PUBLIC HEARING
1. SECOND READING AND ADOPTION OF ORDINANCES AMENDING THE ALHAMBRA MUNICIPAL CODE BY MODIFYING TITLE 20 THEREOF ADOPTING BY REFERENCE THE 2023 LOS ANGELES COUNTY BUILDING CODE (TITLE 26), ELECTRICAL CODE (TITLE 27), PLUMBING CODE (TITLE 28), MECHANICAL CODE (TITLE 29), RESIDENTIAL CODE (TITLE 30), AND EXISTING BUILDING CODE (TITLE 33) WITH CERTAIN AMENDMENTS, ADDITIONS AND DELETIONS THERETO – F2M22-59, N2M22-121, O2M22-4807, O2M22- 4808
Chief Building Official JEFFERSON delivered a staff report. Staff requested that the City Council consider second reading and adoption of an ordinance adopting by reference the 2023 Los Angeles County Building, Electrical, Plumbing, Mechanical, Residential, and Existing Building Code with certain amendments, additions and deletions thereto. State law requires local governments to enforce California Title 24. Most jurisdictions in Los Angeles County wait to comply with this requirement until the County of Los Angeles adopts the Building Codes and all of the associated local amendments. Then, these jurisdictions adopt the County 2 1 2 -1 2 -22
Building Codes. Historically, the City has adopted the Los Angeles County codes by reference.
Staff also request ed that the Council adopt an urgency ordinance, adopting the same 2023 Los Angeles County Codes, that would take effect on January 1, 2023. State law provide d that if the City has not adopted its own building, residential, electrical, plumbing and mechanical codes by January 1, 2023, the state building, residential, electrical, plumbing and mechanical codes would automatically become the codes for the City of Alhambra. An urgency ordinance does not require a 40-day waiting period and therefore it w ould ensure that the Alhambra building, residential, electrical, plumbing and mechanical codes (based on the LA County Codes) are in place on January 1, 2023. The regular ordinance was being adopted, as a good practice measure, in case the urgency ordinance was challenged for any reason.
Opened/Closed Public Hearing: Mayor Maloney opened the public hearing and, as there was no one present that wished to speak, closed the same.
Discussion: None
Action Taken: After receiving public testimony, the Mayor close d the public hearing and the City Council, by one motion, t ook the following actions:
1. Declare d introduced for its second reading and adopt ed the following ordinance entitled:
Ordinance No. O2M22-4807 : An Ordinance of the Alhambra City Council amending the Alhambra Municipal Code by modifying Title 20 thereof adopting by reference the 2023 Los Angeles County Building Code (Title 26), Electrical Code (Title 27), Plumbing Code (Title 28), Mechanical Code (Title 29), Residential Code (Title 30), Existing Building Code (Title 33), with certain amendments, additions and deletions thereto ; and,
2. Declare d introduced for its first reading the following urgency ordinance entitled:
Ordinance No. O2M22-4808: An Urgency Ordinance of the Alhambra City Council amending the Alhambra Municipal Code by modifying Title 20 thereof adopting by reference the 2023 Los Angeles County Building Code (Title 26), Electrical Code (Title 27), Plumbing Code (Title 28), Mechanical Code (Title 29), Residential Code (Title 30), Existing Building Code (Title 33), with certain amendments, additions and deletions thereto

21. RESOLUTION REAUTHORIZING THE CITY COUNCIL AND THE CITY ’S BOARDS AND
COMMISSIONS TO IMPLEMENT TELECONFERENCE ACCESSIBILITY FOR CONDUCTING PUBLIC MEETINGS PURSUANT TO AB 361 – F2M20-33, R2M22-60 During COVID, the City conducted meetings offering teleconferencing accessibility to members of the public, City Council, members of City boards and commissions, City staff and consultants. The executive orders authorizing such meetings lapsed on September 30, 2021, replaced with legislation in the form of AB 361. AB 361 was signed into law by the Governor on September 16, 2021, which went into effect immediately as urgency legislation (codified under Government Code § 54953), and waived certain provisions of the Brown Act in order to allow local agencies to continue to meet remotely. Specifically, the bill allow ed remote teleconference flexibility, but only when there was a state of emergency that ma de it unsafe to meet in person. The Council made the necessary findings for the conduct of teleconferenced accessible meetings via Resolution No. R2M21-42 adopted on October 25, 2021. The proposed Resolution again ma de the required findings under AB 361, and if adopted, it would allow the City to continue to offer teleconference accessibility for public meetings, to help mitigate the spread of COVID-19, as well as during other state-proclaimed emergencies, such as earthquakes or wildfires, where physical attendance may present a risk. When Governor Newsom ends the State ’s emergency declaration on February 28, 2023, the City Councilmembers and Commissioners would no longer be able to attend meetings remotely except under limited circumstances as set forth in AB 2449 and other provisions of Government Code section 54953, absent another emergency declaration.
