Adopt a Resolu/on reaffirming that, due to the con/nuing COVID-19 Pandemic, a local emergency exists, re-ra/fying the Proclama/on of a State of Emergency by Governor Newsom on March 4, 2020, and authorizing in-person and remote teleconferenced mee/ngs of legisla/ve and advisory bodies of the City of American Canyon for the period of July 19, 2022 to August 18, 2022 pursuant to the Ralph M. Brown Act.

BACKGROUND & ANALYSIS
Because of the COVID-19 Pandemic, the City Council, as well as the City Planning Commission and Board of Directors of the American Canyon Fire Protec/on District, have been conduc/ng mee/ngs via Zoom teleconference, as allowed by Execu/ve Order N-29-20. However, the Execu/ve Order expired on September 30, 2021.
Assembly Bill 361, which was approved at by the Governor on September 16, 2021, allows local agencies such as the City to con/nue to meet by Zoom or other teleconferencing methods, provided that certain conditions are met.
The effect of Execu/ve Order N-29-20 was to suspend certain provisions of the Ralph M. Brown Open Mee/ng Act (Government Code Sec/on 54950 et seq.), which only allowed remote teleconference par/cipa/on by City Council Members through a pos/ng process at each teleconferenced member’s loca/on, with agenda provisions indica/ng that each teleconferenced location be accessible to the public.
The aBached Resolu/on complies with the provisions of AB 361 to allow con/nued Zoom mee/ngs of the City Council, while also allowing the mee/ngs to be conducted with in-person aBendance.
This “hybrid” style of mee/ng con/nues to promote social distancing by allowing members of the Council, City Staff, and members of the public to par/cipate in the manner in which they feel most safe, thereby promo/ng public par/cipa/on while simultaneously protec/ng vulnerable members of 18 the public, such as those with compromised immune systems.
The ability to con/nue to meet by Zoom, even in conjunc/on with Open Mee/ngs, can be accomplished by the City Council provided that monthly resolu/ons as agendized are enacted with provisions referencing appropriate confirmation of declared emergencies are described.
Stated plainly, the City Council will have to enact a “361 Resolu/on” at least every 30 days to allow the Zoom teleconferencing procedure to continue.
Changes to the first page of the City Council Agendas were made beginning October 2021, as the means for the public to par/cipate via con/nued Zoom teleconference will have to be described consistent with the AB 361 procedures rather than the now-expired Execu/ve Order N-29-20. These changes indicate that, pursuant to this authority, members of the public and members of the City Council may con/nue to par/cipate by Zoom video/teleconferencing, or alterna/vely par/cipate inperson at the designated physical meeting location.
COUNCIL PRIORITY PROGRAMS AND PROJECTS

FISCAL IMPACT

WHEREAS, due to the emergence of new variants of COVID-19, such as Delta Variant, followed by the surging Omicron Variant of COVID-19, not all members of the public may feel safe to participate personally at in-person meetings; and,

BACKGROUND & ANALYSIS
A livable community is a place that is not simply habitable, but that is desirable. It is not just where people live, but where they want to live.
The Na4onal Community Survey (NCS) asks residents their opinion about certain aspects of “livability” in American Canyon. The NCS was developed by the experts at Polco, Inc. (formerly Na4onal Research Center, Inc.). American Canyon last undertook the NCS in 2015. The NCS Report in Attachment 1 summarizes the responses to survey.
Great communi4es are partnerships of the government, private sector, community-based organiza4ons and residents, all geographically connected. The NCS captures residents’ opinions considering the following central facets of a community:
Economy
Mobility
Community Design
Utilities
Safety
Natural Environment
Parks and Recreation
Health and Wellness
Education, Arts, and Culture
Inclusivity and Engagement
48 Survey Method
The NCS was conducted was conducted over several weeks this past February and March. In keeping with contemporary na4onal trends for data gathering, there were three ways to par4cipate in the survey: paper ballot (invita4on only), on-line (invita4on only), and on-line (open participation). All three methods contained the same questions.
American Canyon has approximately 4,500 households. Approximately 2,700 randomly selected households received mailings beginning on February 7th, 2022 and the survey remained open for seven weeks. Of those invited to par4cipate, for 1,200 households, the first mailing was a postcard invi4ng the household to par4cipate in the survey. The next mailing contained a cover leDer with instruc4ons, the survey ques4onnaire, and a postage-paid return envelope. The final mailing contained a reminder letter, another survey, and a postage-paid return envelope.
For the remaining 1,500 households, the first mailing was a postcard invi4ng the household to par4cipate, followed one week later by a reminder postcard. All mailings included a web link to give residents the opportunity to respond to the survey online. All follow-up mailings asked those who had not completed the survey to do so and those who had already done so to refrain from completing the survey again.
Thirty-two (32) of the 2,700 mailed invita4ons or surveys were returned because the household address was vacant or the postal service was unable to deliver the survey as addressed. Of the remaining 2,668 households that received the invita4ons to par4cipate, 335 completed the survey, providing an overall response rate of 13%.
The NCS was available in English, Spanish, and Tagalog. All mailings contained paragraphs in all 3 languages instruc4ng par4cipants on how to complete the survey in their preferred language. Of note, only a handful of Spanish and Tagalog surveys were completed.
It is customary to describe the precision of es4mates made from surveys by a “level of confidence” and accompanying “confidence interval” (or margin of error). A tradi4onal level of confidence, and the one used in the Report, is 95%. The 95% confidence interval can be any size and quan4fies the sampling error or imprecision of the survey results because some residents’ opinions are relied on to es4mate all residents’ opinions. The margin of error for the City of American Canyon survey is no greater than plus or minus 5 percentage points around any given percent reported for all respondents (335 completed surveys).
In addi4on to the randomly selected “probability sample” of households, a link to an online open par4cipa4on survey was publicized by the City of American Canyon. The open par4cipa4on survey was iden4cal to the probability sample survey with one small update; it included a ques4on about where they heard about the survey. The open par4cipa4on survey was open to all city residents and became available on March 7th, 2022. The survey remained open for three weeks. The data presented in the following tabs exclude the open par4cipa4on survey data, but a tab at the end 49 provides the complete frequency of responses to questions by the open participation respondents.
Key Findings
The Report compares American Canyon (pop. 21,000) with responses to Na4onal Benchmarks (allsized ci4es) and Custom Benchmarks - comparisons of American Canyon's (results to those from other communi4es with popula4on 15,000 to 35,000). It also compares American Canyon's 2022 and 2015 survey results. It is important to note the survey was administered during the COVID-19 pandemic, a 4me of previously unimaginable challenge for many communi4es - including American Canyon. While the NCS Report provides comparisons to na4onal benchmarks, it is important to note that much of the benchmark data was collected prior to the pandemic. This may impact how American Canyon's ra4ngs compare to other communi4es’ ra4ngs from the past five years as well as the comparison to American Canyon's 2015 NCS results.
A summary of key findings is below:
Residents appreciate American Canyon's governance and leadership.
All 2022 survey items pertaining to the City's governance received reviews on par with na4onal benchmarks. Nearly 70% of residents gave posi4ve evalua4ons to the overall quality of services provided by the City, similar to comparison communi4es across the na4on. Three-quarters of respondents favorably rated the overall customer service by American canyon employees, and American Canyon's public informa4on services. Addi4onally, respondents gave high marks to City leadership, with about two-thirds of respondents feeling that residents were treated fairly and with respect. About 6 in 10 residents posi4vely rated the job American Canyon government does at welcoming resident involvement. At least half of residents evaluated American Canyon officials as being honest and generally ac4ng in the best interest of the community. In a set of ques4ons unique to American Canyon, residents were asked to rate the City's response to COVID-19. Nearly 7 in 10 provided excellent or good ra4ngs to the City for generally ac4ng in the best interest of the community, being open and transparent to the public, informing residents about COVID-19 related issues facing the community, and resident's overall confidence in the government's COVID-19 response.
Although some aspects of American Canyon's economy have seen small gains over ,me, this facet remains and area of opportunity for the community.
The economy is a concern for most residents within American Canyon, with 93% ra4ng it an essen4al or very important focus area for the next few years. When asked what impact, if any, the economy would likely have on their family income in the next six months, only 19% of residents expected a posi4ve impact, while 37% felt it would have a nega4ve impact (a 17% decrease from American Canyon's 2015 survey results). About one-quarter of residents posi4vely reviewed the City's vibrancy of downtown/commercial areas, which was a slight increase over the prior survey but scored much lower than in comparison communi4es across the country. A similar propor4on of respondents were pleased with the City's shopping opportuni4es and employment opportuni4es, also lower than the na4onal benchmarks. About 4 in 10 gave posi4ve marks to American Canyon as 50 a place to visit, as well as to the community's economic development. Roughly one-third gave favorable ra4ngs to the variety of business and service establishments, but more than half indicated that the overall quality of business and service establishments was excellent or good (a 15% increase from the previous survey). In addi4on, the overall economic health of American Canyon improved slightly since 2015, with more than 6 in 10 respondents offering positive evaluations.
Survey respondents indicate that crime may be a concern but value the City's safety services.
Nearly all residents (99%) rated safety as essen4al or very important for the City to focus on in the coming two years. About 8 in 10 residents scored the feeling of safety in their neighborhood during the day posi4vely, which was on par with benchmark comparisons. Three-quarters reported feeling safe in American Canyon's downtown/commercial area during the day (lower than na4onal benchmark comparisons). About 6 in 10 residents felt very or somewhat safe from violent crime and property crime, both of which were also lower than na4onal benchmarks. The majority of residents gave favorable reviews of the City's fire services (91%) and ambulance or emergency medical services (83%). Three-quarters gave posi4ve marks to police services and fire preven4on and educa4on, and a similar percentage reported feeling safe from fire, flood, or other natural disasters.
About 6 in 10 residents reviewed crime preven4on and emergency preparedness favorably. All of these safety services were on par with national averages.
American Canyon residents see their community as welcoming and inclusive, contribu,ng to a positive overall quality of life.
Most residents posi4vely rated the City as a place to live (83% excellent or good) and the overall quality of life in American Canyon (77%). About 8 in 10 were also likely to recommend living in American Canyon and planned to remain in the City for the next few years. A similarly high propor4on favorably reviewed American Canyon as a place to raise children (80%). Ra4ngs for the City's inclusivity were also posi4ve, likely contribu4ng to the high quality of life experienced by residents. About 8 in 10 residents posi4vely rated the community for valuing and respec4ng residents from diverse backgrounds and aDrac4ng people from diverse backgrounds, both of which scored higher than the na4onal benchmark comparisons. Similarly, American Canyon received posi4ve marks from three-quarters of residents for making all residents feel welcome. The majority of residents were pleased with the sense of community in American Canyon (68%) and the openness and acceptance of the community toward people of diverse backgrounds (69%). Addi4onally, at least half rated the neighborliness of residents and the of civic/community pride as excellent or good.
The Report was published on the City's website on June 8, 2022. This included the 2022 Na4onal Community Survey Report of Results, the "Full Trends," which represent the comparison of the current survey results to the 2015 results and access the full data of the survey.
Staff recommends the Council receive and file the 2022 National Community Survey Report.
COUNCIL PRIORITY PROGRAMS AND PROJECTS
51 Organizational Effectiveness: "Deliver exemplary government services."
FISCAL IMPACT
The cost of administering the NCS was included and expended as part of the FY 21/22 Budget. The FY 2022/23 Budget includes funding to maintain an ongoing subscrip4on with Polco for addi4onal community engagement.
As a part of our current subscrip4on, Polco now offers "Quick Link Surveys". This set of surveys and polls, developed by survey scien4sts at Polco’s Na4onal Research Center, focus on the heart of livability in communi4es, with topics such as Community Iden4ty, Neighborliness, Customer Service, and Community Highlights & Challenges. These surveys are designed to provide ongoing feedback from residents in many of the areas the NCS Report provided. As Polco collects data na4onally from these short surveys, they will share findings with Polco users like American Canyon to bring both local and na4onal insights. Polco will also provide best prac4ces in engagement and outreach to communicate about these surveys with the community.

53 About The NCS™
The National Community Survey™ (The NCS™) report is about the “livability” of American Canyon. A livable community is a place that is not simply habitable, but that is desirable. It is not only where people do live, but where they want to live. The survey was developed by the experts from National Research Center at Polco.
Great communities are partnerships of the government, private sector, community-based organizations and residents, all geographically connected. The NCS captures residents’ opinions considering ten central facets of a community:
• Economy
• Mobility
• Community Design
• Utilities
• Safety
• Natural Environment
• Parks and Recreation
• Health and Wellness
• Education, Arts, and Culture
• Inclusivity and Engagement
The report provides the opinions of a representative sample of 335 residents of the City of American Canyon collected from February 7th, 2022 to March 28th, 2022. The margin of error around any reported percentage is 5% for all respondents and the response rate for the 2021 survey was 13%. Survey results were weighted so that the demographic profile of respondents was representative of the demographic profile of adults in American Canyon.
How the results are reported
For the most part, the percentages presented in the following tabs represent the “percent positive.” Most commonly, the percent positive is the combination of the top two most positive response options (i.e., excellent/good, very safe/somewhat safe, etc.). On many of the questions in the survey respondents may answer “don’t know.” The proportion of respondents giving this reply is shown in the full set of responses included in the tab “Complete data.” However, these responses have been removed from the analyses presented in most of the tabs. In other words, the tables and graphs display the responses from respondents who had an opinion about a specific item.
Comparisons to benchmarks
NRC’s database of comparative resident opinion is comprised of resident perspectives gathered in surveys from over 600 communities whose residents evaluated the same kinds of topics on The National Community Survey. The comparison evaluations are from the most recent survey completed in each community in the last five years. NRC adds the latest results quickly upon survey completion, keeping the benchmark data fresh and relevant. The communities in the database represent a wide geographic and population range. In each tab, American Canyon's results are noted as being “higher” than the benchmark, “lower” than the benchmark, or “similar” to the benchmark, meaning that the average rating given by American Canyon residents is statistically similar to or different (greater or lesser) than the benchmark. Being rated as “higher” or “lower” than the benchmark means that American Canyon's average rating for a particular item was more than 10 points different than the benchmark. If a rating was “much higher” or “much lower,” then American Canyon's average rating was more than 20 points different when compared to the benchmark.
The survey was administered during the COVID-19 pandemic, a time of challenge for many local governments. While we provide comparisons to national benchmarks, it is important to note that much of the benchmark data was collected prior to the pandemic. This may impact how your City's 2021 ratings compare to other communities’ ratings from the past five years. 1 54
Methods
Selecting survey recipients
All households within the City of American Canyon were eligible to participate in the survey. A list of all households within the zip codes serving American Canyon was purchased from Go-Dog Direct based on updated listings from the United States Postal Service. Since some of the zip codes that serve the City of American Canyon households may also serve addresses that lie outside of the community, the exact geographic location of each housing unit was compared to community boundaries using the most current municipal boundary file. Addresses located outside of the City of American Canyon boundaries were removed from the list of potential households to survey. From that list, addresses were randomly selected as survey recipients, with multi-family housing units (defined as those with a unit number) sampled at a rate of 53 compared to single family housing units.
An individual within each household was selected using the birthday method. The birthday method selects a person within the household by asking the “person whose birthday has most recently passed” to complete the questionnaire. The underlying assumption in this method is that day of birth has no relationship to the way people respond to surveys. This instruction was contained in the introduction of the survey.
Conducting the survey
The 2,700 randomly selected households received mailings beginning on February 7th, 2022 and the survey remained open for seven weeks. For 1,200 households, the first mailing was a postcard inviting the household to participate in the survey. The next mailing contained a cover letter with instructions, the survey questionnaire, and a postage-paid return envelope. The final mailing contained a reminder letter, another survey, and a postage-paid return envelope. For the remaining 1,500 households, the first mailing was a postcard inviting the household to participate, followed one week later by a reminder postcard. All mailings included a web link to give residents the opportunity to respond to the survey online. All follow-up mailings asked those who had not completed the survey to do so and those who had already done so to refrain from completing the survey again.
The survey was available in English, Spanish, and Tagalog. All mailings contained paragraphs in all languages instructing participants on how to complete the survey in their preferred language.
About 1% of the 2,700 mailed invitations or surveys were returned because the household address was vacant or the postal service was unable to deliver the survey as addressed. Of the remaining 2,668 households that received the invitations to participate, 335 completed the survey, providing an overall response rate of 13%. The response rate was calculated using AAPOR’s response rate #2* for mailed surveys of unnamed persons.
It is customary to describe the precision of estimates made from surveys by a “level of confidence” and accompanying “confidence interval” (or margin of error). A traditional level of confidence, and the one used here, is 95%. The 95% confidence interval can be any size and quantifies the sampling error or imprecision of the survey results because some residents’ opinions are relied on to estimate all residents’ opinions. The margin of error for the City of American Canyon survey is no greater than plus or minus 5 percentage points around any given percent reported for all respondents (335 completed surveys).
In addition to the randomly selected “probability sample” of households, a link to an online open participation survey was publicized by the City of American Canyon. The open participation survey was identical to the probability sample survey with one small update; it included a question about where they heard about the survey. The open participation survey was open to all city residents and became available on March 7th, 2022. The survey remained open for three weeks. The data presented in the following tabs exclude the open participation survey data, but a tab at the end provides the complete frequency of responses to questions by the open participation respondents.

Analyzing the data
Responses from mailed surveys were entered into an electronic dataset using a “key and verify” method, where all responses are entered twice and compared to each other. Any discrepancies were resolved in comparison to the original survey form. Range checks as well as other forms of quality control were also performed. Responses from surveys completed on Polco were downloaded and merged with the mailed survey responses.
The demographics of the survey respondents were compared to those found in the 2010 Census and 2019 American Community Survey estimates for adults in the City of American Canyon. The primary objective of weighting survey data is to make the survey respondents reflective of the larger population of the community. The characteristics used for weighting were age, sex, race, Hispanic origin, housing type, and housing tenure. No adjustments were made for design effects. Weights were calculated using an iterative, multiplicative raking model known as the ANES Weighting Algorithm.* The results of the weighting scheme for the probability sample are presented in the following table.
NRC aligns demographic labels with those used by the U.S. Census for reporting purposes, when possible. Some categories (e.g., age, race/Hispanic origin, housing type, and length of residency) are combined into smaller subgroups. .
3 56
The survey datasets were analyzed using all or some of a combination of the Statistical Package for the Social Sciences (SPSS), R, Python, and Tableau. For the most part, the percentages presented in the reports represent the “percent positive.” The percent positive is the combination of the top two most positive response options (i.e., excellent/good, very safe/somewhat safe, essential/very important, etc.), or, in the case of resident behaviors/participation, the percent positive represents the proportion of respondents indicating “yes” or participating in an activity at least once a month.
On many of the questions in the survey respondents may answer “don’t know.” The proportion of respondents giving this reply is shown in the full set of responses included in the tab “Complete data”. However, these responses have been removed from the analyses presented in the reports. In other words, the tables and graphs display the responses from respondents who had an opinion about a specific item.

Balancing performance and importance
Every jurisdiction must balance limited resources while meeting resident needs and striving to optimize community livability. To this end, it is helpful to know what aspects of the community are most important to residents and which they perceive as being of higher or lower quality. It is especially helpful to know when a facet of livability is considered of high importance but rated as lower quality, as this should be a top priority to address.
To help guide City staff and officials with decisions on future resource allocation, resident ratings of the importance of services were compared to their ratings of the quality of these services. To identify the services perceived by residents to have relatively lower quality at the same time as relatively higher importance, all services were ranked from highest perceived quality to lowest perceived quality and from highest perceived importance to lowest perceived importance. Some services were in the top half of both lists (higher quality and higher importance); some were in the top half of one list but the bottom half of the other (higher quality and lower importance or lower quality and higher importance); and some services were in the bottom half of both lists.
Services receiving quality ratings of excellent or good by 64% or more of respondents were considered of “higher quality” and those with ratings lower than 64% were considered to be of “lower quality.” Services were classified as “more important” if they were rated as essential or very important by 84% or more of respondents. Services were rated as “less important” if they received a rating of less than 84%. This classification uses the median ratings for quality and importance to divide the services in half.
The quadrants in the figure below show which community facets were given higher or lower importance ratings (right-left) and which had higher or lower quality ratings (up-down). Facets of livability falling closer to a diagonal line from the lower left to the upper right are those where performance ratings are more commensurate with resident priorities. Facets scoring closest to the lower right hand corner of the matrix ( higher in importance and lower in quality) are those that may warrant further investigation to see if changes to their delivery are necessary to improve their performance. This is the key part of this chart on which to focus. Facets falling in the top left hand corner of the chart (lower in importance but higher in quality) are areas where performance may outscore resident priorities, and may be a consideration for lower resource allocation.

This dashboard contains a complete set of responses to each question on the survey. By default, "Don't know" responses are excluded, but may be added to the table using the response filter to the right. When a table for a question that only permitted a single response does not total to exactly 100%, it is due to the common practice of percentages being rounded to the nearest whole number. 39 92

Methods (open participation)
As part of its participation in The National Community Survey™ (The NCS™), the City of American Canyon conducted a survey of 335 residents. Survey invitations were mailed to randomly selected households and data were collected from February 7th, 2022 to March 28th, 2022. The results from this main survey effort represent the most robust estimate of your residents’ opinions.
After the above data collection period was underway, a link to an online open participation survey was publicized by the City of American Canyon. The open participation survey was identical to the probability sample survey with one small update; it included a question about where they heard about the survey. The open participation survey was open to all city residents and became available on March 7th, 2022. The survey remained open for three weeks and there were 229 responses.
The open participation survey data were not collected through a random sample and it is unknown who in the community was aware of the survey; therefore, a level of confidence in the representativeness of the sample cannot be estimated. However, to reduce bias where possible, these data were statistically weighted to match the demographic characteristics of the 2010 Census and 2019 American Community Survey estimates for adults in the City of American Canyon. The characteristics used for weighting were age, sex, race, Hispanic origin, housing type, and housing tenure. No adjustments were made for design effects.
Weights were calculated using an iterative, multiplicative raking model known as the ANES Weighting Algorithm.* The results of the weighting scheme for the open participation survey are presented in the following table. * Pasek, J. (2010). ANES Weighting Algorithm. Retrieved from https://web.stanford.edu/group/iriss/cgi-bin/anesrake/resources/RakingDescription.pdf Unweighted Weighted Target*

Open participation survey results
This dashboard contains a complete set of responses to each question on the open participation survey. By default, "don't know" responses are excluded, but may be added to the table using the response filter to the right. When a table for a question that only permitted a single response does not total to exactly 100%, it is due to the common practice of percentages being rounded to the nearest whole number. 70 123

Dear City of American Canyon
Resident:
Please help us shape the future of
American Canyon! You have been
selected at random to participate in
the 2022 American Canyon
Community Survey. If you have
already completed the survey
online, thank you. Please do not
respond twice.
Please take a few minutes to fill out
the enclosed survey. Your
participation in this survey is very
important – especially since your
household is one of only a small
number of households being
surveyed. Your feedback will help
American Canyon make decisions that
affect our City.
A few things to remember:
• Your responses are confidential
and no identifying information
will be shared.
• In order to hear from a diverse
group of residents, the adult 18
years or older in your household
who most recently had a birthday
should complete this survey.
• You may return the survey by
mail in the enclosed postagepaid envelope, or you can
complete the survey online at:
https://polco.us/placeholder
Please do not share your survey
link. This survey is for randomly
selected households only. The City
will conduct a separate survey that is
open to all residents just a few weeks
from now.
If you have any questions about the
survey please call 707-647-5355.
Thank you for your time and

BACKGROUND & ANALYSIS
On April 7, 2022, American Canyon resident Richard Peterson submiDed a "no0ce of inten0on" to circulate a pe00on for an ordinance ini0a0ve en0tled "Add 157 Acres Owned by Green Island Property, LLC to the City of American Canyon Urban Limit Line and Amend the General Plan to Expand Poten"al City Industrial Development" (ADachment 4). ThereaEer, the City ADorney prepared and provided an official "ballot 0tle and summary" for the proposed ini0a0ve for use by the proponents for publication and circulation of the petition (Attachment 5).
Ballot Title and Summary
The proposed ordinance would include 157 acres of undeveloped land in unincorporated Napa County owned by Green Island Property, LLC (“Property”) into the City of American Canyon (“City”) 2008 Urban Limit Line (“ULL”). Inclusion of the Property into the City ULL is a step necessary for the 153
Napa County Local Agency Forma0on Commission (“Napa LAFCO”) to consider an amendment to the City Sphere of Influence (SOI) and annexa0on of the Property into the City. The Property is unsuited for its originally planned purpose of a vineyard due to naturally occurring saltwater intrusion from coastal waters.
This ini0a0ve ordinance would also amend the City General Plan to be consistent with the ULL amendment and would expand the amount of poten0al industrial development within the ULL by 6,845,454 gross square feet, and also within the City limits if LAFCO annexes the Property into the City. The ini0a0ve ordinance General Plan amendment also provides amended policies direc0ng the City to work with the County and LAFCO towards modifying the City's Sphere of Influence to include areas within the City's Urban Limit Line, a necessary precursor for poten0al annexa0on of the Property into the City.
This ini0a0ve ordinance would be become effec0ve January 1, 2023 if approved, and could only be amended to further its purposes by a 4/5 vote of the City Council aEer its effec0ve date. The amended ULL may only be amended by the voters.
Certification
On June 27, 2022, proponents filed the pe00on with City Clerk. Following a review by the City Clerk and City ADorney, the pe00on was delivered to the Napa County Registrar of Voters for signature verifica0on. On July 13, 2022, the Napa County Registrar of Voters returned a Cer0ficate of Sufficiency. Staff recommends the Council accept the Registrar's cer0fica0on as to the sufficiency of the initiative petition. (Attachment 2)
Next Steps
The Council has two op0ons: 1) Adopt the Ordinance; or 2) Allow the voters to decide whether to adopt the Ordinance. Staff recommends Option 2.
To implement staff's recommenda0on, the Council must place a ques0on on the ballot for November 8, 2022 General Election. The question (Measure "J") would read:
______________________________________________________________________________________________ "Shall the measure to add 157 acres owned by Green Island Property, LLC to the City of American Canyon Urban Limit Line and amend the General Plan to expand poten#al city industrial development be adopted? "
YES
NO
______________________________________________________________________________________________ To place the foregoing ques0on on the November 8 General Elec0on Ballot, the Council must request the Register of Voters consolidate this maDer with the other elec0on related items - namely 154
the City Council Municipal Elec0ons. Staff recommends the Council adopt the Resolu0on as shown in Attachment 3.
ThereaEer, Primary and RebuDal Arguments may be filed in favor and against. The Primary Argument filing period opens at 8:30 a.m. on Friday, July 29, 2022, and closes at 5:00 p.m. on Wednesday, August 10, 2022. The RebuDal Argument filing period opens at 8:30 a.m. on Thursday, August 11, 2022, and closes at 5:00 p.m. on Monday, August 22, 2022. (EC 9285) Consistent with Elec0ons Code Sec0on 9280, the City ADorney is directed to prepare an impar0al analysis of Measure J.
COUNCIL PRIORITY PROGRAMS AND PROJECTS
Organizational Effectiveness: "Deliver exemplary government services."
FISCAL IMPACT
The cost of a consolidated elec0on is split between the number of en00es on the ballot, number of posi0ons, and number of ballot measures. There is $50,000 currently budgeted in 100-10-130-42160 for FY2022-23, however the addi0on of Measure J requires an es0mated addi0onal $50,000 for a total of $100,000, for the City’s November 8, 2022, General Elec0on based on an es0mate provided by the Napa County Clerk Recorder.

YES
NO
Section 2. The proposed measure title and summary is as follows:
An Initiative Ordinance to Add 157 Acres Owned by Green Island Property, LLC to the City of American Canyon Urban Limit Line and Amend the American Canyon General Plan to Expand Potential City Industrial Development
This initiative proposes an ordinance that would include 157 acres of undeveloped land in unincorporated Napa County owned by Green Island Property, LLC (“Property”) into the City of American Canyon (“City”) 2008 Urban Limit Line (“ULL”). Inclusion of the Property into the City ULL is a step necessary for the County Local Agency Formation Commission (“LAFCO”) to consider an amendment to the City Sphere of Influence and annexation of the Property into the City. The Property is unsuited for its originally planned purpose of a vineyard due to naturally occurring saltwater intrusion from coastal waters.
This initiative ordinance would also amend the City General Plan to be consistent with the ULL amendment and would expand the amount of potential industrial development within the ULL by 161
6,845,454 gross square feet, and also within the City limits if LAFCO annexes the Property into the City.
The initiative ordinance General Plan amendment also provides amended policies directing the City to work with the County and LAFCO towards modifying the City's Sphere of Influence to include areas within the City's Urban Limit Line, a necessary precursor for potential annexation of the Property into the City.
This initiative ordinance would be become effective January 1, 2023, if approved, and could only be amended to further its purposes by a 4/5 vote of the City Council after its effective date. The amended ULL may only be amended by the voters.

ULL amendment Ballot title and summary
(269 Words)
This initiative ordinance would also amend the City General Plan to be consistent with the ULL amendment and would expand the amount of potential industrial development within the ULL by 6,845,454 gross square feet, and also within the City limits if LAFCO annexes the Property into the City.
The initiative ordinance General Plan amendment also provides amended policies directing the City to work with the County and LAFCO towards modifying the City's Sphere of Influence to include areas within the City's Urban Limit Line, a necessary precursor for potential annexation of the Property into the City.
This initiative ordinance would be become effective January 1, 2023 if approved, and could only be amended to further its purposes by a 4/5 vote of the City Council after its effective date. The amended ULL may only be amended by the voters.

Water Supply and Demand Update, Enhanced Customer Portal Presentation
RECOMMENDATION
Receive and file a report on water supply and demand in the City of American Canyon Water Service Area.

BACKGROUND & ANALYSIS
Due to the limited rain throughout California this past winter, the April 1st 2022 snow pack was just 68% in the Sierras (which is the source of the City’s water supply). Addi<onally, the State of California Water Watch reported on June 1, 2022 reservoir storage level is es<mated 70% of historical average in the reservoirs. California is experiencing three consecu<ve dry years 2020, 2021 and 2022. Drought condi<ons state-wide con<nue to persist. With the combina<on of warmer than average temperatures and minimal precipita<on experienced in the state, the Department of Water Resources (DWR) indicates that 2021 was the fourth driest year on record statewide.
Demand Patterns
Current data reflects total potable water consump<on has reduced by roughly 8% for the City of American Canyon Year to Date 2022 as compared to Year 2021. This includes total water consumed from all classes including Residen<al, Commercial, City and other. Current data reflects during June 2022 (AAachment 1) roughly 1% reduc<on compared to June 2021 (AAachment 2), Residen<al total potable reduc<on 3%, City total potable reduc<on 23%, Commercial 0% reduc<on, data indicates temporary water meter connec<ons for construc<on & Private Fire Protec<on Services Meters (Classified as "Other") consumed 5 Acre Feet more this June 2022 compared to June 2021. The trends overall remain similar to Year 2021 when the total potable water reduc<on was 14% overall (AAachment 3). The City Maintenance & U<li<es Department uses Advanced Metering Infrastructure (AMI) and sounding leak equipment to find and repair leaks, 26 leaks have been repaired this Year 2022. The City also uses AMI for "My Water Usage Portal" allowing customers to view their own water usage. The City has enhanced the customer portal which now allows customer to view bill and pay bill, track and compare your usage to yourself and others, track your flow by 195
hour, day, calendar month or by u<lity billing cycle. Customers can also view in units, gallons or dollars. Data will indicate a water reduc<on or an increase in consump<on. The My Water Usage Portal also provides several water conserva<on links and is supported via mobile app allowing customers to have no<fica<ons and insight at their finger <ps. The My Water Portal provides City dashboard messages, "health and human safety use" (HHS) State standard of 55 gallons per person per day calculator, custom self goal consump<on seHngs, several addi<onal alert no<fica<ons with enable and disable capabili<es. The Maintenance & U<li<es Department con<nues to seek solu<ons that are impacIul and innova<ve for the community and environment such our zero foot print, recycled water program, customer portal, rebate program and community out reach.
In response to the extraordinary situa<on, DWR delivered only 5 percent of requested State Water Project (SWP) supplies in Year 2021. As a result, the City received just 260 acre-feet (AF) of our 5,200 AF “Table A” entitlements.
In 2022, American Canyon will receive just 15% of its Table A en<tlement from the SWP (780 AF).
The City will u<lize another 500 AF of “Emergency Vallejo Permit Water” and is pursuing addi<onal supplies from various statewide transfer programs.
It’s worth no<ng customer demand in 2020 (2,884 AF) and 2021 (2,795 AF) was nearly iden<cal to demands in 2015 (2,890 AF) - the last year of the prior state-wide drought. Assuming no reduc<on in demand this year 2022 compared to 2021, the City is facing a deficit of approximately 470 AF in 2022.
Regular Water Supply
780 AF Table A
896 AF Advance Table A
500 AF Vallejo Permit
176 AF Article 21
300 AF Vallejo Treated Water
2,325 AF Subtotal
Additional Water Supply
500 AF Vallejo Emergency Permit
0 AF Dry Year Transfer Program
224 AF Yuba Accord
Historical water demand since 2018 has ranged from 2,603 AFY to 2,890 ADFY as shown below:
2018 2,720 AF
2019 2,603 AF
2020 2,884 AF
2021 2,795 AF
196
Currently the City has consumed an es<mated 1084 AF from it's water sources year to date 2022, nearly a 8% reduc<on compared to 2021. The amount of addi<onal supplies iden<fied to be available matches the an<cipate deficit, but with liAle margin for error and no supplies to be carried over into 2022. Although other supply programs may be available, reducing customer demand is the key strategy for 2022.
Current Drought Emergency
California is experiencing nearly it's sixth serve drought in 100 years, CalmaAers.org reported the current drought is over 840 days of drought condi<ons for the State of California. On March 28, 2022, California's Governor Newsom signed updates to the Statewide (all Coun<es) Drought Emergency Execu<ve Order N-7-22. (AAachment 9). In July 2021, Governor Newsom called on Californians to voluntarily reduce their water use by 15%. At the end of March 2022 aOer the state failed to meet its 15% goal, the Governor issued an Execu<ve Order calling on local water agencies to escalate their response to the ongoing drought. On March 28, 2022, Governor Newsom directed the State Water Board to consider adop<ng an emergency regula<on for urban water conservation.
State of California Update
On May 24, 2022, the State Water Board adopted an emergency regula<on. The emergency regula<on is expected to take effect on or around June 10, 2022. It will remain in effect for one year from the effective date, unless the State Water Board acts to end, modify, or readopt it.
History
On July 20, 2021, City Council declared a Stage 2 Drought Emergency and called for a 20% reduc<on in water use by all customers. Unfortunately, demand did not achieve the desired outcome.
Although residen<al customers achieved a 12% reduc<on and commercial customers achieved a 13% reduc<on the City did not achieve it’s demand Year 2021 compare to its Year 2020, 20% reduction goal. The Stage 2 Emergency remains in effect.
Call to Action
Simply put, the trend is not decreasing enough and further ac<on is needed. All customers (residen<al, commercial/industrial, and governmental) are subject to the same request for a 20% reduc<on in use. Generally, a 10-20% reduc<on can be achieved by implemen<ng one or more of the following best practices:
No more than 2 days per week for irriga<ng landscaping - especially turf lawns - and do so only during the late evening and early morning hours (between 6:00 p.m. to 6:00 a.m.).
Inspect all irrigation systems, repair leaks, and adjust spray heads to eliminate avoidable overspray.
No more than 2 minutes of run-<me for each irriga<on cycle. If water begins to run-off to gutters or sidewalks, then recue the cycle time or water by hand.
Replace thirsty, non-native turf with native, drought tolerant landscaping.
Replace all old high-flow toilets.
197
U<lize water conserva<on incen<ve and rebate programs to replace plumbing fixtures and appliances with water efficient models.
Limit the dura<on of showers to 5 minutes or less, turning off the faucet when brushing teeth and flushing toilets only when necessary each day.
Categories of Use
It is important to dis<nguish a hierarchy of types of water use. Categories such as "health and safety", "commercial/economic" and "decorative" are applicable.
Examples of "health and human safety use" (HHS) would be for drinking, cooking, and bathing - its worth no<ng the State has set a standard of 55 gallons per person per day for this purpose. For American Canyon (popula<on 21,800), that would equate to approximately 1,300 AF per year. The remaining demand is either commercial/economic or decorative.
Examples of "commercial/economic use" (CII) would be businesses - par<cularly those who u<lize water in their produc<on. Economic/commercial water serves a purpose by contribu<ng employment and economic activity to the community.
Examples of "decora<ve use" would be outdoor landscaping, fountains, swimming pools, etc.
Decorative use is water that does not fit the other categories.
In general, HHS uses are the priority followed by CII uses, and then decora<ve uses. At this <me, a drastic reduction/elimination of decorative uses is needed.
Of note, irriga<on of turf is the single largest decora<ve use that is being targeted for elimina<on, the City offers recycled water for these purposes.
Moreover, there is a dis<nc<on between decora<ve use of water for commercial/industrial proper<es vs. residen<al proper<es. Namely, the former contributes only a minuscule amount to the value of the business enterprise whereas the laAer can play a larger in determining "curb appeal" and can bear a rela<onship to salability. In short, the call for ac<on for the business community to eliminate all outdoor turf potable irriga<on while the call for ac<on for residents to reduce outdoor turf irrigation and otherwise mindfully use water.
However, staff recommends delaying the implementa<on of certain provisions of ACMC Sec<on
13.14 – namely enforcement of mandatory 20% reduc<ons and Drought Surcharges – un<l a future date. The primary reason is that staff believes it will be more effec<ve to work coopera<vely with our customers to reduce demands rather than to implement puni<ve measure such as fines and surcharges. Furthermore, there are prac<cal and logis<cal u<lity billing challenges that must be overcome before the surcharges can be implemented appropriately. 198
For the remainder of 2022, a 20% reduc<on compared to 2020 demand is needed to counteract the underwhelming response and allocations provided by DWR.
Implemen<ng these prac<ces now will hopefully forestall puni<ve measure and subsequent stages manda<ng reduc<ons, including Stage 3 - 30% reduc<on (mandatory), and Stage 4 reduc<on - 50% (mandatory).
Addi<onally, the Drought Strike Team con<nues to iden<fy City facili<es where consump<on may be reduced. For example, conver<ng Community Parks I & II to recycled water for irriga<on is a top priority for this summer. The Team is generally focused on opera<ons (both potable and recycled water supply), facili<es (parks and buildings), enforcement and public outreach including the recycled water deliveries and fill sta<ons. In addi<on to updates to the City’s website and the City Manager’s recent email updates, ongoing outreach activities include inserts in monthly utility bills.
Although prior Council ac<on provides the Mayor and City Manager authority to carry out transac<ons to procure addi<onal supplies, reducing customer demand is a key strategy for 2022.
Such ac<on is consistent with Governor Newsome's May 10, 2021 Declara<on of Drought Emergency for Napa County (and elsewhere).
COUNCIL PRIORITY PROGRAMS AND PROJECTS
Infrastructure: "Develop and maintain infrastructure resources to support sustainable growth."
FISCAL IMPACT
The Water Fund FY21-22 Budget has sufficient funds to withstand a short-term increase in cost to acquire addi<onal supplies while experiencing a decrease in revenue due to reduced sales.
Impending purchases include Dry-Year Transfer Program, Yuba Accord Water, and Vallejo Emergency Permit Water.
ENVIRONMENTAL REVIEW
Providing the Water Demand and Supply Report is not a "project" under the California Environmental Quality Act ("CEQA"). Further, the item is categorically exempt from CEQA review as an ac<on by an agency for the protec<on of natural resources (pursuant to CEQA Guidelines sec<on 15307) and for the protection of the environment (pursuant to CEQA Guidelines section 15308).

Event Title:* Climate Action Committee (& AmCan Ad Hoc Committee) Event Report: The Countywide Climate Action Committee met and agreed to support a regional Climate Action Plan. This would save on consultant costs (vs. 6 separate plans) and improve the coordination of efforts. It should not deter any jurisdiction from pursuing "low hanging fruit"--projects that could reduce our GHG emissions while simultaneously developing a comprehensive plan. For example, this shouldn't slow down efforts to install EV Chargers, or encourage more battery backups.
The other topic was the status of the Regeneration Napa County (aka, Napa County Climate Challenge), in which most of the members supported contributing to the $9000 annual subscription fee (our share would be around $1200/year). This is an exciting program that lets people assess their carbon footprint, as well as give them insights in ways to reduce that footprint. It also has a gamification element, in which teams can be developed and some healthy competition can be encouraged to create a bigger impact.
The City's ad hoc committee also met and heard from our local Natural Resources Conservation District about tree policies and contact info regarding other carbon sequestration efforts. We also finalized the draft interim report, which is due to Council on August 1. We are going to meet with Brent Cooper to review the several areas that his shop would oversee (changes to zoning ordinance; permitting and licensing, etc.) File/Photo Upload Max file size for all uploads is 10 MB Event

Event Title:* Napa Valley Transportation Authority (NVTA) Event Report: As the new Vice-Chair, I was part of the agenda-setting process. We reviewed the upcoming agenda (July 20)-- nothing too eventful, other than we are trying to secure funding for the environmental review of our SR29 Corridor project (overall EIR will be around $4 million).
We also scheduled a zoom "meet and greet" with NVTA staff. This is something NVTA staff asked for, but it seems like a great idea. It's planned for June 27. In-person would probably be better, but apparently, Covid has forced most of the employees to work from home.

Event Report: During the pandemic, this group met to work through some of the logistical and administrative challenges getting 209
rental relief to renters and landlords. Most of those covid-related protections are gone, but Mayor Ellsworth from St. Helena requested to bring back the group and address ongoing rental issues, including affordable housing and homelessness. We met twice to date. Right now we are in a learning mode, but we talked about trying to organize a large stakeholders group to discuss the issues and more importantly, to focus on solutions.

Event Report: Soscol Junction Groundbreaking: Groundbreaking finally started on this project, which will reduce the biggest bottleneck in the South County. Construction is expected to take 2+ years, but it is fully funded and we actually saved a couple million on the bid!
Transfer of Command--Fire District: This rather formal transfer of command drew a lot of Fire officials from Napa and the North Bay area. It was very exciting, not only because this transfer doesn't always occur so officially, but also to see Mike Cahill in casual dress!! Looking forward to Chief Baylea's time in office.
Achievement Award from Emily Bit and Alisa Karesh: These two High School graduates received the recognition they deserved and most of the CAC members were there to wish them well (as well as NVUSD Trustees). Jim Wilson MC'ed the event. They are both going to Berkeley, with degrees relating to sustainability.
Met with the Cat People: Met with three representatives of this group, and talked about the upcoming workshop. We talked about the need to focus on solutions, and to encourage as many stakeholders as possible to attend. We also acknowledged that staffing shortages could be a bigger stumbling block than just finding the funds (which will also be a challenge!) We talked about ways in which the group could raise money on their own.
Met with Scott Thomason: He was concerned about the Green Island Vineyard initiative, particularly relating to the claims that were being made about the measure. We talked about how the City is not responsible for the signature-gatherers, and that there could be a number of conditions that could be applied to protect open space and viewsheds. We talked about how this could be part of a bigger picture relating to our Urban Limit Line in general. I also met with Mayor Garcia about this topic.

Event Title:* Community Events and Activities
Event Report: Juneteenth: Our inaugural event went very well--no incidents during the event and we had a good turnout. The other good news: we only used $8500 of the $25,000 the City contributed to the event. We can either refund the dollar amount or keep it as seed money for next year. The Arts Foundation discussed the matter and we're willing to go either way. Congratulations to Brenda Knight for doing an outstanding job.
Pride Day/Key Club Sendoff: These two events were at the same time, and both weren't where they were originally scheduled. I was able to find the Key Club group and visited with our graduating Key Club Seniors. I didn't find out where the Pride Group was meeting, so I missed that one. Hopefully next year! ACAF: The Board met on the 12th and reviewed all the activities we have going on! We're very busy. We'll be at Meet Me in the Street on July 13, providing most of the entertainment. We received a grant from the Arts Council Napa Valley for a Latin Celebration Day! So the band, mariachis and a local dance troupe will be on site for the event. Come out and enjoy! We are also promoting our monthly Friday Nights at the Plaza--the next one is Friday, August 5. We're also working on our annual Pumpkin Path event, and planning a new ACHS Art & Music event (also grant funded). Lastly, we received a grant from the County which will help fund a Filipino Cultural program later this year.
Field Day (Ham Operators): I received a tour of the various ham operator tents at Silver Oak Park. It is amazing how these operators can function even when major communication systems are down. They rely 210
on airwaves and solar power. They also try to reach people as far away as possible, sometimes on different continents!
Fourth of July: This was a big event again. Starting the parade at 3 seemed to go well--the crowds were just as big along the road way. Starting later also creates the opportunity for our State and National leaders to show up--thank you, State Senator Bill Dodd! The rest of the event was a shift to a more traditional concert with food vendors and fireworks. There must have been 3-5,000 people in Comm Park II and along Wetlands Edge Road. So, it was clearly a successful event. Good Job!! Napa County Democratic Central Committee: Discussed the upcoming mid-term elections and also got into a spirited discussion about regional housing needs! The points made were: we need to have housing closer to where the jobs are; and a lot of the land where the jobs are, are either high fire-risks or Ag Preserve. The County seems to focus more on how to handle their housing numbers (by contracting out to Napa City or American Canyon), rather than recognize the dysfunctionality of separating housing from work sites.
