ORDINANCE NO. 2024-___

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALISO
VIEJO AMENDING SECTIONS 15.10.020 (PERMITTED USES IN
RESIDENTIAL DISTRICTS) AND 15.38.030 (RESIDENTIAL PARKING

REQUIREMENTS) OF THE ALISO VIEJO MUNICIPAL CODE

PERTAINING TO LOW BARRIER NAVIGATION CENTERS, GROUP

QUARTERS, AND EMPLOYEE HOUSING AND DETERMINING THE

ORDINANCE TO BE EXEMPT FROM CEQA
WHEREAS, the City of Aliso Viejo, California (“City”) is a municipal corporation, duly organized under the constitution and laws of the State of California; and WHEREAS, in recent years, the California Legislature has approved, and the Governor has signed into law, several bills that to impose new limits on local authority to regulate low barrier navigation centers, group quarters, and employee housing; and WHEREAS, in 2023, the City Council adopted the 6 th Cycle Housing Element which includes programs that commit the City to complete code amendments to comply with changes in law related to low barrier navigation centers, group quarters, and employee housing; and
WHEREAS, this ordinance (“Ordinance”) updates AVMC Sections 15.10.020 and

15.38.030 to comply with state law, including Government Code Section 65660, and Health and Safety Code Sections 1566.3 and 17021.5; and WHEREAS, on February 21, 2024, the City Council held a duly noticed public hearing and at which time all interested persons had the opportunity to appear and be heard on the matter of adopting the Codes as amended herein. Following the public hearing, the City Council introduced (i.e., conducted a first reading of) the Ordinance; and WHEREAS, all legal prerequisites to the adoption of this Ordinance have occurred.

NOW, THEREFORE, the City Council of the City of Aliso Viejo does ordain as follows:

SECTION 1. Incorporation of Recitals. The recitals above are each incorporated by reference and adopted as findings by the City Council.

SECTION 2. CEQA. Based on the entire record before it, the City Council finds that adoption of this Ordinance is exempt from the California Environmental Quality Act (CEQA) because it is an administrative activity that will not result in a direct or reasonably foreseeable indirect physical change to the environment and is thus not a “project” under State CEQA Guidelines section 15378. (See State CEQA Guidelines, § 15060(c)(2) and (3). Alternatively, even if the adoption of the Ordinance did qualify as a project under CEQA, the City Council finds that the Ordinance is exempt from CEQA pursuant to Section 15061(b)(3) of the State CEQA Guidelines, which provides that a project is exempt from CEQA where it can be seen with certainty that there is no possibility that the 14 60367.01100\42032625.2 2
activity in question may have a significant effect on the environment. The Ordinance will not have a significant effect on the environment as it does not authorize any construction or development; it simply updates select land use tables in the Aliso Viejo Municipal Code to comply with recent changes in state law governing the same.

SECTION 3. Required Findings. In accordance with Section 15.78.050(E) of the Aliso Viejo Municipal Code, the City Council hereby finds as follows:

1. Public Welfare . Adoption of this Ordinance will not create conditions materially detrimental to the public health, safety, and general welfare as it simply updates the AVMC to comply with state law requirements governing low barrier navigation centers, group quarters, residential care facilities, and employee housing in the City. Adoption of this Ordinance is also consistent with—and contemplated by—the City’s Sixth Cycle Housing Element, the adoption of which the City Council determined will not create conditions materially detrimental to the public health, safety, and general welfare.

2. General Plan. The Ordinance is consistent with, and in furtherance of, the City’s General Plan as it effectuates Aliso Viejo Municipal Code amendments contemplated by (and committed to in) the City’s Sixth Cycle Housing Element.

AGENDA ITEM
DATE: February 6, 2024
TO: Mayor and City Council
FROM: Shaun Pelletier, Director of Public Works / City Engineer SUBJECT: FIRST AMENDMENT TO THE AGREEMENT WITH HARBOR POINTE AIR

CONDITIONING & CONTROL SYSTEMS FOR HVAC MAINTENACE

SERVICES
______________________________________________________________________ Recommended Actions:

1. Approve a first amendment to the agreement with Harbor Pointe Air Conditioning & Control Systems to perform HVAC maintenance services that increases the total compensation under the agreement by $50,000 for a total agreement amount of $100,000; and

2. Authorize the City Manager to execute the first amendment to the agreement.

Fiscal Impact:

The contractor fee for this work is estimated to be $34,000 in FY 2024-25 for regular maintenance. There may also be a need for extra work if equipment fails. This work will be appropriated in the FY 2024-25 budget.

Background:

The City currently owns and maintains five (5) City facilities requiring HVAC maintenance:

Aliso Viejo Center, Aquatic Center, Iglesia Park Community Center, City Hall, and Aliso Viejo Ranch.

Staff issued an RFP for HVAC Maintenance Services at City Facilities in 2022. Harbor Pointe was selected as the HVAC maintenance contractor for all facilities for an initial agreement amount of $50,000.

Discussion:

Staff recommends Harbor Pointe to perform the HVAC Maintenance services because of their current experience in providing such services for the city, and their timely response to all extra work order calls. In addition to routine preventative maintenance services, unforeseen HVAC improvements were required at City Hall and Aliso Viejo Ranch. These 36

Page 2 of 2 ends

improvements included installing new HVAC door switches at the barn to improve the temperature control of the room and completion of the tenant improvements at City Hall Suite 200. As a result, the original amount of $50,000 was expended sooner than anticipated due to authorized extra work completed in the first 2 years of the agreement. The increase in total compensation by $50,000 will cover the $16,000 needed to complete HVAC preventative maintenance services for the remainder of FY 2023-24 and $34,000 for FY 2024-25. Funds for this service are already included in the FY 2023-24 budget and will be appropriated in the FY 2024-25 budget.

Harbor Pointe will continue to provide the requested quarterly service at the Aliso Viejo Center, Aquatic Center, City Hall, Iglesia Park Community Center, and Aliso Viejo Ranch.

Additional costs beyond preventative maintenance will be authorized by City staff prior to commencing the work. The initial term of the agreement will remain from July 1, 2022 through June 30, 2025. The City has the option to renew the agreement for two (2) additional one-year terms.

So Kim, Community Development Director
SUBJECT: A REQUEST TO ESTABLISH A PET GROOMING FACILITY IN

CONJUNCTION WITH A PET SUPPLY STORE (PET EVOLUTION)
WITHIN AN EXISTING BUILDING LOCATED AT 26541 ALISO CREEK

ROAD, SUITE A
Recommended Action:

Adopt a Resolution (Attachment 1) approving a Conditional Use Permit (USE-2023- 00029) to allow for a pet grooming facility in conjunction with a retail pet supply store (Pet Evolution) at 26541 Aliso Creek Drive, Suite A (USE-2023-00029).

Fiscal Impact:

There is no fiscal impact.

Background:

On December 11, 2023, Rick Zarski representing Pet Evolution (“Applicant”) submitted a Conditional Use Permit application to operate a pet grooming facility in conjunction with a retail pet store at 26541 Aliso Creek Drive, Suite A. The existing suite was previously occupied by a produce market called “Growers Direct”. On February 12, 2024, the application was deemed complete.

General Plan Land Use Designation: Town Center Commercial (“TCC”)/High Density Residential (“HDR”)
Zoning Designation: Specific Plan No. 2 Commercial-Town Center (“SP2-CTC”)
Environmental Review: Categorically Exempt
(CEQA Section 15301 – Existing Facilities)
45

Page 2 of 4 ends

Figure 1. Project Location Figure 2. Storefront
Discussion:

Operations
The proposed project consists of converting the existing 3,000 square foot tenant space into a retail pet supply store and pet grooming facility. The specific plan permits retail stores; therefore, the conditional use permit request is for the pet grooming facility only.

The Applicant states that the retail store will specialize in healthy pet food options, along with pet supplies including treats, toys, leashes, etc.

The grooming component of the operations consists of full -service grooming, where customers can drop off their pet to be serviced by the groomers. T he Applicant will also offer a self -service wash option, where customers can come in to wash their pets themselves. There are four self-service wash stations available. The self-service wash is a walk-in service, and the full-service grooming is by appointment only.

The Applicant estimates employing a total of 12to 15 individuals, with up to 10 employees onsite at any given time. The proposed hours of operation are Monday through Saturday from 9 a.m. to 8 p.m. and Sunday from 9 a.m. to 6 p.m.

Findings
The subject site, 26541 Aliso Creek Drive, Suite A , has a zoning designation of Specific Plan No. 2 Commercial-Town Center (“SP2-CTC”). This zoning designation allows animal grooming with an approval of a Conditional Use Permit (“CUP”). Pursuant to the Commons Specific Plan Section 7 Administration and Implementation, the following findings (in bold text) shall be made by the decision-making authority prior to the approval of a CUP.

PROJECT SITE
46

Page 3 of 4 ends

1. That the proposed conditional use is consistent with the General Plan.

The subject site has a General Plan land use designation of Town Center Commercial (“TCC”)/High Density Residential (“HDR”) which allows a mixture of community retail and commercial services. Section 4 of the Specific Plan further specifies that other uses, including but not limited to, dining, entertainment, theaters, and automotive, etc. are also allowed with an approval of a CUP.

Therefore, the proposed grooming facility will be consistent with the general plan and this finding can be made.

2. That the nature, condition and development of adjacent uses, buildings, and structures have been considered, and the proposed conditional use will not adversely affect or be materially detrimental to the adjacent uses, buildings, or structures.

The proposed location for the pet grooming facility is located in the Specific Plan No. 2 Commercial Town Center zoning district which is characterized by a variety of uses including retail, dining and entertainment uses. As such, adding grooming services to the permitted pet retail facility will be compatible with other variety of active uses in the shopping center. Therefore, this finding can be made.

3. That the proposed site is adequate in size and shape to accommodate the walls, fences, parking and loading facilities, landscaping and other land use development features prescribed in the specific plan and required by the City in order to integrate the use with existing and planned uses in the vicinity.

As discussed in the introductory paragraph above, the Specific Plan allows animal grooming with an approval of a CUP. The applicant proposes to remodel the interior of the existing suite with no exterior changes, except for the installation of signs. The proposed work will require compliance with the building code and therefore, will be consistent with the City’s regulations.

The grooming facility would be in an existing shopping center known as The Commons. The shopping center shares parking spaces through a series of reciprocal agreements for parking, access, encroachments, and utilities; therefore, parking is evaluated on all uses within the shopping center at a rate of one space per 220 square feet. The shopping center, which consists of the former Lowe’s building, perimeter buildings (e.g., Trader Joe’s, Walgreens, Taco Bell, etc.) and proposed tenant outdoor patios, consists of a total of 236,631 square feet. Based on this square footage, the parking requirement is 1,076 parking spaces, and 1,090 parking spaces are provided. No changes are proposed to the size of the subject tenant space that would impact the parking requirements.

Based on the discussion above, the site is adequate to accommodate the proposed animal grooming facility and therefore this finding can be made. 47

Page 4 of 4 ends

Environmental:

The proposed use is Categorically Exempt from environmental review per CEQA guidelines Section 15301 Existing Facilities, Class 1, as the proposed grooming service consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, involving no expansion of existing or former use.

Public Notice:

On February 22, 2024, a public notice of the public hearing was published in the Laguna Niguel News and mailed to all property owners within 300 feet of the subject site. No public comments were received in response.

WHEREAS, all other legal prerequisites to the adoption of this Resolution have occurred.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ALISO VIEJO, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:

SECTION 1. Determination of Recitals. The City Council hereby finds and determines that all of the recitals set forth above are true and correct. The above recitals are hereby incorporated as substantive findings of this Resolution.

SECTION 2. Compliance with CEQA. The City Council finds the proposed project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to a Class 1 exemption. The minor modifications to the interior of the building would involve only a negligible expansion of the proposed use (State CEQA Guidelines, § 15301 [Class 1 exemption applies to the operation, repair, maintenance, permitting, leasing, or minor alteration of existing structures, facilities, or topographical features involving negligible or no expansion of existing or former use]). Tenant improvements associated with the project are limited to the interior of the tenant space, consisting of flooring, wall panels and electrical work.

SECTION 3. Approval of Project and Findings for Conditional Use Permit. In accordance with Section 7 of The Commons at Aliso Town Center Specific Plan, the City Council hereby makes the following findings of fact and approves Conditional Use Permit 49 60367.01460\34673878.3 Page 2 of 10
USE-2023-00029 for a pet grooming facility in conjunction with a pet supply store, subject to the conditions set forth in Exhibit “A” and project plans set forth in Exhibit “B”, which are both attached hereto and incorporated herein by reference.

1. The proposed conditional use is consistent with the General Plan.

3. That the proposed site is adequate in size and shape to accommodate the walls, fences, parking and loading facilities, landscaping and other land use development features prescribed in the specific plan and required by the City in order to integrate the use with existing and planned uses in the vicinity. The Specific Plan allows animal grooming with approval of a CUP. The applicant proposes to remodel the interior of the existing suite with no exterior changes, except for the installation of signs. The parking requirement for the tenant space is based on size. As no physical changes are proposed to the tenant space or the shopping center, there will be no impact to parking.

SECTION 4. Filing of Notice of Exemption. The City Council hereby authorizes and directs staff to prepare, execute and file with the Orange County Clerk a Notice of Exemption for the proposed Project. Additionally, the Notice of Exemption for this project will be posted on the City of Aliso Viejo website, filed in the State Clearinghouse CEQA.net website, and provide the notice to parties requesting notification.

SECTION 5. Location of Documents. The administrative record for the Project is maintained at City Hall located at 12 Journey, Suite 100, Aliso Viejo, CA 92656. The custodian of records is the City Clerk.
