2. ORDINANCE AMENDING THE ZONING CODE TO ALLOW MEDICINAL CANNABIS

DELIVERY-ONLY RETAILERS IN THE INDUSTRIAL ZONE WITH A CONDITIONAL

USE PERMIT AN D REGULATORY BUSINESS PERMIT TO IMPLEMENT THE REQUIREMENTS OF SB 1186 – F2M23-78, N2M24-7, O2M24-4826

This is the time and place set by Notice No. N2M24-7 for the City Council to hold a public hearing to consider adopt ion of an ordinance amending the City’s Zoning Code to allow medicinal cannabis delivery -only retailers in the Industrial Zone with a conditional use permit and a regulatory business permit to implement the requirements of SB 1186. The

3 2-12-24
California Legislature adopted Senate Bill 1886 (“SB 1186”) in 2022, entitled the Medicinal Cannabis Patients’ Right of Access Act, which precludes cities and counties from adopting or enforcing regulations that prohibit or have the effect of prohibiting the retail sale of medicinal cannabis by delivery. SB 1186 took effect on January 1, 2024. SB 1186 allows cities and counties to adopt and enforce reasonable regulations on the retail sale by delivery of medicinal cannabis, including zoning requirements. The City Council adopted an interim urgency ordinance on December 11, 2023, that is consistent with the proposed ordinance. The interim urgency ordinance was adopted to get regulations in place by the January 1, 2024 deadline while the City finished the process of adopting the comprehensive Zoning Code update. On January 22, 2024 the City Council extended the urgency ordinance for ten months and fifteen days. Now that the new Zoning Code has been adopted, the City Council can move forward with the proposed amendment. The proposed ordinance would allow a delivery -only retailer of medicinal cannabis to be a conditionally permitted use in the Industrial zone. The retailer must only sell medicinal cannabis; the retail sale of adult-use (e.g., recreational) cannabis would remain prohibited.

As a delivery -only business, there would be no storefront operations (no walk -in customers). The proposed ordinance also includes separation requirements for such businesses. The ordinance also proposes that an annual business regulatory permit be required for such businesses. The proposed ordinance includes operational standards for these businesses. These include security requirements, odor control measures, and a requirement that product not be visible from the exterior of the property. Failure to comply with the operational requirements could result in the regulatory permit being suspe nded, revoked or not renewed.

Recommended Action: City Council conduct a public hearing and, a fter receiving public testimony, the Mayor should close the public hearing and the City Council declare introduced for its first reading the following ordinance entitled:

Ordinance No. O2M24-4826: An Ordinance of the City Council of the City of Alhambra adopted pursuant to the City’s Police powers and Business Professions Code §26320 to amend Alhambra Municipal Code Section

AB 481 requires that the Council determine, based on the annual military equipment report submitted pursuant to Section 7072, whether each type of military equipment identified in that report has complied with the standards for approval set forth in Government Code section 7071(d). An assessment of current personnel staffing levels in the Parks and Recreation Department has demonstrated a need for additional positions to be filled, created, altered or moved. The Parks and Recreation Department currently has two budgeted vacant full- time positions - Clerical Assistant III and Park Worker I. By using the combined fully burdened funding of both positions, the Parks and Recreation Department can add a full- time Parks Supervisor and a Clerical Assistant II. Due to the c ontract approaching its initial expiration date and the contractor’s continued satisfactory performance, staff reached out to Inter -Con Security to obtain rates for the remaining two-year term, if authorized. Should the two-year amendment be approved, the additional cost for the contract would be in the amount of $1,252,302.48. Increases to cost are the result of inflation and wage increases.

Recommended Action: City Council approve an amendment, subject to final language approval by the City Manager and City Attorney, to the contract between Inter- Con Security Systems, Inc. and the City of Alhambra (C2M21-21) for parking enforcement services for an additional two years through June 30, 2026 at a cost not to exceed $1,252,302.48; and, direct staff to under take the steps necessary to finalize Council’s action. The Alhambra Municipal Code (“AMC”) is a comprehensive gathering of ordinances adopted by the City Council covering a wide range of topics, such as City or ganization, parking, land use, licensing, purchasing, and contracting. From time-to-time updates are made to the AMC to address new state legislation, clarify ambiguous provisions, or delete outdated language. While some of these changes require immediate consideration by the Council, most can be addressed periodically. Accordingly, staff intends to annually bring a code clean up ordinance to the Council in the first quarter of each year that will address modifications needed due to new legislati on, as well as other suggested clarifying changes. For this first such annual review, City staff is suggesting minor changes to the AMC to reflect current practices, clarify confusing parts of the AMC, and bring outdated sections into compliance with State law. The City reviewed the environmental impacts of this Ordinance under the California Environmental Quality Act (Public Resources Code §§ 21000, et seq. “CEQA”) and the regulations promulgated thereunder (14 Cal. Code of Regs. §§ 15000, et seq., the “CEQA Guidelines”). This Ordinance is not subject to further review environmental review because: (1) it will not result in a direct or reasonably foreseeable indirect physical change in the environment (14 Cal. Code Regs. §

12 2-12-24
15060(c)(2); (2) there is no possibility that this Ordinance will have a significant effect on the environment (14 Cal. Code Regs. § 15061(b)(3)); and (3) the Ordinance, by itself, does not constitute a “project” as defined in section 21065 of the Public Resources Code and the CEQA Guidelines (14 Cal. Code Regs. § 15378).
