CITY OF ALAMEDA RESOLUTION NO. _____
OPPOSING PROPOSITION 43, “LIMITS VOTERS’ ABILITY TO RAISE REVENUES FOR LOCAL GOVERNMENT SERVICES, LEGISLATIVE CONSTITUTIONAL AMENDMENT,” ON THE NOVEMBER 3, 2026 CALIFORNIA STATEWIDE BALLOT WHEREAS, Proposition 43, “Limits Voters’ Ability to Raise Revenues for Local Government Services,” will appear on the November 3, 2026 California statewide ballot and is a legislatively referred amendment to the California Constitution; and WHEREAS, the California Constitution permits local governments to increase taxes with voter approval, and local tax measures may be placed on the ballot by a local governing body or through the voter initiative process; and WHEREAS, under current law, special taxes placed on the ballot by a local governing body require two-thirds voter approval, while recent court decisions have allowed voter-proposed local special taxes to be approved by a majority vote; and WHEREAS, Proposition 43 would amend the California Constitution so that, beginning January 1, 2027, voter-proposed measures to impose, extend, or increase a local special tax would also require approval by two-thirds of voters; and WHEREAS, Proposition 43 does not itself impose, increase, reduce, or repeal a City tax and does not place the City’s existing voter-approved tax revenues in jeopardy; and WHEREAS, the Legislative Analyst’s Office states that Proposition 43 could result in lower local government tax revenues in the future than would otherwise occur because of the higher voter-approval threshold, while noting that the actual fiscal effect is unknown and would depend on future decisions by local governments and voters, and the City’s Finance Department has identified that reduced access to future locally generated revenues could affect the City’s ability to fund municipal services; and WHEREAS, the City of Alameda’s 2025-26 Legislative Agenda identifies Revenue, Taxation, and Employee Relations as a Legislative Focus Area and supports efforts that maintain City revenue streams and create a positive financial impact on the City; and WHEREAS, the Legislative Agenda directs the City to oppose measures that put City revenues from fees, charges, and tax revenue at risk and limit the ability of local governments to increase revenue, and supports state efforts that would reduce the vote threshold for local initiatives; and WHEREAS, based on the City’s adopted Legislative Agenda policies regarding Revenue, Taxation, and Employee Relations, the importance of locally generated revenues to funding City services, and the potential future fiscal effects identified by the Legislative Analyst’s Office, the City Council desires to oppose Proposition 43.

NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Alameda hereby opposes Proposition 43, “Limits Voters’ Ability to Raise Revenues for Local Government Services, Legislative Constitutional Amendment,” on the November 3, 2026 California statewide ballot. * * * * *
