CITY OF ALHAMBRA
AGENDA
Regular Meeting

ALHAMBRA CITY COUNCIL
Council Chambers, 111 South First Street
December 12, 2022
6:00 p.m.

ROLL CALL:

COUNCIL: Lee, Maza, Pérez, Andrade-Stadler, Maloney

FLAG SALUTE: Led by Mayor Maloney

READING OF ORDINANCE TITLES

Government Code Section 36934 requires that all ordinances be read in full prior to City Council taking action on the ordinance. By listing the ordinance title on the Council agenda, Council may determine that the title has been read.

Recommended Action: By motion, determine that the titles to all ordinances which appear on this public agenda have been read, and waive further reading.

PUBLIC HEARING

1. SECOND READING AND ADOPTION OF ORDINANCE S AMENDING THE ALHAMBRA MUNICIPAL CODE BY MODIFYING TITLE 20 THEREOF ADOPTING BY REFERENCE THE 202 3 LOS ANGE LES COUNTY BUILDING CODE (TITLE 26), ELECTRICAL CODE (TITLE 27), PLUMBING CODE (TITLE 28), MECHANICAL CODE (TITLE 29), RESIDENTIAL CODE (TITLE 30), AND EXISTING BUILDING CODE (TITLE 33) WITH CERTAIN AMENDMENTS, ADDITIONS AND DELETIONS THERETO – F2M22-59, N2M22-121, O2M22-4807, O2M22-4808

Staff is requesting that the City Council consider second reading and adoption of an ordinance adopting by reference the 202 3 Los Angeles County Building, E lectrical, Plumbing, Mechanical, Residential, and Existing Building Code with certain amendments, additions and deletions thereto. State law requires local governments to enforce California Title 24. Most jurisdictions in Los Angeles County wait to comply with this requirement until the County of Los Angeles adopts the Building Codes and all of the associated local amendments. Then, these jurisdictions adopt the County Building Codes. Historically, the City has adopted the Los Angeles County codes by reference. Staff is also requesting that the Council adopt an urgency ordinance, adopting the same 202 3 Los Angeles County Codes, that will take effect on January 1, 2023. State law provides that if the City has not adopted its own building, residential, electrical, plumbing and mechanical codes by January 1, 2023, the state building, residential, electrical, plumbing and mechanical codes will automatically become the codes for the City of Alhambra. An urgency ordinance does not require a 40-day waiting period and therefore it will ensure that the Alhambra building, residential, electrical, plumbing and mechanical codes (based on the LA County Codes) are in place on January 1, 202 3. The regular ordinance is being adopted, as a good practice measure, in case the urgency ordinance is challenged for any reason.

3 12-12-22
Recommended Action: After receiving public testimony, the Mayor should close the public hearing and the City Council, by one motion, should take the following actions:

1. Declare introduced for its second reading and adopt the following ordinance entitled:

Ordinance No. O2M 22-4807: An Ordinance of the Alhambra City Council amending the Alhambra Municipal Code by modifying Title 20 thereof adopting by reference the 2023 Los Angeles County Building Code (Title 26), Electrical Code (Title 27), Plumbing Code (Title 28), Mechanical Code (Title 29), Residential Code (Title 30), Existing Building Code (Title 33), with certain amendments, additions and deletions thereto; and,

2. Declare introduced for its first reading the following urgency ordinance entitled:

Ordinance No. O2M 22-4808: An Urgency Ordinance of the Alhambra City Council amending the Alhambra Municipal Code by modifying Title 20 thereof adopting by reference the 2023 Los Angeles County Building Code (Title 26), Electrical Code (Title 27), Plumbing Code (Title 28), Mechanical Code (Title 29), Residential Code (Title 30), Existing Building Code (Title 33), with certain amendments, additions and deletions thereto

and adopt same by a 4/5 vote of the City Council, after which such ordinance shall go into effect immediately.

2. PUBLIC HEARING FOR A SUBSTANTIAL AMENDMENT TO THE 2020 -2024 CONSOLIDATED PLAN AND 2022 -23 ANNUAL ACTION PLAN FOR THE COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) PROGRAM – F2M20-58, N2M22-117, M2M22-152

This is the time and place set by Notice No. N2M22-117 for the City Council to conduct a public hearing to consider a substantial amendment to the 2020-2024 Consolidated Plan and 2022-2023 Annual Action Plan for the Community Development Block Grant Program.

From time to time, it is necessary for the City to process Substantial Amendments to the Consolidated Plan and the Annual Action Plan to allow for new CDBG or HOME funded activities; modification of existing activities; or other program administrative actions. The project is an eligible CDBG activity under Section 570.201(c) of the federal regulations (Public Facility and Impro vements Activity), and it meets the National Objective of benefiting Low - and Moderate -Income Areas 570.208(a)(1)(i) and Limited Clientele Activities 570.208(a)(2)(ii)(A). The proposed project includes sidewalk/street improvements at Montezuma, Florentina, El Paseo, San Clemente, Carlos, Los Higos, Adams, and Vega. Specifically, CDBG funds will be used for the following improvements:
pavement resurfacing of 7 street segments; repair approximately 39,320 square feet of broken and off -grade sidewalk improveme nts; repair approximately 930 linear feet of broken and off-grade curb and gutter; repair approximately 7,479 square feet of broken and off-grade driveway approaches; and, upgrades or installation of 12 ADA ramps. The addition of this project to the 2022-23 Annual Action Plan requires not only the Substantial Amendment to the Annual Action Plan, but also a small change to the 2020 -2024 Consolidated Plan. The Consolidated Plan identifies Community Facilities/Infrastructure

4 12-12-22
Improvements as a “low” priority; h owever, with the addition of $750,000 toward the proposed project, the priority shifts to a “medium” category.

Recommended Action: City Council:

1. Open the public hearing and receive public comment;

2. Close the public hearing and at the City Council’s discretion, approve a Substantial Amendment to the 2020-2024 Consolidated Plan and 2022-23 Annual Action Plan to establish a new public infrastructure project up to $750,000 from unspent prior year CDBG funds; and,

Staff contacted Tyler Technologies about providing additional training and based on the City’s need for support services, a maximum of 80 hours of onsi te training is recommended for new and existing employees who utilize the system. Additionally, staff from various departments have identified items on the back end of the system that need to be adjusted and areas that can benefit from additional streamlining. As a result, staff is also requesting for Tyler Technologies to provide a “client services account manager” through their Energov Assist Complete program. The dedicated account manager will provide a total of 600 hours of consulting services during a one-year duration to be used toward configuration changes and strategic planning for system updates.

Recommended Action: City Council approve contract addenda , subject to final language approval by the City Manager and City Attorney, with Tyler Technologies, Inc. for staff training and account management services related to City’s land management and permitting software system for a one-year term in an amount not to exceed $103,400; and, direct staff to undertake the steps necessary to finalize Council’s action. 21. RESOLUTION REAUTHORIZING THE CITY COUNCIL AND THE CITY’S BOARDS

AND COMMISSIONS TO IMPLEMENT TELECONFERENCE ACCESSIBILITY FOR CONDUCTING PUBLIC MEETINGS PURSUANT TO AB 361 – F2M20-33, R2M22-60

During COVID, the City has conducted meetings offering teleconferencing accessibility to members of the public, City Council, members of City boards and commissions, City staff and consultants. The executive orders authorizing such meetings lapsed on September 30, 2021, replaced with legislation in the form of AB 361. AB 361 was signed into law by the Governor on September 16, 2021, which went into effect immediately as urgency legislation (codified under Government Code § 54953), and waived certain provisions of the Brown Act in order to allow local agencies to continue to meet remotely. Specifically, the bill allows remote teleconference flexibility, but only when there is a state of emergency that makes it unsafe to meet in person. The Council made the necessary findings for the conduct of teleconfe renced accessible meetings via Resolution No. R2M21 -42 adopted on October 25, 2021. The proposed Resolution again makes the required findings under AB 361, and if adopted, it will allow the City to continue to offer teleconference accessibility for public meetings, to help mitigate the spread of COVID-19, as well as during other state- proclaimed emergencies, such as earthquakes or wildfires, where physical attendance may present a risk. When Governor Newsom ends the State’s emergency declaration on February 28, 2023, the City Councilmembers and Commissioners will no longer be able to attend meetings remotely except under limited circumstances as set forth in AB 2449 and other provisions of Government Code section 54953, absent another emergency declaration.

Recommended Action: City Council adopt Resolution No. R2M22-60: A Resolution of the City Council of the City of Alhambra reauthorizing the City Council, and the City’s Boards and Commissions to implement teleconference accessibility for conducting public meetings pursuant to AB 361
