RECOMMENDATION:
That the City Council, by Motion, approve a Third Amendment to the Amended and Restated Agreement between the Savanna School District and the City of Anaheim for Lease of Real Property at Twila Reid Elementary School and a Third Amendment to Amended and Restated Agreement between the Savanna School District and the City of Anaheim for Lease of Real Property at Hansen Elementary School for public park purposes (collectively, the “Agreements”) for an initial one-year term commencing on July 1, 2022 with four additional one-year renewal options; authorize the Director of Community Services or designee, on behalf of the City, to execute the Agreements and any related documents, and to take such actions as are necessary to implement and administer the Agreements; and authorize only those modifications to the Agreements as may be necessary and as approved by the City Attorney’s Office.
DISCUSSION:
The City of Anaheim and the Savanna School District entered into two agreements for use of school district property at Twila Reid Elementary in 1964 and Hansen Elementary in 1967 for City park purposes. Since this time, these properties have served as public park spaces for use by the public for recreational and leisure activities. The City is responsible for the maintenance of the park property, utility expenses, and security monitoring services.
The Twila Reid school property includes approximately six acres of land used for park purposes. The initial term of the agreement began in 1964 as a 25-year lease. This was followed by an Amended and Restated Lease in 1990 for an additional 25 years. In 2015, a First Amendment to the Amended and Restated Lease was in place for one year with five additional one-year optional renewals, which was renewed in 2016. In 2017, the Second Amendment to the Amended and Restated Agreement was renewed for one year with four additional one-year renewals, which will expire under its own terms on June 30, 2022.
Approve Third Amendments to Amended and Restated Lease Agreements Between Savanna School District and the City of Anaheim for Lease of Real Property at Twila Reid School Park and Hansen School Park June 21, 2022
Hansen Park school property used for park purposes sits on approximately 1.6 acres of land. The initial term of the Lease Agreement began in 1967 as 25-year lease followed by an Amended and Restated Lease commencing in 1992, for an additional 25 years. In 2017, the First Amendment to the Amended and Restated Lease for Hansen Park was approved and a Second Amendment in 2017 for one-year term and four additional one- year renewal options that will expire under its own terms on June 30, 2022.
The desire of both parties is to allow the City to continue to use a portion of the school park spaces for park purposes. All other terms of the Agreements will remain the same, including the term, which is one-year with four additional one-year renewal options.
No monetary consideration will be paid to the Savanna School District by the City of Anaheim for park use under the Amendments.
IMPACT ON BUDGET:
Sufficient funding is appropriated in the Community Services department’s General Fund budget for the security, utility, and maintenance expenses associated with the park properties.
