CITY COUNCIL AGENDA REPORT
City of Anaheim

CONVENTION, SPORTS & ENTERTAINMENT

DEPARTMENT
DATE: MAY 24, 2022
FROM: CONVENTION, SPORTS & ENTERTAINMENT DEPARTMENT
SUBJECT: SECOND AMENDMENT TO THE AGREEMENT BETWEEN

ANAHEIM TRANSPORTATION NETWORK AND THE CITY OF

ANAHEIM FOR SHUTTLE SERVICES FOR ANAHEIM

CONVENTION CENTER ATTENDEES
ATTACHMENT (Y/N): YES ITEM # 15
RECOMMENDATION:

That the City Council, by Motion,

1. Approve the Second Amendment to the Agreement between Anaheim Transportation Network (ATN) and the City of Anaheim (City), granting ATN the right to provide additional public transportation services along the current ATN public route system on an as-needed basis for attendees of events at the Anaheim Convention Center (ACC); increasing the number of optional renewals at the City’s sole option by three, for a total of eight optional one-year renewals bringing the overall term of the Agreement to ten years and increasing the hourly rate payable to ATN by $2.99 per hour for a total of $62.85 per hour for the first additional one-year renewal with a 3% annual increase for each vehicle requested for ACC attendee shuttles; and

2. Authorize the Mayor of the City of Anaheim to execute the Second Amendment and authorize the Executive Director of the Convention, Sports & Entertainment Department to execute any other related documents, including all actions necessary to implement and administer the Agreement.

DISCUSSION:

Pursuant to a non-exclusive franchise granted by the City Council to ATN in 2004, as amended in 2011 and 2019, ATN provides resort transportation shuttle services within the limits of the City of Anaheim, including The Anaheim Resort™, the Platinum Triangle (including the Honda Center, Angel Stadium of Anaheim, and surrounding areas), the downtown area of the City of Anaheim, and such other areas as designated by the City Manager.

Second Amendment between Anaheim Transportation Network and the City of Anaheim May 24, 2022

Page 2 of 2 ends

In 2015, the City entered into an Agreement with ATN for shuttle services for off-site event attendee parking at Angel Stadium of Anaheim, Garden Walk, and Honda Center to support events at the Convention Center, when off-site parking has been deemed critical to the success of the event and on those occasions when shuttle services were required. Based on the ongoing relationship between the City and ATN, the existing contractual Agreement, and the current performance of such shuttle services by ATN for the Convention Center, the Convention Center seeks to extend the agreement with ATN for the provision of shuttle services to off-site parking locations on an as-needed basis for an additional three optional one-year renewals at the City’s sole option, increasing the total optional one-year renewals to eight and bringing the overall term of the Agreement to ten years, and increase the hourly rate payable to ATN by $2.99 per hour for a total of $62.85 per hour, which is all-inclusive of staffing costs, equipment, insurance, fees, taxes, and fuel for the first additional one-year renewal with a 3% annual increase to offset increases in the prices of fuel and labor costs, for each vehicle requested for ACC attendee shuttles. All other terms of the Agreement remain unchanged.

IMPACT ON BUDGET:

Sufficient funds are included in the Convention, Sports & Entertainment Department’s Enterprise Fund budget. Funding for subsequent years will be subject to Council’s approval of budget appropriations.

Respectfully submitted,
Thomas Morton, Executive Director
Convention, Sports & Entertainment Department
