CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: APRIL 12, 2022
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: AWARD OF CONTRACT FOR EUCLID STREET IMPROVEMENT

PROJECT FROM CRESCENT AVENUE TO GLENOAKS AVENUE
ATTACHMENT (Y/N): YES ITEM # 10
RECOMMENDATION:

That the City Council, by Motion, award the contract to the lowest responsible bidder, EBS General Engineering, Inc., of Corona, California, and Contractor’s License No. 720016, Classification A, in the amount of $1,570,678 plus a 10% contingency, for the construction of Euclid Street Improvement Project from Crescent Avenue to Glenoaks Avenue; authorize the Director of Public Works, on behalf of the City, to execute the Contract and any other related documents, and to take such actions as are necessary to implement and administer the Contract; and direct and authorize the Finance Director to execute the Escrow Agreement pertaining to contract retentions.

DISCUSSION:

In August 2016, the Department of Public Works submitted a grant application to the California Department of Transportation (Caltrans) under the Cycle 8 Highway Safety Improvement Program (HSIP) for the Euclid Street and Glenoaks Avenue Traffic Signal Modification and Median Islands to Crescent Avenue Project. In November 2016, the City was awarded $1,118,610 in federal grant funds for this Project.

This project will install protected left turn phasing and raised medians with landscaping to increase safety at the intersection and throughout the corridor. In addition to the safety components, this project will also include resurfacing and reconstructing the asphalt concrete pavement within the existing right-of-way, removal and reconstruction of ADA compliant access ramps, driveway approaches, curb and gutter, concrete sidewalk, signing, striping, and other miscellaneous items of work.

The City advertised for bids to construct on January 20, 2022. The bid due date was February 17, 2022. The City received six bids summarized as follows:

1. EBS General Engineering, Inc., Corona ........................$1,570,678.00

2. Sequel Contractors, Inc., Santa Fe Springs ....................$1,647,572.60

3. R.J. Noble Company, Orange ........................................$1,672,065.24

4. All American Asphalt, Corona ......................................$1,732,623.00

5. Excel Paving Co, Long Beach .......................................$1,887,828.00

6. Hardy & Harper, Inc., Lake Forest ................................$1,930,000.00 Award of Contract for Euclid Street Improvement Project from Crescent Avenue to Glenoaks Avenue April 12, 2022

The bid price is within the engineer’s estimate, reflects the current bidding environment, appears to be reasonable, and is within the available funding. Liquidated damages for this project will be $3,750 per day. Construction is scheduled to begin in Summer 2022 and be completed by Fall 2022.

After the bid opening, the City received one bid protest from the second lowest bidder, Sequel Contractors, Inc., related to the designation of sub-contractors submitted by EBS General Engineering, Inc. City staff, in consultation with the City Attorney’s Office, reviewed the bid protest and determined that there is no merit to the claims made in the bid protest, and EBS General Engineering, Inc. remains the lowest responsible bidder.

COMMUNITY WORKFORCE AGREEMENT (CWA):

This project is exempt from the Community Workforce Agreement with the Los Angeles / Orange Counties Building and Construction Trades Council and the Signatory Craft Councils and Local Unions. The federal funding for this project does not allow for local hiring preferences, therefore this project is exempt.

ENVIRONMENTAL DETERMINATION:

City Council determined on October 24, 2017, the Project as Categorically Exempt under the California Environmental Quality Act. Notice of Exemption subsequently filed with the County Clerk on October 25, 2017.

IMPACT ON BUDGET:

Sufficient funds are available in restricted transportation funds in the Public Works Department FY 2021/22 budget.

Respectfully submitted,
Rudy Emami
Public Works Director
