CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: JUNE 7, 2022
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: SUBDIVISION AGREEMENT OF PARCEL MAP NO. 2021-123 ATTACHMENT (Y/N): YES ITEM # 07
RECOMMENDATION:

That the City Council, by Motion, approve the Subdivision Agreement of Parcel Map No. 2021-123 (Agreement) and direct and authorize the Mayor Pro Tem and City Clerk to execute the Agreement.

DISCUSSION:

The Anaheim Housing Authority (“Authority”) is the owner of an approximately 2.35 acre site, consisting of several parcels and located at 1445 S. Anaheim Boulevard. The majority of the project site is vacant and is occasionally used as storage and a one-story office structure is located on the northwest corner of the site.

Anaheim Midway LP, through its managing general partner National Community Renaissance of California (“Developer”), has entered into a comprehensive affordable housing agreement concerning the development and operation of an affordable rental housing project consisting of approximately eighty-six (86) rental units with the Authority.

The Authority desires to establish a one lot subdivision with open space, private drives, and landscaped areas via a parcel map, as required by the Subdivision Map Act. The Parcel Map No. is 2021-123 and contains 2.349 acres (gross area) and 2.277 acres (net area). The engineering for the development project is being provided by C&V Consulting of Irvine, California.

The Tentative Parcel Map was approved by the Planning Commission on June 21, 2021 in conjunction with Miscellaneous Permit No. 2021-00767. The Tentative Parcel Map approval includes an initial expiration date of June 21, 2023. The Parcel Map has been checked and found to be technically correct and substantially the same as it appeared on the Tentative Parcel Map as approved by the Planning Commission.

The proposed development will provide public improvements including driveway apron, curb and gutter, sidewalk, and landscaping improvements along the frontage of Midway Drive and Anaheim Boulevard. These improvements are consistent with the City of Anaheim General Plan and the conditions of approval for the Tentative Parcel Map and will continue to enhance the City infrastructure and circulation in the project area.

As part of the map approval, the Developer is required to enter into a Subdivision Agreement with the City. Approval of the agreement is necessary to ensure that the Developer completes all off-site public improvements to the property and that the work is performed by the Developer at his sole cost. The agreement requires that the Developer provide security for the cost of the improvements to ensure the new homes will have the required infrastructure to service the development, and the Developer has posted these bonds. In the event that the Developer is not able to complete the work due to unforeseen circumstances, the City may utilize the security bond through the surety company to complete the improvements as directed by the City Engineer.

IMPACT ON BUDGET:

There is no budgetary impact.

Respectfully submitted,
