The City of Alhambra’s Public Works Department completed an Engineering and Traffic Survey (Speed Survey) for 88 street segments citywide and prepared the City of Alhambra 2023/2024 Engineering and Traffic Survey. The purpose of an engineering and traffic survey is to establish updated speed limits that can be legally enforced using radar at pre-determined locations. The City of Alhambra’s 2023/2024 Engineering and Traffic Survey determined that 9 segment locations are eligible for a 5 MPH reduction i n the posted speed limit. These segment locations are outlined in the Director of Public Works & Utilities’ August 26, 2024 staff report. A resolution is required to be adopted by the City Council to set and establish citywide speed limits to be upheld by the courts. Additionally, an ordinance is necessary to set the speed limits on those road segments identified in the report that are outside of a residential district and are not otherwise subject to the Vehicle Code’s prima facia speed limit. The ad option of the City of Alhambra 2023/2024 Engineering and Traffic Survey will allow the posted speed limits to be upheld by the courts and will not constitute a "Speed Trap" as defined by CVC Section 40802. There are 88 total segments citywide that were selected for inclusion in the certification as listed in the Draft City of Alhambra 2023/2024 Engineering and Traffic Survey.

39. FIRST READING OF AN ORDINANCE TO IMPLEMENT CALIFORNIA UNIFORM
CONSTRUCTION COST ACCOUNTING PROCEDURES FOR PUBLIC
CONSTRUCTION PROJECTS, AMENDMENT TO THE ALHAMBRA MUNICIPAL
CODE REGARDING PUBLIC CONTRACT CODES AND UPDATING NON -PUBLIC PROJECTS/PROFESSIONAL SERVICES CONTRACT LIMITS – F2M24-62, O2M24 - 4837, M2M24-160
The Public Contract Code specifies the procedures that public agencies must follow when they build public works projects, including limits on project costs. The California Uniform Public Construction Cost Accounting (CUPCCAA) Act was enacted in 1983 as an alternative to these general requirements by allowing increased bid limits as long as participating agencies follow uniform accounting standards and bidding procedures. Staff is requesting the City Council “opt in” to the provisions set forth by the CUPCCAA Act.
This will allow public projects costing $60,000 or less to be performed by negotiated contract or by purchase order. Projects costing $200,000 or less can use informal bidding procedures set forth in the CUPCCAA Act. Projects that cost more than $200,000 must be put out to bid under formal bidding procedures. The benefits of adopting the CUPCCAA Act will increase the purchasing limit for public agencies, simplify bidding for projects that are $200,000 or less, reduce number of formal bids based on project size, and expedite contracting for projects under $200,000.In order for the City to avail itself of the higher bid and purchasing limits, the City must formally el ect to be bound by the provisions of the Uniform Public Construction Cost Accounting Act, which specifies the procedures for obtaining informal bids, and to use the uniform construction cost accounting procedures adopted by the California Uniform Constr uction Accounting Commission. Staff is requesting the City Council adopt Ordinance No. O2M24 -4837 and update the City of Alhambra's Purchasing Policy Limits as more specifically outlined in the Director of Finance’s August 26, 2024 staff report.
Recommended Action: City Council implement the California Uniform Public Construction Cost Accounting Act (CUPCCAA) enacted under Public Contracts Code Section 22000 through 22045 and amend Chapter 3.36 Purchasing of Supplies and Equipment, Chapter 3.38 Contracts for Consultant and Professional Services and Chapter
3.40 Bidding and Contracts for Public Projects in the City of Alhambra Municipal Code to include informal bidding procedures for public construction projects costing less than $200,000 (M2M24-160); and, direct the City Attorney to introduce and give first reading by title only, waiving further reading to following ordinance entitled:
Ordinance No. O2M24 -4837: AN ORDINANCE OF THE CITY COUNCIL

3.36 OF THE ALHAMBRA MUNICIPAL CODE RELATING TO THE
PURCHASING OF SUPPLIES AND EQUIPMENT, CHAPTER 3.38 OF
THE ALHAMBRA MUNICIPAL CODE, RELATED TO CONTRACTS FOR
CONSULTANT AND PROFESSIONAL SERVICES, CHAPTER 3.40 OF THE
ALHAMBRA MUNICIPAL CODE, RELATED TO BIDDING AND CONTRACTS
FOR PUBLIC PROJECTS, AND IMPLEMENTING THE CALIFORNIA
UNIFORM CONSTRUCTION COST ACCOUNTING PROCEDURES FOR

which ordinance shall return for a second reading and adoption at the next Council meeting on September 9, 2024.

Staff requests that the City Council adopt an urgency ordinance amending salary and benefits for Executive Management employees, Confidential employees and City Council Members and approve an updated class specification for Police Chief. 43. RESCIND PRIOR JULY 22, 2024 ACTION FOR ORDINANCE NO. O2M24 -4831 AND SECOND READING AND CONSIDERATION FOR ADOPTION OF ORDINANCE NO.
O2M24-4831 APPROVING ZONING TEXT AMENDMENT AMD -24-01 MAKING GENERAL CLARIFYING UPDATES TO THE CITY’S ZONING CODE AND DETERMINE THIS ACTION IS EXEMPT FROM CEQA – F2M20-24, O2M24-4831
Ordinance No. O2M24 -4831 was introduced for first reading at the June 24, 2024 City Council meeting and returned for a second reading and adoption at the July 22, 2024 City Council meeting. Shortly thereafte r, it was identified that there was an inconsistency between the Zoning Text Amendment language introduced at first reading and the
21 8-26-24
language adopted at second reading. Specifically, the text introduced at first reading included a clarifying statement in Alhambra Municipal Code (“AMC”) Sections 23.05.030.C (Minimum Residential Density, CBD, EMC, CMU, and AC Districts) and 23.06.030.A (Minimum Residential Density, PO and I Districts) specifying that the provisions of those sections only apply “if residential uses are proposed for the site.” This clarifying statement was not included in the text adopted at second reading on July 22 nd. Additionally, there were minor inconsistencies found in AMC Section 23.22.040 (Accessory Dwelling Units).
To rectify these inconsistencies, the language of the Zoning Text Amendment has been revised to reflect what was initially introduced for first reading on June 24 th and to be consistent with State law, and the Ordinance is returning for re -introduction for second reading and adoption.
Recommended Action: City Council:
1. Rescind the Council’s prior action on July 22, 2024 with respect to Ordinance No.
O2M24-4831;
