PUBLIC HEARING
PROPOSED ADJUSTMENTS IN VARIOUS CITY FEES AND SERVICE CHARGES - F2M15-48, F2M24-39, N2M24-49, R2M24-13
This is the time and place set by Notice No. N2M24-49 for the City Council to hold a public hearing to consider adjusting various city fees and service charges. Resolution No.
R2M16-4, previously adopted by the City Council, sets forth the City's Comprehensive Fee and Service Charge Schedule. The City has maintained its fee schedule without increases since 2016. To ensure the sustainability of services, a Comprehensive Fee and Rate Study was conducted in 2023 to assist the City in determining appropriate fee levels for the various services provided by the City.
While the update of the Comprehensive Fee and Service Charge Schedule will provide a fiscal impact in the form of additional revenue, it is pertinent to note the revenue is not intended to fund new services; rather the revenue is intended to offset the costs of providing existing services that are recoverable from fees. Considering the duration since the last fee increase, staff recommends a phased approach for certain fee increase over a three-year period, while others are recommended for full cost recovery. Staff is recommending adoption of the new fees, as set forth in the staff report and exhibits to the attached Resolution.
Recommended Action: After receiving public testimony, the Mayor should close the public hearing and the City Council should adopt Resolution No. R2M24-39 entitled: A Resolution of the Alhambra City Council Modifying Resolution No. R2M16-4 Approving Various City Fees and Service Charges.

5. NOTICE INVITING BIDS: SURFACE AND EXTERIOR CONCRETE REPAIRS FOR THE LIBRARY, POLICE DEPARTMENT AND CITY HALL BUILDINGS - F2M24-40, N2M24- In August 2021, a facility assessment determined that the Library's garage and basement levels have cracking, and thus are in need of epoxy concrete repair and the removal of efflorescence. The recent rainstorms, made it apparent repairs should not be delayed, since seepage and water intrusion were experienced on both parking levels. Exterior cracking and water intrusion have also been observed at the Police Department and City Hall buildings. During rainstorm events, seepage, water intrusion and flooding in the basements have been a frequent occurrence. City staff does not possess the expertise to complete this type of repair, as such staff is requesting the City Council authorize a Notice Inviting Bids that will include repairs to the Library, Police Department, and City Hall buildings.

Community Risk Reduction (CRR) is a division of the Alhambra Fire Department (AFD).
CRR staff is dedicated to increasing safety, preventing, or reducing fire losses and ensuring compliance with applicable codes and ordinances. The communication and delivery of reports from third parties is done manually and does not allow for efficient tracking, processing and enforcement of the codes.
Brycer is designed to consolidate efforts into a single operation to streamline the reporting process. Brycer utilizes TCE software that tracks and drives fire code compliance and helps reduce false alarm activity through a simple web-based service that allows the CRR to connect to contractors who inspect, test, and maintain fire protection systems.
Inspectors can then efficiently review reports, track deficiencies, notify parties and ensure compliance of fire and life safety systems. Brycer provides a database of the buildings in our jurisdiction and helps to achieve greater fire protection systems reliability at zero cost. 8 4-22-24
TCE allows for service providers to submit copies of their inspection and testing reports to AFD electronically, facilitating a more efficient review, tracking and follow-up process with occupants to correct deficiencies and maintain systems. The term of the proposed Brycer Agreement will be for three years, effective June 1, 2024, and will be renewed on June 1, 2027 for two terms of one year each pursuant to satisfactory performance. Per the Alhambra Municipal Code (Section 3.38.050), the contract procedures may be dispensed when the services can only be obtained from one source (sole source). In this case, the reporting support services are exclusively available through Brycer. The reporting services of Brycer are highly specialized and essential to the City's CRR operations.
Recommended Action: City Council approve a contract with Brycer, LLC, subject to final language approval by the City Manager and City Attorney, to implement The Compliance Engine (TCE) for fire code compliance and reporting services for a three-year period with an option for two one-year contract extensions, and authorize the City Manager to execute the extensions if the services are satisfactory; authorize the City Manager or designee to execute the necessary documents; and direct staff to undertake the necessary steps to finalize Council's action. WHEREAS, trees, wherever they are planted, are a source of joy and spiritual renewal.
NOW, THEREFORE, I, ROSS J. MAZA, Mayor of the City of Alhambra, do hereby proclaim April 26, 2024 as ARBOR DAY in the City of Alhambra and urge all citizens to support efforts to protect trees and woodlands and to plant trees to gladden the heart and promote the well-being of this and future generations.

TO: Honorable Mayor and Members of the City Council
SUBMITTED BY: Michael Macias, Director of Parks and Recreation h Janine Pinto, Senior Services Supervisor
SUBJECT: PROCLAIM MAY 2024 "OLDER AMERICANS MONTH" IN THE CITY OF
ALHAMBRA
RECOMMENDATION:
To request that the City Council join in the national celebration honoring "Older Americans" by proclaiming May 2024 as "Older Americans Month" in the City of Alhambra.
BACKGROUND:
1. National recognition of "May is Older Americans Month" is a tradition dating back to 1963 as a result of President John F. Kennedy's meeting with the National Council of Senior Citizens. Thanks to President Jimmy Carter's 1980 designation, what was once called Senior Citizens Month, is now called "Older Americans Month." Every President since JFK has issued a formal proclamation declaring May as "Older Americans Month."
2. Older Americans Month recognizes the legacies and contributions of older Americans and supports them as they enter the next stage in life. This year's "Older Americans Month" theme, "Powered by Connection" recognizes the profound impact that meaningful relationships and social connections have on our health and wellbeing.
3. Connections play a vital role in supporting independence and aging in place by combatting isolation, loneliness and other issues.
4. The City of Alhambra provides services, support, and resources to Older Americans year- Recreation Department, Senior Services Division has scheduled our annual "Older Americans Month" Celebration on Friday, May 3, 2024.
FINANCIAL ANALYSIS:
There is no fiscal impact. All special events, seminars, and activities are included in the approved Fiscal Year 2023-2024 budget.

CITY MANAGER APPROVAL:

TO: Honorable Mayor and Members of the City Council
SUBMITTED BY: Pearl Lieu, Finance Director pl
SUBJECT: PUBLIC HEARING FOR CONSIDERATION OF ADOPTING
RESOLUTION NO. R2M24-13 MODIFYING RESOLUTION NO. R2M16- 4 APPROVING VARIOUS CITY FEES AND SERVICE CHARGES
RECOMMENDATION:
It is recommended the City Council conduct a public hearing and consider adopting Resolution R2M24-13, making adjustments to Resolution R2M16-4 for modifications to the City Fees and Service Charges.
BACKGROUND:
The last Comprehensive Fee and Rate Study was completed in 2005, which was over nineteen years ago. During this period, adjustments to fees were primarily guided by changes in the consumer price index (CPI).
Resolution No. R2M16-4, previously adopted by the City Council, sets forth the City's Comprehensive Fee and Service Charge Schedule. The City has maintained its fee schedule without increases since 2016
To ensure the sustainability of services, a Comprehensive Fee and Rate Study was conducted in 2023 to assist the City in determining appropriate fee levels for the various services provided by the City. The Study ensures fee adjustments accurately reflect the current costs associated with delivering City services, thereby safeguarding the sustainability of the City's operations in accordance with the Council's strategic plan goal to create a strong financial base.
The primary objective of a user fee is to recover a portion, or up to 100% of the costs to provide the service, from the individuals or companies that benefit from the services. While the update of the Comprehensive Fee and Service Charge Schedule will provide a fiscal impact in the form of additional revenue, it is pertinent to note the revenue is not intended to fund new services; rather the revenue is intended to offset the costs of providing existing services that are recoverable from fees. Recovering the costs of providing fee-related services directly influences the City's fiscal health and increases the City's ability to meet service level expectations. When a fee targets "100% or full cost recovery," the individual bears the entire cost. When a fee targets less than full cost recovery, the General Fund subsidizes the service activity.
Considering the duration since the last fee increase, staff recommends a phased approach for certain fee increases over a three-year period, while others are recommended for full cost recovery. The phased strategy aims to mitigate the impact on stakeholders and ensure a smoother transition to the revised fee structure. The following fees are recommended for phase in over three years, most notably planning fees with increases over 60% and water meter installation for 1 inch to 6 inches. The remaining fees should be set to fully recover costs, adjusting for salary increases and changes in the consumer price index over time.
Staff is recommending adoption of those new fees, as set forth in Exhibit A and B to the attached Resolution No. R2M24-13. Staff is requesting the City Council direct the Finance Director to make the necessary budget adjustments for all changes to fees and service charges.

A RESOLUTION OF THE ALHAMBRA CITY COUNCIL
MODIFYING RESOLUTION NO. R2M16-4 APPROVING

WHEREAS, the last Comprehensive Fee and Rate Study was completed in 2005, which was over nineteen years ago. During this period, adjustments to fees were primarily guided by changes in the consumer price index (CPI); and.
WHEREAS, Resolution No. R2M16-4, previously adopted by the City Council, sets forth the City's Comprehensive Fee and Service Charge Schedule. The City has maintained its fee schedule without increases since 2016; and,
WHEREAS, to ensure the sustainability of services, a Comprehensive Fee and Rate Study was conducted in 2023 to assist the City in determining appropriate fee levels for the various services provided by the City. NOW, THEREFORE, BE IT RESOLVED by the Alhambra City Council that the Council hereby:

2. The 2024 Fees and Service Charges Schedule as identified in the attached Exhibit "A" & "B" shall become effective on May 1, 2024 and shall be subject to annual adjustment thereafter based on the Consumer Price Index (CPI) at July 1 of each fiscal year.
3. The Director of Finance is directed to generate a new Fees and Service Charges Schedule to reflect 1) the City's Fees and Charges as adopted by Resolution R2M24-13; 2) any increases implemented based upon CPI; and 3) the changes set forth in Exhibit "A" and "B" attached hereto.

SUBMITTED BY: Martin Ray, Director of Public Works & Utilities All SUBJECT: AUTHORIZATION TO CIRCULATE A NOTICE INVITING BIDS FOR
SURFACE AND EXTERIOR CONCRETE REPAIRS FOR THE
LIBRARY, POLICE DEPARTMENT AND CITY HALL BUILDINGS
RECOMMENDATION:
It is recommended the City Council authorize staff to circulate a Notice Inviting Bids for Surface and Exterior Concrete Repairs to the Library, Police Department and City Hall buildings and direct staff to undertake the necessary steps to finalize Council's action.
BACKGROUND:
In August 2021, a facility assessment determined that the Library's garage and basement levels have cracking, and thus are in need of epoxy concrete repair and the removal of efflorescence.
FINANCIAL ANALYSIS:
Funds have been allocated in the Library's Capital Improvement Project, under account number 310.50.5010.92315 and Facilities Replacement - Upgrades under account number 310.70.7010.92198.

FUNDING FROM THE STATE WATER RESOURCES CONTROL BOARD
RECOMMENDATION:
It is recommended the City Council accept a grant from the California Extended Water and Wastewater Arrearage Payment Program through funding from the State Water Resources Control Board in the amount of $98,360.46 to pay delinquent water and sewer bills; direct the Finance Director to increase revenue account 404.00.42808 and expense account 404.80.8681.68087 by $98,360.46; and direct staff to undertake the steps necessary to finalize Council's action.
FACTS:
On November 30, 2023, staff applied to the California Extended Water and Wastewater Arrearage Payment Program (Program). The Program was developed to provide additional assistance to water and sewer systems that accrued residential and commercial customer arrearages during the COVID-19 pandemic from June 16, 2021 to December 31, 2022. The City received a payment of $98,360.46, the estimate staff requested in the Program application. The City previously received funding from the program in the amount of $278,640.59 for the relief period of March 4, 2020 through June 15, 2021.
The Program requires water and sewer systems to allocate the funds as a credit to customers within 60 days of receiving funds and notify the customers in writing of the amount credited. Customers do not have to repay any payments received. The City is required to return funds not credited to customers within six months of receipt back to the State Water Resources Control Board. The grant funds only cover water and sewer charges for accounts that were billed during the specified COVID-19 pandemic relief period.
Once approved, staff will credit all eligible delinquent water and sewer accounts during the eligible period and notify each account holder of the amount credited to their account, per the grant guidelines.
FINANCIAL ANALYSIS:
The $98,360.46 grant will used to reduce outstanding balances for delinquent water and sewer accounts.
The fiscal impact of this grant is an increase of $98,360.46 in the Utilities Department's Water revenue account number 401.00.42806 and expense account 401.80.8681.68088 in the amount of $64,730.50; and in the Sewer's revenue account number 404.0042808 and expense account 404.80.8681.68087 in the amount of $33,629.96.

EXPENDITURES
RECOMMENDATION:
It is recommended the City Council:
1. Accept the 2023 Urban Area Strategic Security Initiative Grant (UASI) in the amount of $452,298.00; and
2. Direct the Finance Director to amend the City's 2023-2024 Adopted Budget by increasing the Police Department revenue by $146,818.00 in account 101.20.42399 and appropriating $146,818.00 in account 101.20.2010.99399 and increasing the Fire Department revenue by $305,480.00 in account 101.30.42399 and appropriating $305,480.00 in account 101.30.3610.99399; and
3. Direct staff to undertake the steps necessary to finalize Council's action.
BACKGROUND:
The City of Los Angeles has been identified by the United States Department of Homeland Security as a Core City with several potential terrorist targets within its borders. As a designated Core City, they are eligible for additional funding through the UASI Grant Program that is administered by the Department of Homeland Security. In addition to the Core City (Los Angeles), individual cities that are contiguous to the City of Los Angeles are also eligible for funding. The City of Alhambra and 15 other cities are identified as contiguous cities and, therefore, are eligible for funding through this grant.
The Alhambra Police Department and the Alhambra Fire Department jointly submitted a grant request for $452,298.00 to the Approval Authority who administers the UASI Grant Program, and the request was approved. The Police Department was allocated $146,818.00 and the Fire Department was allocated $305,480.00.
During the 2023 UASI Grant process, the Los Angeles Police Chief's Association allocated $35,700.00 for the Alhambra Police Department to purchase software licensing for its Automated License Plate Reading (ALPR) program and $111,118.00 for the purchase of an armored police rescue vehicle. The police rescue vehicle is intended for shared use by Alhambra, South Pasadena, and Monterey Park. The Fire Department will receive $305,480.00 for Urban Search and Rescue equipment and training, as well as for sustainment and maintenance of the Alhambra Fire Training Facility.
FINANCIAL ANALYSIS:
This is a reimbursement grant. Once a request is approved by the Los Angeles City Urban Area Approval Authority and the State (Cal OES), the sub-grantees (Alhambra Police Department and Alhambra Fire Department) must spend the money for approved expenses and make a claim for reimbursement. There is no cost share or match requirement associated with this funding for the approved equipment.
Acceptance of the 2023 UASI Grant by the City Council requires an amendment to the Fiscal Year 2023-2024 Budget for Police grant revenues (Account No. 101.20.42399) and expenditures (Account No. 101.20.2010.99399) in the amount of $146,818.00; and an increase to Fire grant revenues (Account No. 101.30.42399) and expenditures (Account No. 101.30.3610.99399) in the amount of $305,480.00.

RECOMMENDATION:
It is recommended the City Council adopt a Resolution delegating authority to the City Manager and Director of Human Resources and Risk Management to submit Employer Originated Disability Applications to the California Public Employees' Retirement System (CalPERS).
BACKGROUND:
1. An application for a CalPERS disability or industrial disability retirement may be initiated by an employee or an employer. If the employee has not already filed an application, Government Code section 21153 obligates the employer to file on behalf of the employee if the employer has reason to believe, based on a report from Qualified Medical experts, the employee is disabled as defined by the Public Employees' Retirement Law (PERL). In many cases, the employee initiates the disability retirement application however, there are times where it becomes necessary for the City to submit an application in order to move the process forward in a timely manner.
In the past, CaPERS accepted Employer Originated Applications submitted by City staff.
However, CaPERS recently notified the City that in order to maintain the status quo and accept Employer Originated Disability Applications, the City Council must first officially delegate authority to staff via a Resolution, per Government Code section 21152.
3. A Resolution (Resolution No. R2M24-12) delegating authority to the City Manager and Director of Human Resources & Risk Management to submit Employer Originated Disability applications is required.

It is recommended the City Council award a contract to ECOnorthwest, subject to final language approval by the City Manager and City Attorney, for economic and market analysis consulting services in an amount not-to-exceed $75,000 over two years; and direct staff to undertake the steps necessary to finalize the Council's action.
BACKGROUND:
On April 24, 2023, the City Council approved the 2023 Strategic Plan with Goal Three: Create a Strong Financial Base and Strong Economic Base (Economic Development), and reaffirmed the same in the 2024 Strategic Plan approved April 8, 2024. One of the goal's objectives is to develop an Economic Development Action Plan. The Plan will create a comprehensive and integrated approach to economic development that strengthens the City's economic base. The vision will focus on the community's present and future economic values over the next four years. Meanwhile, the goals will be a more tangible reflection of the vision and provide specific framework to implement economic development policies and programs. RECOMMENDATION:
It is recommended the City Council approve a contract with Brycer, LLC, subject to final language approval by the City Manager and City Attorney, to implement The Compliance Engine (TCE) for fire code compliance and reporting services for a three-year period with an option for two one- year contract extensions, and authorize the City Manager to execute the extensions if the services are satisfactory; authorize the City Manager or designee to execute the necessary documents; and direct staff to undertake the necessary steps to finalize Council's action.
BACKGROUND:
TCE allows for service providers to submit copies of their inspection and testing reports to AFD electronically, facilitating a more efficient review, tracking and follow-up process with occupants to correct deficiencies and maintain systems.
AFD and Brycer, LLC will enter into a revenue sharing agreement and a $30.00 fee will be collected for every inspection report submitted. This fee will also be applied to occupancies that perform and report self-inspections which meet the requirements of Alhambra's adopted fire codes. The "Annual Inspection and Compliance Reporting Fee" has been submitted as part of the FY 2023/24 General Fee Schedule. The $30.00 is significantly less than the Fire Department's current average hourly rates. For each $30.00 collected, the City of Alhambra will retain $10.90 and Brycer will be paid $19.10 (17.00+7.00% of the fee).
Brycer offers its services to numerous cities, utilizing its proprietary software. The reporting services by Brycer are highly specialized and essential to the City's CRR operations. The City fee component will cover the administration costs of the program.
FINANCIAL ANALYSIS:
No General Fund appropriation is required for this project. The projected revenue for the Alhambra Fire Department in year one is $12,000.00. Revenue will progressively increase in year two and the following years as higher participation and compliance is achieved. The estimated revenue for a three-year contract in total will be approximately $57,000.00, allocated to Fire & Life Safety System Compliance account no. 101.30.44533. The precise amount can be less or more depending on actual reports processed.

CITY MANAGER APPROVAL:
DATE: April 22, 2024
TO: Honorable Mayor and Members of the City Council
SUBMITTED BY: Lauren Myles, City Clerk W
SUBJECT: NOVEMBER 5, 2024 ALHAMBRA GENERAL MUNICIPAL ELECTION:
ADOPTION OF AN ORDINANCE CALLING THE ELECTION AND OF A
RESOLUTION REGARDING CONSOLIDATION WITH THE STATEWIDE
GENERAL ELECTION TO BE HELD THAT SAME DATE IN LOS
ANGELES COUNTY
RECOMMENDATION:
In orderto continue the election process in an orderly and timely manner, it is respectfully requested that the City Council take the following actions:
1. Declare introduced for its second reading and adopt the following ordinance entitled:
Ordinance No. O2M24-4829 entitled: An Ordinance of the Alhambra City Council providing for a General Municipal Election in said City to be held on November 5, 2024 and providing for the consolidation of the General Municipal Election with the Statewide General Election, said Election being held for the election of the following City Officials, to wit: Councilperson of the Third District, full term; and, Councilperson of the Fourth District, full term; and,
2. Adopt Resolution No. R2M24-14 entitled: A Resolution of the Alhambra City Council requesting the Board of Supervisors of the County of Los Angeles to order the consolidation of an Alhambra General Municipal Election to be held on November 5, 2024 with the Statewide General Election to be held in Los Angeles County the same day, to authorize the Board of Supervisors of the County of Los Angeles to canvass the returns of said General Municipal Election and to request that the Registrar of Voters of said County be permitted to render specified services to the City of Alhambra relating to the conduct of said General Municipal Election pursuant to Elections Code Section 10403 BACKGROUND:
1. On April 8, 2024, the City Council introduced for first reading Ordinance No. 02M24-4829 providing for a General Municipal Election to be held on November 5, 2024 for the purpose of submitting to the qualified voters the following named officers: Councilperson of the Third District, full term; and, Councilperson of the Fourth District, full term.
Pursuant to the Alhambra Charter as recently amended by Measure V in 2020, these offices shall be nominated from and elected by districts.
The Alhambra City Charter provides that General Municipal Elections shall be consolidated with the Statewide General Elections to be held on the first Tuesday following the first Monday of every even-numbered year; hence, the next General Municipal Election for the City of Alhambra, will be held on Tuesday, November 5, 2024.
3. The City of Alhambra historically has consolidated its General Municipal Elections with those held on the same date in the County of Los Angeles. Based on economies of scale, such consolidation has resulted in considerable cost savings for the City in that:
a) Instead of separate precincts, polling places and voting booths for the City's General Municipal Election and the County's Statewide General Election, the precincts, polling places and voting booths are the same in every case for both elections. b) The County Registrar of Voters prints and mails the City's sample ballots, candidate's statements and polling place cards to all registered voters within the City of Alhambra in the same envelopes it uses for mailing sample ballots and polling place cards to voters for the Statewide General Election held in Los Angeles County.
c) The County Registrar of Voters processes, on the City's behalf, requests for absent voter ballots which is a time-consuming and labor-intensive process. d) On election night, the County Registrar of Voter counts the votes cast in the City's General Municipal Election at the same time all other votes are tallied for the Statewide General Election cast in Los Angeles County, thereby saving the City the expense of purchasing/renting ballot counting equipment.
Finally, since the County counts our ballots, the Los Angeles County Board of Supervisors is being authorized to canvass the returns on our behalf.
