CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: JUNE 21, 2022
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: ANAHEIM RESORT MAINTENANCE DISTRICT ANNUAL

LEVY AND COLLECTION OF ASSESSMENTS
ATTACHMENT (Y/N): YES ITEM # 22
RECOMMENDATION:

That the City Council, following a public hearing, by Resolution, confirm the Diagram and Assessment and provide for the Levy of the Annual Assessment in and for the Anaheim Resort Maintenance District for Fiscal Year 2022/23.

DISCUSSION:

The Anaheim Resort Maintenance District was formed effective July 1, 1999 by action of the City Council based upon a vote to do so by the property owners in the area known as the Anaheim Resort. The property owners in the Anaheim Resort voted to levy an assessment upon themselves to ensure the long-term quality of maintenance, repair, and replacement of the Anaheim Resort area public improvements consistent with the operation of a truly unique and outstanding destination area.

The levy and special assessments fund the cost of the annual maintenance within the district and are applied to those parcels that specifically benefit from the enhanced maintenance and improvements. The assessment rates for FY 2022/23 are projected to increase 7.51% in conformance with the allowable increase in the Consumer Price Index, All Urban Consumers, for the Los Angeles-Long Beach-Anaheim Area (CPI), from January through January of the previous calendar year. In an effort to relieve the financial burden on property owners, the City waived any increases during the pandemic. With high inflation and rising maintenance costs, staff is recommending an increase in the FY 22/23 assessment rates of 7.51%, equal to the current year CPI, but below the maximum allowable rate increase of 11.78%.

On May 24, 2022 (through the adoption of two separate resolutions), Council initiated the proceedings for the FY 2022/23 annual levy of assessments in the Anaheim Resort Maintenance District, accepted the Assessment Engineer’s Report for the Anaheim Resort Maintenance District, and set June 21, 2022 as the date for a public hearing.

The attached resolution confirms the final assessments as contained in the Assessment Engineer’s Report, directs the City Clerk to file a certified copy of the diagram and assessment with the County Auditor-Controller, and authorizes the County Auditor- Controller to enter these assessments onto the County assessment roll. This is a necessary step towards the FY 2022/23 annual funding of the Anaheim Resort Maintenance District.
