AGENDA ITEM
DATE: December 6, 2023
TO: Mayor and City Council
FROM: Ann Eifert, Director of Financial Services/City Treasurer SUBJECT: TREASURER’S STATEMENT – OCTOBER 2023
Recommended Action:
Receive and file the October 2023 Treasurer’s Statement.
Fiscal Impact:
No Fiscal Impact.
Background:
Per City policy, the Finance Department presents the monthly Treasurer’s Statement for the City Council’s review. This statement shows the cash balances for the various funds, with a breakdown of bank account balances, investment account balances and the effective yield earned from investments.
Discussion:
The City’s portfolio consists of investments in Certificates of Deposits, US Treasuries, US Federal Agencies, Corporate Bonds, and Local Agency Investment Fund (LAIF). All funds invested with LAIF are available for withdrawal within 24 hours.
The Treasurer’s Statement provides information regarding the City’s investment portfolio and activity during the reporting month. The City’s investment portfolio is in compliance with all government codes as well as the City’s investment policy. Interest is credited to the City’s bank account monthly and allocated among the City’s funds. The current portfolio provides sufficient cash flow liquidity to meet the upcoming operating expenses and spending requirements for the next 6 months.

AGENDA ITEM
DATE: December 6, 2023
TO: Mayor and City Council
FROM: Ann Eifert, Director of Financial Services
SUBJECT: ANNUAL MEASURE M2 EXPENDITURE REPORT
Recommended Action:
Adopt a Resolution approving the City’s annual Measure M2 expenditure report for fiscal year ending June 30, 2023.
Fiscal Impact:
There is no financial impact in approving the annual expenditure report. The annual report is required to receive Measure M2 funds.
Background:
Measure M2 provides funding to local agencies through a half cent sales tax measure for street and traffic related maintenance and improvements and other transportation projects such as the Senior Mobility Program. Local jurisdictions are required to submit an annual report to the Orange County Transportation Authority to continue funding. The city has received approximately $8.5 million since 2011.
Discussion:
Requirements for the Measure M2 funding program include an annual expenditure report for all Measure M2 revenues and expenditures during the fiscal year, including general fund monies expended to satisfy Maintenance of Effort requirements, and fund balances at the beginning and fiscal year end. Measure M2 resources totaled $990,325 and expenditures totaled $1,415,248 for fiscal year 2022-23. Fund balance was used to bridge the funding gap as it is common to accumulate funds for multiple years to expend on larger projects. Projects funded by Measure M2 include the slurry seal project, signal synchronization, and Senior Mobility Program.

WHEREAS, local jurisdictions are required to account for Net Revenues, developer/traffic impact fees, and funds expended by local jurisdiction in the M2 Expenditure Report that satisfy the Maintenance of Effort requirements; and
WHEREAS, the M2 Expenditure Report shall include all Net Revenue fund balances, interest earned, and expenditures identified by type and program or project; and WHEREAS, the M2 Expenditure Report must be adopted and submitted to the OCTA each year within six months of the end of the local jurisdiction’s fiscal year to be eligible to receive Net Revenues as part of M2.

AGENDA ITEM
DATE: December 6, 2023
TO: Mayor and City Council
FROM: Ann Eifert, Director of Financial Services
SUBJECT: APPROPRIATION OF GRANT FUNDS FROM CALRECYLE
Recommended Action:
Authorize the appropriation of $71,231 in grant funding to the fiscal year 2023-24 budget.
Fiscal Impact:
The City was awarded $71,231 from CalRecycle’s Senate Bill (SB) 1383 Local Assistance Grant Program. Funds are used to offset General Fund costs in the support, implementation, and compliance with SB 1383 requirements.
Background:
SB 1383 was signed into law by Governor Jerry Brown on September 19, 2016. SB 1383 sets aggressive targets for reducing the amount of organic waste that can be sent to landfills. The law also requires jurisdictions to implement a food recovery program to assist the State in increasing edible food recovery by 20% and to establish mandatory organic recycling programs. In addition, SB 1383 requires all single family, multi-family, and commercial solid waste generators to have access to recycling programs that collect and recover organic waste.
In 2022, staff applied for CalRecycle’s SB 1383 Local Assistance Grant Program, which provides funding to assist local agencies in complying with SB 1383. The City was subsequently awarded $71,231 to offset costs associated with public education and outreach, inspections, enforcement, administration, and reporting.
Discussion:
Although funds were received in June 2022 from CalRecycle, funds have not been appropriated. As of month-end October 2023, $30,348 has been spent on eligible grant expenditures and the remaining funds will need to be expended by May 2024. It is recommended that City Council approve the appropriation of grant funds to the fiscal year 2023-24 budget.

SUBJECT: AWARD CONTRACT TO HARDY AND HARPER, INC. FOR THE ENTERPRISE STREET REHABILITATION PROJECT – ALISO VIEJO

______________________________________________________________________ Recommended Actions:
1. Approve Contract Documents, Specifications, and Plans for Enterprise Street Rehabilitation Project – Aliso Viejo Parkway to Aliso Creek Road;
2. Award a contract in the amount of $1,284,000 to Hardy & Harper, Inc. as the lowest responsible bidder for the Enterprise Street Rehabilitation Project – Aliso Viejo Parkway to Aliso Creek Road;
3. Authorize the City Manager to execute a contract with Hardy & Harper, Inc.;
4. Authorize City staff to make total compensation to Hardy & Harper, Inc. up to $1,284,000 plus $128,400 (10% of the contract amount) to allow for contingencies, totaling $1,412,400;
5. Declare this project categorically exempt from the California Environmental Quality Act (CEQA) process Per Title 14 of the California Code of Regulations, Chapter 3, Article 19, Section 15301 (Class 1: Existing Facilities); and
6. Authorize the appropriation of $92,400 in SB1 Funds to the fiscal year 2023-24 budget.
Fiscal Impact:
Total fiscal impact will be approximately $1,412,400 including construction ($1,284,000) and contingency ($128,400). The adopted fiscal year 2023-24 Capital Improvement Plan (CIP) budget includes $1,320,000 for construction and contingency. An additional appropriation of $92,400 from SB1 funds will be needed to complete the project. The Moulton Niguel Water District will reimburse the City approximately $46,440 for adjusting their sewer manholes and water valves.
Background:
The City advertised for bids through November 15, 2023 and multiple online plan rooms were used. Eleven contractors requested and received construction documents for the work.
46
The City received and opened five bids at 2:00 p.m. on November 15, 2023. The total amounts for each of the bids received are as follows:
Contractor Base Bid
1. Hardy& Harper, Inc. $1,284,000
2. Onyx Paving Company $1,369,000
3. All American Asphalt $1,479,146
4. RJ Noble Company $1,565,520
5. Excel Paving $1,878,780
City staff has reviewed the bid from Hardy &Harper, Inc. and the bid appears to be responsive and complete.

Discussion:
The engineer’s estimate for this base bid work was about $1,240,000. The average bid item costs were comparable to the engineer’s estimate.
Hardy & Harper, Inc. recently completed a street rehabilitation project in the Glenwood Terrace neighborhood for the City in 2019. They have also performed similar work in other surrounding cities with favorable references.
Staff requests approval of the contract and authorization for payments to Hardy and Harper, Inc. up to $1,412,400 (10% above the contract amount) to cover contingencies such as overages on quantities and additional work requested by the City.
