PUBLIC HEARINGS
1. PUBLIC HEARING REGARDING AN URGENCY ORDINANCE EXTENDING THE TERM OF ORDINANCE NO O2M22 -4797 REGARDING ALHAMBRA MUNICIPAL CODE CHAPTER 22.30 PERTAINING TO URBAN LOT SPLITS AND SECTION
23.16.020 AND CHAPTER 23.90 PERTAINING TO URBAN DWELLINGS – F2M21-16, O2M22-4800
This is the time and place set by Notice No. N2M22-10 for the City Council to hold a public hearing to consider adoption of an Ordinance extending Urgency Ordinance No. O2M22- 4797 amending the Alhambra Municipal Code to add Chapter 22.30 pertaining to urban lot splits and to amend Section 23.16.020 and add Chapter 23.90 pertaining to urban dwellings for a period of 10 months and 15 days . On September 16, 2021, Senate Bill 9
4 2-14-22
(SB 9, Atkins), was signed into law by the Governor. SB9 amended the California Government Code to allow for urban lot splits on R-1 lots. Effective January 1, 2022, these changes require local agencies to ministerially approve applications to allow property owners to split a single-family lot into two lots, add a second home to their lot or split the lot into two and place duplexes on each (which would create up to four housing units on a property currently limited to o ne single-family house). On November 8, 2021, the City Council expressed desire for development of an ordinance in order to retain some local control related to SB9 applications. On January 4, 2022 the City Council adopted an urgency ordinance in this rega rd. By its terms, that ordinance was set to expire after 45 days, unless extended after a public hearing. The urgent need for the ordinance was set forth in the staff report and recitals of the urgency ordinance. A ten-day report was posted on the City’s w ebsite discussing the steps staff has undertaken to address the issues presented by SB9. Staff intends to take a permanent ordinance through the Planning Commission, and then onto the City Council with any recommendation from the Planning Commission. An extension of the urgency ordinance is necessary to facilitate that process.
Per Government Code Section 65858, the extension of the ordinance will last for 10 months and 15 days beyond the original adoption of the ordinance, unless rescinded earlier by the adoption of a permanent ordinance.
Recommended Action: City Council take the follow actions:
1. Conduct a public hearing to receive public testimony; and,
2. Declare introduced for its first reading the following ordinance entitled:
Ordinance No. O2M22-4800: An Urgency Ordinance extending the term of Ordinance No. O2M22 -4797 regarding Alhambra Municipal Code Chapter 22.30 pertaining to urban lot splits and Section 23.16.020 and Chapter 23.90 pertaining to urban dwellings
after which such ordinance shall go into effect immediately upon its adoption by a 4/5th vote of the City Council.
2. PUBLIC HEARING TO ADOPT AN ORDINANCE AMENDING TITLE 23 (ZONING) OF THE ALHAMBRA MUNICIPAL CODE, CHAPTER 23.27 (DOWNTOWN
REVITALIZATION DISTRICT) PER TAINING TO REGULATIONS AND STANDARDS ASSOCIATED WITH AFFORDABLE HOUSING DEVELOPMENTS – F2M22-23, N2M22-11, O2M22-4799
This is the time and place set by Notice No. N2M22-11 for the City Council to hold a public hearing to consider an ordinance amending Chapter 23.27 (Downtown Revitalization District) of the Alhambra Municipal Code pertaining to regulations and standards related to affordable housing developments. The proposed Ordinance also completes one of the programs outlined in the City’s recently adopted 2021-2029 Housing Element. “Program 9: Expanded Density bonus in the Downtown Revitalization District” seeks to expand the density provisions into the entirety of the District to be consistent with Assembly Bill 1763 (AB 1763). In 2019, AB
5 2-14-22
1763 substantially amende d the State of California’s density bonus laws that were originally enacted in 1979. The State’s density bonus law is intended to support the construction of affordable housing.

which ordinance will return for a second reading and adoption at the next regu lar Council meeting.
