PUBLIC HEARING

2. PUBLIC HEARING RELATING TO THE COLLECTION OF COSTS AND FEES FOLLOWING WEED ABATEMENT AT 804 S. SIXTH STREET – F2M25-41, N2M25-95, R2M25-28, M2M25-119

This is the time and place set by Notice No. N2M25-95 for the City Council to hold a public hearing relating to the collection of costs and fees following weed abatement at 804 S.

Sixth Street. On August 22, 2024, the City received a complaint regarding overgrown

3 7-28-25
vegetation at 804 S. Sixth Street (the “ Property”). Upon inspection it was confirmed that the conditions of the property were in violation of Section 6.24.020 of the Alhambra Municipal Code (AMC) with overgrown weeds and vegetation. On August 26, 2024, a Notice of Violation was issued by mail and posted on the Property. No remedial action was taken. Numerous attempts were made by Code Enforcement to remedy the situation with no success. Overgrown weeds and vegetation are health and safety hazards. It is a property owner’s duty to keep their property free from weeds, which constitute a public nuisance under Section 6.24.020 of the AMC. Once the City issues a Notice to Abate per Section 6.24.030 of the AMC, the City has the authority to abate the nuisance itself to ensure the health and safety of the community is maintained per Section 6.24.070. On March 17, 2025, the Code Enforcement Division and accompanying City officials served and executed the Inspection and Abatement Warrant and conducted an abatement of the overgrown vegetation to rid the Property of health and safety violations.

Section 6.24.100 of the AMC requires that the record of costs be submitted to the City Council prior to June 30 th of the fiscal year in which the abatement work was performed, which was satisfied on June 23, 2025. A hearing on the confirmation of such costs must be held prior to July 30th of such year. As of this date, the total cost incurred by the City – including contractor services, attorney involvement, and City staff time is $30,660.45. Per Section 6.24.130 of the AMC, Council shall hear evidence surrounding the A gency Lien List, together with any objections from the property owners liable for the assessment, and may make any revision, correction, or modification to the costs owed. AMC Section

6.24.140 states that the total costs confirmed by Council shall constitu te a special assessment and a lien against the respective lot or parcel of land to which it relates. A special assessment is a tax bill levied by the County Auditor Controller’s Office, and a nuisance abatement lien constitutes a claim against the property which clouds title to the property and must be paid prior to sale of the property. Both types of liens can be foreclosed on in the event of non -payment. City staff recommends that the City Council approve both a lien and an assessment to ensure cost recovery, as set forth in the AMC.

Recommended Action: City Council:

1. Conduct a public hearing to receive public testimony; and,

2. Determine the correctness or reasonableness, or both, of the costs incurred ($30,660.45) in the City’s abatement of the nuisance conditions on the property located at 804 S. Sixth Street (“Property”); and,

3. Authorize a nuisance abatement lien and a special assessment against the Property in the amount of the City’s abatement costs (M2M25-119); and,

4. Adopt Resolution No. R2M25-28 entitled: A Resolution of the City Council of the City of Alhambra, California, confirming a report of abatement costs and authorizing a nuisance abatement lien and special tax assessment to be recorded on title against 804 South 6th Street
