CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: APRIL 12, 2022
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: AWARD OF CONSTRUCTION CONTRACT FOR
UNDERGROUND DISTRICT NO. 67 SYCAMORE STREET
ATTACHMENT (Y/N): YES ITEM # 09
RECOMMENDATION:

That the City Council, by Motion:

1. Award the contract to the lowest responsible bidder, Asplundh Construction LLC, of Buena Park, California, Contractor’s License No. 1028802 Classifications A and C-10, in the amount of $10,463,595.46 plus a 10% contingency, for the construction of Underground District No. 67 Sycamore Street (Project); and

2. Authorize and direct (1) the Director of Public Works, on behalf of the City, to execute the Contract and any other related documents, and to take such actions as are necessary to implement and administer the Contract; and (2) the Finance Director to execute the Escrow Agreement pertaining to contract retentions.

DISCUSSION:

The Project bids are summarized as follows:

1. Asplundh Construction LLC, Buena Park, CA .............................$10,463,595.46

2. Hampton Tedder Electric Company, Montclair, CA ......................$11,582,662.79

3. Hot Line Construction, Inc., Brentwood, CA..................................$12,003,714.47

4. E.E. Electric, Inc., Jurupa Valley, CA .............................................$12,418,784.55

5. Danella Power Services of CA, Hawthorne, CA.............................Non-Responsive Danella Power Services submitted a lower cost bid of $10,459,308.35; however, they did not meet the State of California license requirements during the bid period, and therefore the bid was deemed non-responsive. Asplundh Construction LLC, as the lowest- responsive bidder, is recommended for the construction award. Asplundh’s bid price reflects the current bidding environment, appears to be reasonable, and is within the available funding. Liquidated damages for this Project are set for $1,000 per calendar day.

This Project is part of the 5-Year Underground Conversion Plan. The work to be undertaken consist of undergrounding 12kV distribution and telecommunication systems, street light installation, service conversions, and removal of overhead facilities on Sycamore Street from Anaheim Boulevard to East Street; and on East Street from Adele Street to Eastwood Drive, including adjoining portions of Claudina Street, Emily Street, Philadelphia Street, Olive Street, Sabina Street, Pauline Street, Vine Street, Bush Street, Rose Street, Flower Street, and Glenwood Avenue.

Award of Construction Contract for the Underground District No. 67 Sycamore Street April 12, 2022

Page 2 of 2 ends

Southern California Edison (SCE) has overhead transmission lines along East Street that will remain in place, as SCE is not obligated to underground at their expense.

Coordinating with the Public Works Department’s planned street improvement project for this area, undergrounding construction will be completed before installation of newly paved streets and sidewalks. The various replacements of utility infrastructure will improve electric service reliability, and will also provide an opportunity to replace the existing lights currently mounted on the utility wood poles with new historic styled street light poles with LEDs. Construction for this Project is scheduled to begin in Summer 2022 with completion expected by end of 2023.

COMMUNITY WORKFORCE AGREEMENT (CWA):

This project is not covered “Project Work” as defined in the CWA the City entered into with the Los Angeles/Orange Counties Building and Construction Trades Council and the Signatory Craft Councils and Local Unions. Project Work covered by the CWA is defined and limited to all construction and major rehabilitation work listed on the “Projects List”.

The Project List (Attachment F to the CWA) as approved by City Council on December 3, 2019 identifies projects in which the CWA shall apply. In determining project application, the CWA Project List was based on the Capital Improvement Program that may be adjusted annually based on City priorities, availability of funding, and other considerations. The intent in the development of the Project List is that larger projects be included due to the additional administrative activities associated with the CWA and minimize the impact of the additional administrative functions and costs for the City and for smaller construction firms.

ENVIRONMENTAL DETERMINATION:

The City Council determined by resolution on September 24, 2019, that pursuant to Sections 15301(b), 15302(c)(d), and 15303(d) of Title 14 of the California Code of Regulations, the Project was categorically exempt from CEQA. The Project consists of relocating existing overhead utility lines to underground, installing minor street apparatuses, and LED street lighting, which does not have the potential to create a significant effect on the environment. The work areas will be restored to pre-project conditions after construction is complete.

IMPACT ON BUDGET:

Sufficient funds are budgeted in Anaheim Public Utilities’ Fiscal Year 2021/22 Electric Capital Improvement Program budget from restricted Electric Utility Enterprise funds.

Respectfully submitted, Concurred by,
Rudy Emami Dukku Lee
Director of Public Works Public Utilities General Manager Attachments:
