hi Trish,

I think bringing this as a referral is the best approach. My understanding is that Prop 36 could make a 3
rd offence of theft, regardless of the value, a felony punishable by up to 3 years in prison. It also makes possession of fentanyl a felony and imposes a treatment- mandated felony for someone arrested for the 3
rd time for possession. I read that the
Governor and other Democrat lawmakers are working on a package of retail theft bills as an alternative.

Alameda’s Legislative Agenda could support this bill with these statements:

Provide resources for police and fire services, disaster preparedness, and resiliency and help reduce crime and increase the public safety of Alameda residents, businesses, and visitors.

Support the League of California Cities’ strategic advocacy priority to improve public safety in California communities. Pursue strategies and resources to address crime and its underlying causes.

However, these statements could have conflicting goals:

Increase equity and address systemic racism, provide additional funding and resources to improve the physical health, mental health, and well-being of Alameda residents, provide funding for services and programs for unsheltered residents, and promote social equity.

Continue supporting policing and racial equity outcomes consistent with adopted City Council directions, including adopted City Council direction on the Police Reform and Racial Equity Committee recommendations.

Support efforts that increase funding and address the needs of the most vulnerable in Alameda as well as increase positive outcomes for the mentally ill and unhoused population.

Many thanks,
Sarah

Do you know if the City and Police Chief Nishant Joshi will be supporting Prop 36? I'm not sure if their endorsement list is current. I'm considering bringing a referral for the City if you think Council would need to specifically vote to support.

Thanks.
