CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: MAY 24, 2022
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: ANAHEIM RESORT MAINTENANCE DISTRICT ANNUAL

LEVY AND COLLECTION OF ASSESSMENTS
ATTACHMENT (Y/N): YES ITEM # 22
RECOMMENDATION:

That the City Council, by separate Resolutions:

1. Initiate proceedings for the annual levy of assessments in and accept an Assessment Engineer’s Report for the Anaheim Resort Maintenance District (ARMD); and

2. Declare the City of Anaheim’s intention to provide for an annual levy and collection of assessments in the ARMD for Fiscal Year 2022/23, and set a time and place for the public hearing thereon.

DISCUSSION:

The ARMD was formed July 1, 1999, by action of the City Council and based upon a vote to do so by the property owners in the area known as the Anaheim Resort. The property owners in the Anaheim Resort voted to levy an assessment upon themselves to ensure the long-term quality of maintenance, repair and replacement of Anaheim Resort area public improvements, and presentation of festive elements consistent with the operation of a truly unique and outstanding destination area.

The levy and special assessments fund the cost of the annual maintenance within the district and are applied to those parcels that specifically benefit from the enhanced maintenance and improvements. The assessment rates for FY 2022/23 are projected to increase 7.51% in conformance with the allowable increase in the Consumer Price Index, All Urban Consumers, for the Los Angeles-Long Beach-Anaheim Area (CPI), from January through January of the previous calendar year. In an effort to relieve the financial burden on property owners, the City waived any increases during the pandemic. With high inflation and rising maintenance costs, staff is recommending an increase in the FY 22/23 assessment rates of 7.51%, equal to the current year CPI, but below the maximum allowable rate increase of 11.78%.

The attached two resolutions provide the legal mechanism to fund the district for Fiscal Year 2022/23. The first resolution approves, on a preliminary basis, the Assessment Engineer’s Report (which sets the levy by parcel) and initiates the proceedings for next year’s levy. The second resolution declares the City’s intention for this annual levy and sets a public hearing for June 21, 2022 on this issue.
