CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: APRIL 12, 2022
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: REIMBURSEMENT AGREEMENT WITH UNION PACIFIC

RAILROAD COMPANY FOR PRELIMINARY ENGINEERING

SERVICES FOR THE EXISTING CROSSING LOCATED ON

LINCOLN AVENUE BETWEEN LOARA STREET AND

MANCHESTER AVENUE
ATTACHMENT (Y/N): YES ITEM # 17
RECOMMENDATION:

That the City Council, by Motion, approve the Reimbursement Agreement with Union Pacific Railroad Company (UPRR) for preliminary engineering services for the existing crossing on Lincoln Avenue between Loara Street and Manchester Avenue, authorize the Mayor and City Clerk to execute the agreement, and authorize the total payment of up to $65,000.

DISCUSSION:

Anaheim Multifamily, LLC is the owner and developer of the proposed residential subdivision located at 1600 West Lincoln Avenue. This property was previously the site of Mills Ford.

The development project was approved by the City Council on June 9, 2020 in conjunction with General Plan Amendment No. 2018-00523; Reclassification No. 2018-00316; Conditional Use Permit No. 2018-05979; and Development Agreement No 2019-00001, to allow for the development of the proposed four story mixed-use development consisting of 315 residential units (apartments), 2,031 square foot leasing office, 3,413 square foot commercial spaces, and a parking structure.

The public improvements include curb widening, sidewalk relocation, parkway construction, and landscaping improvements along the frontage of Lincoln Avenue and Loara Street. These improvements are consistent with the City of Anaheim General Plan and the conditions of approval, and will continue to enhance the city's infrastructure and circulation in the project area.

As part of the development’s Mitigation Measures, Mitigation Measure TRAF-1 requires the project to extend the westbound left-turn storage length at Lincoln Avenue and Loara Street an additional 45 feet (providing 105 feet total storage).

A reimbursement agreement between the City and UPRR is required for the review of engineering plans by UPRR. Once the engineering plans are approved, a Construction and Maintenance Agreement will be required for the construction and ongoing maintenance of the Project.

IMPACT ON BUDGET:

The developer will deposit $65,000 into a Public Works Developer Trust Account to fund the Union Pacific Railroad Company invoices related to the project.

Respectfully submitted,
