CITY COUNCIL AGENDA REPORT
City of Anaheim
DEPARTMENT OF PUBLIC WORKS
DATE: MAY 24, 2022
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: APPROVE LICENSE AGREEMENT WITH ORANGE COUNTY
TRANSPORTATION AUTHORITY (OCTA) FOR THE LA PALMA
AVENUE SANITARY SEWER IMPROVEMENTS FROM EAST
STREET TO PAULINE STREET PROJECT
ATTACHMENT (Y/N): YES ITEM # 12
RECOMMENDATION:
That the City Council, by Motion:
1. Approve the License Agreement with Orange County Transportation Authority (OCTA) for the La Palma Avenue Sanitary Sewer Improvements from East Street to Pauline Street Project (Project) for a one-time fee payment of $500;
2. Authorize the Director of Public Works, or designee, on behalf of the City of Anaheim (City), to execute the License Agreement, and any related documents, and take any and all actions as are necessary to implement and administer the License Agreement; and
3. Authorize de minimis changes that do not substantially change the terms and conditions of the License Agreement, as determined by the City Attorney.
DISCUSSION:
The Department of Public Works has a Sanitary Sewer Improvement Program to address ongoing maintenance and capacity issues in the City’s Central Anaheim area.
Implementation of this program improves the overall performance, reduces maintenance costs, ensures adequate capacity for future development, and maintains reliability of the sewer system. Staff has identified areas of high priority sewer capacity needs based on system deficiencies and operations and maintenance (O&M) issues.
This Project identified the need to construct a new 18-inch diameter sewer line within a 30-inch diameter steel casing underneath the Southern California Regional Rail Authority (SCRRA) railroad tracks within OCTA’s railroad right of way on La Palma Avenue.
The License Agreement will allow the City to construct a portion of the Project on OCTA property with mutually negotiated and acceptable terms and conditions. Staff recommends approval of this License Agreement due to the benefit realized by the City as a result of the implementation of this Project.
Approve License Agreement with Orange County Transportation Authority (OCTA) for the La Palma Avenue Sanitary Sewer Improvements from East Street to Pauline Street Project May 24, 2022
IMPACT ON BUDGET:
Adequate funding is available in the restricted Wastewater Fund as part of the Department of Public Works FY 2021/22 budget.
Respectfully submitted,
Rudy Emami
Director of Public Works
