This letter serves as Bay Area Lightworks (BAL) formal appeal requesting the City of Alameda to determine BAL to be the lowest responsive bidder for the Alameda Traffic Signal Upgrade Project No. 07-24-18.
This appeal is based on the fact that W. Bradley Electric, LLC submitted a non-responsive bid. Specifically, their bid failed to properly acknowledge Addendum No. 1 for this proposal. On page one of W. Bradley Electric's bid packet, only one addendum is acknowledged. However, the same page includes the following warning:
"If the City has issued addendum or addenda, the City may reject this proposal if all addenda are not noted above as being received by bidder. "
In addition, W. Bradley Electric did not include a signed copy of Addendum No. 1 in their bid package acknowledging the revisions made by that addendum. Furthermore, Section 3-5, Addenda, of the Project Manual clearly states:
"All bidders are responsible for obtaining any and all changes to the plans, specifications, project manual, addenda, etc., during the bid process.
Given the failure to acknowledge and sign Addendum No. 1 as required by the bid documents, W. Bradley Electric did not comply with the solicitation requirements. As such, their bid is non-responsive and should be rejected.
Additionally, on page 12 of their bid package W. Bradley Electric have an altered bid document. This page appears to be from another bid, as the bidder's bond page should be numbered 5-7 not 4-7 and the project number on the top right is a different font. In section 2-4 of Submission of bid it states "All bids must be prepared on the forms provided by the City" Based on the above-mentioned points, BAL believe W. Bradley Electric shall be deemed non-responsive.
