RECOMMENDATION:
That the City Council, by Motion, approve the Cooperation and Contribution Agreement for Energy and Maintenance of Traffic Signal and Safety Lighting with Toll West Coast LLC (Agreement) for energy and maintenance costs for the traffic signal at Anaheim Boulevard and Cerritos Avenue, with the cost of maintenance paid 75% by the City and 25% by the developer, and authorize the Mayor and City Clerk to execute the Agreement on behalf of the City.
DISCUSSION:
Toll West Coast LLC (Toll West) is the owner and developer of a proposed 292-unit attached, single-family dwelling residential subdivision project (Project) located at the southwest corner of Cerritos Avenue and Anaheim Boulevard, directly east of the I- 5 Freeway and commonly referred to as 100-394 West Cerritos Avenue.
The Project was approved by the City Council with Condition of Approval #47 of CUP2018-05975 and Variance No. 2019-05127 requiring Toll West to enter into an agreement with the City of Anaheim (City) for ongoing operations and maintenance of the traffic signal at the intersection of Anaheim Boulevard and Cerritos Avenue. In addition, Toll West is required to modify the existing traffic signal in accordance with the approved public improvement plans.
Other project public improvements associated with the Project include curb widening, sidewalk relocation, parkway construction, and landscaping improvements along the property frontage of Anaheim Boulevard extending south of Cerritos Avenue. These improvements are consistent with the current City of Anaheim General Plan Amendment and the conditions of approval, and will continue to enhance the City's infrastructure and circulation in the project area.
Energy and maintenance costs include regular monthly maintenance, emergency maintenance, extraordinary maintenance, replacements, and electrical power.
Outlined in the attached agreement are the cost sharing percentages. The developer’s participating share is 25%.

IMPACT ON BUDGET:
Sufficient funds are available in the Public Works FY 2021/22 General Fund budget for traffic signal maintenance. Additionally, developer contributions reduce the City’s cost to maintain this signal.
