REGULAR AGENDA

3. Audit Update - Because audit is during tax season there are some delays but progress is being made. Completion date should be sometime in May. Because Mary Louise Nixon was a CPA, every monthly financial report contained an audit.

The question was asked how often should audits be performed?

4. Housing Element 2024 Annual Progress Report - Planner Susan Peters report that adopted Housing Element requires certification. Many government grants relate to housing. In accordance with State laws an annual report is due on 5' of April of every year. Our Housing Element is done in collaboration with Amador County and the other four cities. Each city and county had a different reviewer. Leap grants will pay for updates to zoning codes. Local Design Review Committee findings are not required to be submitted to City Council. Restraints should be removed where possible to allow housing to happen. Our city exhibits slope instability. State Officials are concerned about recent firing at Federal level. FEMA is "on the chopping block". A work shop is in planning stage for applying for Federal money for water for future growth.

5. Amador City Business and Community Association
ACBCA was formed in 2017 as a Not-for- Profit organization for charity activity. It matters for donations that are tax deductible. There are three Board Members, Chris Walsh is Secretary, A'laina Lyons is Treasurer, and Amelia Ambroselli is President. This year the tax forms were filed on time. Ads for Amador City have been placed in the Visitor's Guide. Coming events are Amapola, and the Poppy/Puppy Bike Ride. Three Dancin' in the Streets events are planned. This year there will be square dancing available with Blue Grass music. Day of the Dead will be celebrated November 2, The First weekend in December will be Main Street Magic. A Community Pot Luck is planned for May 18. Water Street will be closed to vehicular traffic to accommodate a VERY long table for dining. City Administrator Groth asked for a financial statement which A'laina will provide. ACBCA has established an endowment. They also have applied for grants from Amador Arts and the Reservation. Councilperson Bragstad asked if the name could be changed back to GOLDPAN; however, that would require extensive paper work to continue the non-profit status. ACBCA requested a donation of $1,600.00 which is smaller than previous requests. This sum will go towards paying for three bands for the three Dancin' in the Streets events. Sherrill moved, 2nü by Bragstad, approved unanimously.

6. Records Retention Plan for Amador City. - Councilman Ambroselli proposed this plan to store documents, maintain digital access, provide list of categories, and increase transparency. He suggested an ad hoc committee be formed to work on this project. Bragstad moved, 2nd by Sherrill to form committee, approved unanimously.

7. Update - Old City Hall - Anonymous donation has been deposited with city's matching 25%. Locks have been changed. Inner door to be opened to allow access to filing cabinets. Next meeting will be held in Old City Hall. Length of occupation unknown but could be possibly 18 months.

CITY OF AMADOR CITY
City Council Memorandum
To: Honorable Mayor and Members of the City Council
From: Matt Ospital, City Engineer MSO
Date: May 15, 2025
Subject: Amador City Hall Fire Remediation Project
Background
The City of Amador City conducted the bid opening for the Amador City Hall Fire Remediation Project at 10:00 a.m. on February 13, 2025. The City received two bids for the project as follows:

Contractor Base Bid Add Alt #1 Add Alt #2 Add Alt #3 Total Bid Laguna Gold
Mortgage (LGM) $558,940.80 $32,504.00 $35,137.00 $91,160.00 $717,741.80 John Allen
$869,350.00 $17,400.00 $38,500.00 $89,100.00 $1,014,350.00 Construction
Attached is the bid tabulation for your reference.

Our office has reviewed both bid packages and found calculation discrepancies within LGM's bid.

Discussion
On February 18, 2025, Laguna Gold Mortgage formally withdrew their bid due to material mistakes in their submitted bid. As a result, John Allen Construction's bid was submitted to the insurance adjuster for their approval. Although the insurance had previously approved the scope of work, the adjuster was not satisfied with the total cost submitted by John Allen Construction.

John Allen was able to propose an alternate electrical design allowing him to revise his estimate (see table below). The revised estimate was then submitted to the insurance company which they have now approved.

Revised 3/27/25 Base Bid Add Alt #1 Add Alt #2 Add Alt #3 Total Bid John Allen
Construction $820,550.00 $17,400.00 $38,500.00 $89,100.00 $965,550.00 Recommendation
Following LGM Construction's formal withdraw, John Allen Construction's revision of the electrical design and their bid, and the approval by the insurance adjuster, it is recommended the contract be awarded to John Allen Construction for the Base Bid and Additive Alternates #1 & #2 for $876,450.

Fiscal Impact
The cost of the Base Bid will be covered by the insurance company; Additive Alternates #1 & #2 will be paid for by the City.

Thanks for sending over the bridge inspection reports for the Amador City Bridge. These recent reports are recommending that the City install a methacrylate sealant for maintenance purposes (see attached bridge inspection report - page 6).

I reached out to George Reed Construction to see whom they work with for bridge sealing work. They referred me to a company called Dees Burke Engineering (DBE) Constructors.

I received a quote from DBE for approximately $22,330 (see attached), but it excludes work that the City will need, like a detour/traffic control, air monitoring, insurance, bonds, etc.

When it comes time to have this work done, I would plan for $50,000 to $100,000 in cost for plans/specs/advertising, construction, construction oversight. The life of the methacrylate work is expected to be between 10 to 15 years, but it could be more due to the low traffic volume.

Let me know if you need anything else or have any questions.

Thanks,

Presentation to The City Council during Public Comments Section Subject: Fire Safety - Illegal/Chronic Parking at a Fire Hydrant Greetings:

Our kitchen window looks directly down West School Street. From this vantage point, we regularly see vehicles parked illegally close to the fire hydrant at the intersection of Water Street and West School Street.

The CA Vehicle Code is clear, Section 22514, that it is illegal to park within 15' of a fire hydrant.

It is easy to alert drivers to this law via two basic signs that state:
"No Parking Between Signs".

Everything that can reasonably done to be fire safe should be done.

This memo notifies the Amador City Council of the need to address this dangerous vehicle violation issue.

Please add this as an upcoming Agenda Item, or just execute this easy and cost-effective fix.

Thank you,

Smoke-free Parks
My name is Lori Brandmeier with Tobacco Reduction of Amador County (TRAC), a program of Amador County Public Health. This program is funded by Prop 99 and 56 tobacco tax revenues. One of our objectives is smoke-free parks and public places. We can provide education about the dangers of secondhand smoke, support jurisdictions who wish to implement smoke-free park ordinances and provide each park with no smoking signs.

Playgrounds and tot lots, Health and Safety Code 104495:

A person shall not smoke a cigarette, cigar, or other tobacco products within 25 feet of any playground of tot lot or within 250 feet of a youth sporting event Reasons for smoke-free parks:

There is no safe level of secondhand smoke, even outside. Children exposed to secondhand smoke are at risk of asthma, earaches, and Sudden Infant Death Syndrome (SIDS).

Reduces tobacco litter:

Cigarette butts are the most litter item in the country, harming our environment.

Tobacco-free policies protect children and animals from ingesting tobacco product waste and reduced park maintenance costs.

Wildfire prevention: Restricting smoking removes one of the top causes of human- started wildfires- improperly discarded cigarette butts that can ignite dry grass and leaves.

Progress in Amador County:

City of Jackson, City of Ione, and City of Plymouth have passed smoke-free parks policies.

California's Statewide Smoke-Free Air Laws & Restrictions Smoke-Free Air Laws Matter
Smoking and secondhand smoke cause life threatening diseases. It is estimated that nearly 40,000 Californians die each year from diseases caused by smoking and secondhand smoke exposure! California has long led the way in adopting strong and innovative smoke-free air laws that protect people from secondhand smoke exposure. These laws protect Californians at most workplaces and in spaces often frequented by children and youth, who are especially vulnerable to the negative health effects of secondhand smoke. California's smoke-free laws include tobacco products such as cigarettes, cigars, and pipes, as well as electronic smoking devices. Certain laws prohibit the use of all tobacco products, including tobacco that is chewed or dissolved.

Free help with quitting is available at https://www.nobutts.org/or by calling 1-800-NO BUTTS and 1-844-8-NO VAPE.

Why We Need Smoke-Free Parks
People visit parks in Amador County to enjoy the fresh air, tall trees, green grass, and clean playgrounds and trails. However, tobacco use at parks adds to the problems of secondhand smoke, litter, fire, as well as poor modeling behavior for children. This fact sheet outlines the benefits of laws and policies for creating smoke-free parks.

Smoke-free parks promote healthy living.
• By passing smoke-free park laws, cities and counties can make outdoor activities healthier and free from dangerous and nuisance, secondhand smoke.!,2,3 • Smoke-free parks allow children to model healthy behavior from adults, and encourage smokers to smoke less or even quit.*
• Smoke-free park laws help reduce tobacco litter and fire risk.

Many communities already have smoke-free parks.
• Other small, rural counties, like Amador County, already have smoke-free parks policies. Some of these include Butte County, Placer County, and Calaveras County. • The city of Jackson passed a comprehensive smoke-free parks ordinance in 2015. • The city of lone passed a comprehensive smoke-free parks ordinance in 2018. • The city of Plymouth passed a comprehensive smoke-free parks ordinance in 2024.

Smoke-free park laws are easy to enforce.
• Posting no-smoking signs at parks entrances and at playgrounds reminds people of the law, and most will comply.
• People will police themselves. Friends and even strangers will remind tobacco users to either stop smoking or briefly leave the park.
• Very seldom will people ignore the signs and disapproving voices from friends and strangers. In the case they choose to ignore the law, fines and other penalties, which law enforcement can provide, will further deter smoking.
