AGENDA ITEM
DATE: August 7, 2024
TO: Mayor and City Council
FROM: Shaun Pelletier, Director of Public Works / City Engineer SUBJECT: COOPERATIVE AGREEMENT WITH DRC PACIFIC, INC. FOR

DISASTER-RELATED DEBRIS MANAGEMENT SERVICES
______________________________________________________________________ Recommended Actions:

1. Approve a cooperative agreement with DRC Pacific, Inc. to perform disaster-related debris management services; and

2. Authorize the City Manager to execute the cooperative agreement.

Fiscal Impact:

There is no fiscal impact executing this agreement unless staff authorizes debris removal work to be performed during a declared disaster. In these situations, it is anticipated that 75% would be reimbursed by FEMA, and 18.75% reimbursed by CalOES, with the remaining 6.25% being the local match required.

Background:

The City of Aliso Viejo from time to time requires debris removal services during natural or manmade disasters. Typically, this work is completed by our street maintenance contractor or their subcontractors, but its possible a larger event could require additional resources.

Discussion:

The County of Orange procured disaster-related debris management services with DRC Pacific through a competitive bidding process in 2021, and the agreement allows the provisions and pricing to be extended to other California local or state governmental entities. Staff respectfully recommends approval of this cooperative agreement to provide flexibility in quickly serving the residents during any emergency situations.

ACCESSORY DWELLING UNITS AND JUNIOR ACCESSORY

DWELLING UNITS
Recommended Action:

Continue the public hearing to August 21, 2024.

Fiscal Impact:

There is no fiscal impact.

Background:

In March 2023, City Council adopted Ordinance No. 2023-235, updating regulations pertaining to accessory dwelling units and junior accessory dwelling units in compliance with state law. The adopted ordinance was subsequently submitted to the Department of Housing and Community Development (HCD). In June 2024, HCD completed its review of the City’s Ordinance and issued a letter requesting additional amendments. On July 31, 2024, HCD emailed Staff, requesting more clarifications. Consequently, Staff is requesting additional time to address HCD’s recent comments. 83 1

SUBJECT: CONSIDERATION OF AN ORDINANCE AMENDING CHAPTER 8.22 OF

THE MUNICIPAL CODE REGARDING CAMPING ON PUBLIC PROPERTY Recommended Actions:

1. Find that the proposed ordinance is not a “project” subject to the California Environmental Quality Act (“CEQA”) pursuant to State CEQA Guidelines section 15378(a) and, in the alternative, is exempt from CEQA under State CEQA Guidelines section 15061(b)(3); and

2. Introduce for first reading an ordinance, entitled: AN ORDINANCE OF THE CITY

COUNCIL OF THE CITY OF ALISO VIEJO, CALIFORNIA AMENDING CHAPTER

8.22 OF THE ALISO VIEJO MUNICIPAL CODE REGARDING CAMPING ON PUBLIC

PROPERTY AND FINDING THE ORDINANCE DOES NOT QUALIFY AS A PROJECT

SUBJECT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT AND IS EXEMPT UNDER STATE CEQA GUIDELINES SECTION 15061(B)(3).

Fiscal Impact:

None.

Background:

Chapter 8.22 of the Aliso Viejo Municipal Code (“AVMC”) prohibits camping on public property. But AVMC section 8.22.040 barred enforcement of Chapter 8.22’s prohibitions of public camping if the potential arrestee had no alternative shelter , as required under Martin v. City of Boise (920 F.3d 584, 616), a recently reversed 2019 Ninth Circuit Court of Appeals decision that required that limitation on enforcement; and Discussion:

The caselaw giving rise to this bar on enforcement was recently overruled. On June 28, 2024, the U.S. Supreme Court issued its decision in Johnson v. City of Grants Pass, Oregon. Among other things, the Supreme Court held that the Eighth Amendment does not prohibit cities from enforcing laws regulating camping on public property (144 S.Ct. 84 2
2202). The Supreme Court’s Johnson decision abrogates (i.e., overrules) the Ninth Circuit’s decision in Martin. Consequently, Martin is no longer good law or binding on cities.

The attached ordinance surgically amends AVMC section 8.22.040 to remove the outdated Martin provision. Staffs’ recommendation is for the City Council to introduce the ordinance for first reading this evening and set it for second reading and adoption at a subsequent meeting.

Environmental:

The ordinance is not a “project” subject CEQA” because it has no potential to result in either a direct, or reasonably foreseeable indirect, physical change in the environment. (State CEQA Guidelines, § 15378(a).) The ordinance simply strikes a reference to a Ninth Circuit decision that was overruled. In the alternative, the ordinance falls within the “common sense” exemption set forth in State CEQA Guidelines section 15061(b)(3), which exempts activity from CEQA where “it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment.” Here, it can be seen with certainty that there is no possibility that the ordinance may have a significant effect on the environment because the ordinance simply strikes an outdated reference to an overruled Ninth Circuit decision; it will not result in any development or in any new activity with the potential to impact the environment.

AGENDA ITEM
DATE: August 7, 2024
TO: Mayor and City Council
FROM: So Kim, Community Development Director
SUBJECT: DEVELOPMENT IMPACT FEES
Recommended Actions:

1. Receive and file; or

2. Direct Staff to begin a fee study to reassess the park in-lieu fee; or

3. Direct Staff to begin a comprehensive fee study.

Fiscal Impact:

If the City Council directs Staff to proceed with a fee study, funding will need to be allocated through the General Fund for consulting services.

Background:

The City recently adopted the Housing Element, mandating the rezoning of several properties to accommodate 1,195 residential units across different affordability ranges.

With the notable increase in residential units in areas that were previously not designated for such uses, there is a need to assess the possible fiscal impacts of these units on the City’s public services and infrastructure.

Discussion:

Currently, Municipal Code (“AVMC”) Section 14.16 requires park dedication or payment of impact fees (“park in-lieu fee”) as a condition of approval of a new residential subdivision or conversion of existing apartment units. In addition to park in-lieu fees, the City has provisions that require a development agreement (“DA”) for development projects that require a general plan amendment or zone change with a site development or use permit. A DA is a contract between the City and the developer, which may specify conditions, terms, restrictions, and regulations pertaining to all aspects of a development project. The DA may include payment of fees, similar to park in-lieu fees to mitigate development impacts to parks, schools, traffic, etc. Recent changes to State housing 90

Page 2 of 2 ends

laws have significantly limited the areas in which the City may require development agreements. Additionally, in some cases, State law and recent federal case law even prohibit the City’s case-by-case discretionary review of projects, including the imposition of conditions for the provision of parks or other public facilities. The new laws provide much greater leeway for facility impact fees imposed on all building permits pursuant to a master fee program.

Any “fair share” fee or exaction requires a connection, or “nexus”, between the public benefits and the impacts of the development. This concept of nexus has been highlighted by a recent U.S. Supreme Court decision, Sheetz v. El Dorado County , which involved development impact fees. The court ruled that these fees must be “roughly proportional” to the impact of the development, emphasizing the importance of ensuring that development agreements and associated fees are carefully calibrated to reflect the actual impacts of the development.

While the City currently mandates only a park in-lieu fee, the basis for the fee may be outdated in terms of land inventory and costs inventory available for parkland and improvements. Further, other Orange County cities levy additional impact fees for other facilities such as traffic and housing. Consequently, the City Council should consider updating its park fee ordinance and may want to consider evaluating the need for other “fair share” facility fees for the 1,195 residential units outlined in the Housing Element.

This could provide a structured way to offset the costs associated with new development projects, such as funding of public facilities through payment of fees or participation in community facilities districts. It should be noted that while additional or increased fees may have obvious financial benefits, they will need to be evaluated in terms of their possible constraint on development and affordable housing.

Several cities have recently finalized or are currently conducting development impact studies. The costs for these studies typically fall within a range of approximately $30,000 to $70,000. The time frame required to complete these studies is generally around 6 months.

In addition to the development impact fee study covering “bricks and mortar” for facilities, the City Council may want to consider conducting a more extensive fee study covering service fees and whether they need to be adjusted for cost recovery. The total cost for a comprehensive fee study, which includes both the development impact fee study and the larger fee study, is estimated to be between $70,000 and $110,000. This comprehensive study would provide a more complete understanding of the costs associated with City services.

If the City Council chooses to commence either or both of the previously mentioned fee studies, the Staff will issue a Request for Proposal and present a contract at a future meeting. The funding for the study will need to be allocated through the General Fund. 91
