CITY COUNCIL AGENDA REPORT
City of Anaheim

PUBLIC UTILITIES DEPARTMENT
DATE: APRIL 12, 2022
FROM: PUBLIC UTILITIES DEPARTMENT

SUBJECT: APPROVAL OF LICENSE AGREEMENT WITH ORANGE

COUNTY WATER DISTRICT FOR NEW PIPELINES AT

ANAHEIM LAKE
ATTACHMENT (Y/N): YES ITEM # 14
RECOMMENDATION:

That the City Council, by Motion:

1. Approve a License Agreement (Agreement) with Orange County Water District (OCWD) to construct and operate, among others, new pipelines on OCWD- owned property at Anaheim Lake for an initial 20-year term and additional 10 year renewals and a one-time license fee in the amount of $1,148; and

2. Authorize the Public Utilities General Manager, on behalf of the City, to execute the Agreement and any other related documents and take any and all actions as are necessary to implement and administer the Agreement.

DISCUSSION:

Anaheim Public Utilities (APU) operates several groundwater wells on OCWD Property at Anaheim Lake located near the intersection of Tustin Avenue and Miraloma Avenue. APU pipelines connect these wells to APU’s Linda Vista Complex adjacent to Anaheim Lake. An APU project to construct groundwater treatment at the Linda Vista Complex requires a License Agreement to install new pipelines on OCWD’s property. On February 16, 2022, the OCWD Board of Directors approved and authorized execution of the License Agreement (Attachment 1) with APU to construct new pipelines.

The License Agreement provides APU the ability to construct, operate, and maintain the proposed pipelines on OCWD’s property. This Agreement will be for an initial term of 20 years with 10-year automatic renewals and a one-time license fee in the amount of $1,148.

Design for the groundwater treatment project at the Linda Vista Complex is in progress and construction is scheduled to commence in summer 2022.

ENVIRONMENTAL DETERMINATION:

The environmental impacts of the Groundwater Treatment Plant were analyzed under a Mitigated Negative Declaration, which was adopted on April 27, 2021 by the Anaheim City Council in accordance with the California Environmental Quality Act (CEQA) (California Public Resources Code, Section 21000 et seq.) and its Guidelines (California Code of Regulations, Title 14, Section 15000 et seq.) addressing the potential environmental impacts associated with groundwater treatment improvements at La Palma, Linda Vista, Boysen Park, and Energy Field sites. Because the environmental impacts of the plant has been assessed, no further environmental review is necessary.

IMPACT ON BUDGET:

Sufficient funds are included in APU’s Fiscal Year 2021/2022 Water Utility Fund budget.

Respectfully submitted,
Dukku Lee
Public Utilities General Manager
