A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM APPROVING THE APPLICATION FOR GRANT
FUNDS FROM THE RECREATIONAL TRAILS PROGRAM
FOR THE NOHL RANCH OPEN SPACE TRAIL PROJECT
FROM SCOUT TRAIL TO ANAHEIM HILLS ROAD AND
AUTHORIZING THE ACCEPTANCE OF SUCH GRANT ON
BEHALF OF THE CITY AND AMENDING THE BUDGET
ACCORDINGLY
WHEREAS, the Fixing America’s Surface Transportation Act (FAST -ACT) provides funds to the State of California (“State”) for Grants to federal, state, local and nonprofit organizations to acquire, develop and/or maintain motorized and nonmotorized trail projects (the “Grant”); and
WHEREAS, the State Department of Parks and Recreation has been delegated the responsibility for the administration of the program within the State, setting up necessary procedures governing project application under the program; and
WHEREAS, said procedures established by the State Department of Parks and Recreation require the Applicant to certify by resolution the approval of application before submission of said application to the State; and
WHEREAS, the Applicant will enter into a contract with the State of California to complete the Nohl Ranch Open Space Trail Project from Scout Trail to Anaheim Hills Road (the “Project”); and
WHEREAS, the City desires to accept any such Grant which may be awarded to the City.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Anaheim does hereby resolve as follows:
1. Approves the filing of an application for the Recreational Trails Program; and
2. Certifies that the Project is consistent with the City’s general plan or the equivalent planning document; and
3. Certifies that City has or will have available prior to commencement of any work on the Project included in this application, sufficient funds to operate and maintain the Project; and
4. Certifies that the City has reviewed, understands, and agrees to the General Provisions contained in the Contract shown in the Procedural Guide; and
5. Appoints the Director of Public Work or Designee as agent to conduct all negotiations, execute and submit all documents, including, but not limited to applications, agreements, amendments, payment requests, which may be necessary for the completion of the Project and acceptance of the Grant; and
6. Agrees to comply with all applicable federal, state and local laws, ordinances, rules, regulations and guidelines; and
7. Contingent upon the acceptance of said Grant, the annual budget of the City of Anaheim is hereby amended by increasing revenue and expenditures in an amount equal to the amount of the Grant funds awarded.
