SUBJECT: APPROVAL OF A RETIRED ANNUITANT PRIOR TO THE
180- DAY WAITING PERIOD

RECOMMENDATION:
That the City Council, by Resolution, waive the 180-day waiting period, approve the appointment of Maria Munoz, Police Dispatcher II, as a retired annuitant, determine the crucial need of the position, and supersede Resolution No. 2022-051.
DISCUSSION:
Government Code Section 7522.56 specifically requires a retired annuitant appointed prior to the required 180-day wait period be approved by the legislative body on the off- consent calendar of the agenda.
On May 24, 2022, Resolution No. 2022-051 was unanimously approved by the City Council, however inadvertently placed on the consent calendar. As such, to comply with the government code, staff resubmits the recommendation and new resolution for separate action, as detailed in the attached May 24, 2022 staff report, certifying the nature of employment, determining the appointment is necessary to fill a critically needed position, waiving the 180-day waiting period, and superseding Resolution No. 2022-051.
IMPACT ON BUDGET:
Sufficient funds are available in the Police Department’s FY 2022/23 General Fund budget.
