2-1. Biennial
Operating Budget for Fiscal Years 2023-24 and 2024-25
Staff R
ecommendation: That the Council review the draft Fiscal Year 2023-24 and 2024-25 Biennial Budget package and provide staff direction on preparation for adoption in June 2023
Finance & A
dministrative Services Director Heather Rowden presented the staff report.
The Council has authorized three fiscal policies: General Fund Reserve Policy, Reserve Fund Policy, and Investment Policy. Staff requests amendments to the Reserve Fund Policy to add definitions and details regarding use of funds and to the Investment Policy to align it with State law. Staff has updated the Master Fee Schedule to include Consumer Price Index (CPI) adjustments and remove outdated fees. The staffing section of the proposed Budget reflects the maximum number of authorized positions, bargaining unit changes for Fiscal Years (FY) 2023-24 and 2024-25, and a proposed salary schedule.
The proposed B
udget includes a revenue increase of $4.4 million, an increase in the Recreation Department’s charges for services based on increased programming, salary and benefit increases, increases in insurance costs and Information Technology (IT) software expenses, and moving community event sponsorships to the Council budget and Sugar-Sweetened Beverage Tax allocations to the non- departmental budget. Staff has prepared a list of anticipated expenditures over the next five years for each Reserve Fund so that the Council may consider funding Reserve Funds through the Operating Budget. In addition, staff has prepared a ten-year projection of cash flow.
Staff
proposes a $3 million payment to the California Public Employees’ Retirement System (CalPERS), projects the actual payment will be $2.9 million, and suggests depositing the $100,000 difference into the Pension Reserve Fund. Staff also proposes depositing an additional 0.5% or approximately $40,000 into the Pension Reserve Fund to begin saving for future CalPERS payments. In addition, staff requests a blanket appropriation for several Reserve Funds to alleviate the need for Council approval of an unexpected purchase; however, unexpected purchases would continue to be subject to the usual policies and procedures.
A summa
ry of comment from the Financial Advisory Committee Members is as follows:
Based on the projected deficits for FY 2023-24 and 2024-25, the General Fund Reserve Fund balance will fall below the target amount at the end of FY 2024-25 due to increased expenses. The FAC would like to explore creating a Pension Funding Policy to examine •

2 the City’s pension plans, set goals for them, and plan for CalPERS payments. The FAC suggested that a forecast of staffing could help estimate salary and benefit expenses and General Fund impacts. An analysis of the $1 million increase in FY 2023- 24 budgeted expenses for the Community Development and Public Works Department s over the FY 2022-23 actual expenses could be helpful.
The FAC Revenue Subcommittee is exploring revenue enhancements and is sensitive to the general resistance to new taxes.
A summary of Council comment is as follows: a proposal to direct staff to estimate the cost for two Community Emergency Response Team (CERT) trainings per year and to include that amount in the Budget; the ten- year projection indicates that deficits will be realized; support for attempting to reach full staffing.

6 regulations of shared micromobility services and that fees include sufficient funding to help implement increased infrastructure for parking.
Staff Recommendation: That the Council:
1. Introduce and waive for first reading Ordinance No. 2023- 03, amending sections of the Albany Municipal Code relating to mobility sharing services
2. Provide direction to staff to incorporate fees as proposed into the upcoming FY 2023-24 Master Fee Schedule to be brought back for Council approval
Community Development Analyst Michelle Plouse presented the staff report. In October 2022, the Council adopted an urgency ordinance regulating shared mobility services, and the City entered into a temporary operating agreement with Veo the following day. Staff has drafted an ordinance that is substantially the same as the urgency ordinance. The proposed ordinance provides for permit applica tion, permit renewal, annual, improper parking, device removal, and device storage fees. The proposed fees are based on fees contained in the Master Fee Schedul e, except that the device storage fee is based on Emeryville’s fee.
Data from Veo indicates more than 1,000 trips have occurred since mid- October 2022.
The trips totaled approximately 1,800 miles, and each trip lasted on average 13 minutes.
The City has received one complaint regarding improper parking.
A summary of public comment is as follows: Veo chose to build community support before aggressively deploying devices in Albany; an inquiry regarding accident and injury data and potential mitigations.
Community Development Analyst Plouse advised that she has no accident data.
A summary of Council comment is as follows: shared micromobility companies require riders to be at least 18 years of age; the State Vehicle Code prohibits the riding of e- scooters on sidewalks and allows the county court to set a fine for such; the Council may wish to require an annual fee once a provider’s average number of users or devices per month reaches a specific number; a preference to base an annual fee on devices rather than users; the City may wish to limit the number of providers ; a suggestion for staff to utilize one device per bike rack as guidance in determining the number of devices permitted for deployment.
MOTION:
Moved by Vice Mayor Miki, seconded by Council Member Hansen- Romero, to 1) introduce and waive for first reading Ordinance No. 2023- 03, amending sections of the Albany Municipal Code relating to mobility sharing services and 2) direct staff to incorporate fees as proposed into the upcoming FY 2023-24 Master Fee Schedule to be brought back for Council approval.

City Clerk Anne Hsu presented the staff report. The Council recently adopted a resolution and ordinance updating the policy regarding student and student -affiliated appointments to City Advisory Bodies. In response to outreach regarding vacancies, the City Clerk’s office has received applications for the vacancies. Council Members have reviewed the applications and provided their recommendations to fill the vacant seats.
Council Members recommended one adult affiliated with students for the Climate Action Committee and one high school student and one adult affiliated with students for the Parks, Recreation & Open Space (PROS) Commission. If Council Members wish, they may ratify the appointments through a motion, second, and affirmative vote.
