11-1. Consideration of Proposed Ballot Measure to Amend Measure D Single Family Zoning Standards

Staff Recommendation: That the Council adopt Resolution No. 2026-29:

1. Ordering a ballot measure to be submitted to the voters of the City at the General Municipal Election to be held on Tuesday, November 3, 2026, that if approved by the voters, would amend Measure D, passed in 1978, and authorize the City Council to modify standards in the Residential Single Family (R-1) zoning district following the normal procedures for adoption of amendments to the Municipal Code related to residential development standards; and

2. Direct staff and the City Attorney to proceed accordingly

CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA)
This item does not constitute a project under the California Environmental Quality Act (CEQA) because it can be seen with certainty that there is no possibility that it will have a significant effect on the environment. (CEQA Guidelines Section 15061(b)(3).)

Community Development Director Dina Tasini presented the staff report. Currently, a change in development standards for the residential single-family zoning district requires a 50% +1 approval by the voters. Changes to standards for all other zoning districts require only a public hearing. Staff proposes a ballot measure to amend Measure D (1978) so that the residential single-family zoning district is treated the same as other zoning districts.

A summary of public comment is as follows: opposition to amending Measure D as proposed.

A summary of Council comment is as follows: the proposed amendment would increase equity across the City.

11-2. Update to Street Paving and Storm Drain Facility Improvement Special Parcel Tax

Staff Recommendation: That the Council:

1. Provide direction to staff on whether the Council wishes to pursue an update to the Storm Drain Facilities and Street Paving Special Parcel Tax for voter consideration at the November 2026 General Municipal Election; and

2. If a ballot measure is to be developed, provide direction to staff on the preferred methodology of calculation for the update to the Street Paving and Storm Drain Facility Improvement Special Parcel Tax

Public Works Director Mark Hurley presented the staff report. An update to the tax is proposed in response to the potential sale of the Golden Gate Fields property and resulting loss of tax revenue should the property become tax exempt. The Street Paving and Storm Drain Facility Improvement Tax, Measure F (2006), fund s repairs and rehabilitation of streets and storm drains. The current tax structure is based on lot square footage with one Equivalent Residential Unit (ERU) defined as a single-family residential lot of 3,000 square feet. In Fiscal Year (FY) 2025/26, the tax revenue totaled approximately $1.4 million. Of that amount, the Golden Gate Fields property generated approximately $290,000 in tax revenue.

Staff proposes an update that targets revenue of $1.4 million, caps the annual Consumer Price Index (CPI) increase at 3% , and includes possessory interest propert ies and exemptions for low-income property owners and renters . Option 1 maintains the current tax structure but institutes a cap on lot square footage of 500,000. In Option 2, the tax structure is based on lot square footage with a flat rate of $0.0638 per square foot.

A summary of public comment is as follows: opposition to utilizing tax revenue to fund new bike lanes; support for additional funding for storm drains.

A summary of Council comment is as follows: support for Option 1; support for Option 2 with a trigger that implements the tax structure update.

A summary of Council comment is as follows: support for Option 2 with language for a trigger; the trigger for implementing an updated tax structure would be the large parcel at Golden Gate Fields being re-classified as non-taxable.
