6. RESOLUTION AUTHORIZING THE COMMUNITY DEVELOPMENT DIRECTOR AS

APPROVING OFFICER FOR DETERMINATIONS OF PUBLIC CONVENIENCE OR NECESSITY FOR THE DEPARTMENT OF ALCOHOLIC BEVERAGE CONTROL – F2M24- 16, R2M24-11
The State Department of Alcoholic Beverage Control (ABC) is responsible for administering licenses for the sale of alcoholic beverages. Pursuant to Section 23958 of the California Business and Professions Code, ABC shall deny an application for a license if issuance would result in or add to an undue concentration of licenses. Currently, the Alhambra Planning Commission was designated to make Public Convenience or Necessity (PCN) determinations regarding ABC license applications where undue concentration exists. The PCN finding was typically included as part of the Planning Commission Resolution approving any entitlement applications, such as a Conditional Use Permit, required for the ABC license. The adopted Planning Commission resolution would then be provided to ABC as the City ’s formal PCN determination. With the recent adoption of the comprehensive Zoning Code update, certain ABC licenses, including Type 20 and 21 off-sale licenses, would no longer require Conditional Use Permits and therefore, would no longer require review by the Planning Commission.

Consistent with the changes adopted as part of the Zoning Code update, s taff recommened the City Council delegate to the Community Development Director the authority to make PCN determinations for ABC licenses, and delegate to the Community Development Director the authority to issue PCN letters after a determination is made.
