Accordingto RobBonta, CaliforniaAttorneyGeneral, theCityof Anaheimwill berequiredto:

Depositapproximately $96millionintoalocalhousingtrustfundfor thesolepurposeof financingnew extremelylow, verylow, andlow-incomehousingintheCityof Anaheimoverthenextfiveyears; Providethe AttorneyGeneralwithperiodicdetailedreportstracingthosefundsto specificaffordablehousingdevelopment projects, untilthefundsarefullydisbursed; Commitanadditional $27millionin affordablehousingcreditsto theAngelsfor thedevelopmentof upto 466affordablehousingunitsontheAngelStadiumPropertySite; andallowtheAngelsto leveragethe $27millionwithdevelopmentincentivesandpublicfinancingto ensure thetimelydevelopmentof theseunits.

RobBantacalledontheCityCouncilto approvetheproposedjudgment, whichwoulddedicatemorethan $123 millionto fundtheconstructionof affordablehousingonanexpeditedtimelineandcouldresultinmorethan 1,000newaffordablehomes.

Sidhucontinuesto lieto thepublicbystatingthattheCityof Anaheimactedlegally, leadingtheresidentsand publicto believethattheStateAttorneyGeneraliswrongto imposeanyamendmentsto thecity’sbehindclosed doorsnegotiationsandcorruptdealing(s) withtheAngelsBaseballandSRBmanagement.

Theresidents & taxpayersof Anaheim, fundedthecorruptsaleof thestadiumandthecity’s ownedlargest parcelsurroundingthestadium. Now, withthestadiumgiveawayandtheAttorneyGeneral’sproposal, the taxpayersareagainbeingliedto bySidhuwhenhestatesthatSRBwill bepayingtheapproximately $96 millionconsideringthefactthatthe $96millionistaxpayermoneythatwascorruptlygivento SRBinthefirst place.

All of thiscouldandwouldhavebeenavoidedif thecorruptmayorfollowedthelawinaccordancewiththe SurplusLandAct; instead, hiscalculatedcorruption, greed, andineptitudetargetedignoringthelawasevident bythecity’sdefendantpositionvs. PEOPLEOFTHESTATEOFCALIFORNIAandCALIFORNIA DEPARTMENTOFHOUSINGANDCOMMUNITYDEVELOPMENT.

I demandthatthecity’sso-calledmayor (HarrySidhu) immediatelyrecognizewrongdoingandimmediately resign….theresidentsof thecitydeservebetter.

Wethree, WarrenGarten, MarciaGartenandStevenGartenandweallvoteineveryelectionhereinAnaheimsince 2000, arestronglyopposedtothesettlementregardingthesaleoftheAngelStadium, asproposed, betweentheCity of AnaheimandtheStateAttorneyGeneral’sOffice. Asproposed, thesettlementabsolvestheCity’sillegalno-bid saleofourmostvaluableasset; leviesa $100millionfinethatshouldotherwisebeinourgeneralfundforparks, neighborhoodservices, infrastructure, andpublicsafety; andthesettlementfurtherintensifiesracialandeconomic segregationinourcitybypushingaffordablehousingawayfromthe153acresstadiumdistrictandplatinum triangle–indirectcontradictiontoourHousingElementassubmittedtotheStateofCalifornia. Inessence, this settlementapprovesanillegalactthatisakintosomeonetakingyourhomeandofferingyourchildabicycleto compensate.

It isinarguablethattheCityof Anaheimanditsresidentswillbenefitgreatlyfromtheaffordablehousingthatwill comefromtheAngelStadiumsettlement. I hopethatthehousingwill beequitablyspatiallydistributedthroughout theCity, andthattheCityprioritizesverylowincome (VLI) andlowincome (LI) units. ThroughmyroleasaCity Councilmembersince2018, I haveremainedandcontinueto beafirmadvocateforaffordablehousing, especially forverylowincomeandlowincomehouseholds. I havefirmlyadvocatedthataffordablehousingbeequitably spatiallydistributedthroughouttheCity, evenattimeswhenthecurrentcouncilmajoritydidnotwishtoconverse andagendizethetopicwhenit cametotheHousingElementand/orotherdevelopmentprojectsthathavecomeupto avote.

Anaheim'ssettlementfortheAngelStadiumtransactionhasconcerningimplicationsfortheapplicationofthe CaliforniaSurplusLandActandadvocatesabilityto advocateformeaningfulprojectswithdeepaffordablehousing onpublicly-ownedsurplusproperties. TheCASLAisdesignedtoprioritizeaffordablehousingandother communitybenefitsonpublicly-ownedsurplusproperties. Withthesettlement, it appearstheCitydoesnothaveto buildaffordablehousingunitsonsite, whichisinoppositiontooneofthegoalsoftheSLAofhavingaffordable housingincorporatedtoaproposedproject.

Moreoever, throughouttheAngelStadiumnegotiationandultimatelyitssale, therewasaclearissueof transparency. MayorSidhuappointedhimselfastherepresentativeoftheCityinnegotiationswiththeintentionthat hewouldreporttocouncilandreceivetheirinputforanegotiationagreement. However, Sidhucamebackand decidedonaproposedsaleagreementandleftlittletonoroomforconsultationwiththeCouncilandthepublic.

Additionally, theCitydidnotprovidepublicforumswhereresidentsandothermembersofthepubliccouldlearn abouttheongoingnegotiationsandprovidetheirinput. MayorSidhuandtheCouncilmajoritydecidedthatthey knewwhatwasbestforAnaheimwithoutconsultingresidentsandthepublic.

OnDecember2021theCAHousingandCommunityDevelopmentdepartmentconcludedthattheCitywasin violationofoftheCASurplusLandActandfoundthat:

1. TheCityfailedto declaretheAngelStadiumpropertyas “surplus”

2. TheCityfailedtoputoutanoticeofavailabilityasrequiredbytheSLA 1 3. TheCityviolatedtheSurplusLandActbyfailingtoprovideHCDtheinformationanddocumentsrequiredby GovernmentCodesection54230.5(b)(1) priortoagreeingtotermstodisposeoftheProperty.

Thequestionremains, “WhydidtheCouncilMajoritychoosetonotputthislandupforabidundertheSLAprocess andresolvethissooner?” AsalongtimeAnaheimresidentandAnaheimcouncilmember, I amconcernedofthe precedentwearesettingasaCityandwhatit signalstoothermunicipalitiesthattheycancircumventthelawand negotiateadealonpublicly-ownedsurpluspropertiesbehindcloseddoorsandsimplypayafinelaterdowntheline.

Thebottomlineisthis: MayorHarrySidhu, andhisCouncilmajority, illegallysoldour AnaheimStadiumand surroundinglandonano-bidrealestatedealthatisnowcostingthetaxpayersof Anaheim $100millioninstate imposedfines. Whilethe $100millionfinewill gotowardbuildingaffordablehousinginAnaheim, thefactremains thatthelawwasbroken. Endsdonotjustifythemeans. Asproposed, thesettlementpushessuchaffordablehousing awayfromthestadiumsitefurtheringracialandeconomicsegregationinourCity. Soonceagain, theflatlandsof Anaheimwill beartheresponsibilityof MayorSidhuandhisCouncilmajority’sillegalbehavior. Themessageto Anaheimresidents–takeabackseattotheMayor’sfriendsandcampaigncontributors; andif youareahard-working residentinourCity? YoumayworkandserveinAnaheimbutyouarenotwelcometoliveintheStadiumdistrict.

Thankyou,
Marcia, WarrenandSteveGarten
