CITY COUNCIL AGENDA REPORT
City of Anaheim
HUMAN RESOURCES DEPARTMENT
DATE: JULY 19, 2022
FROM: HUMAN RESOURCES DEPARTMENT
SUBJECT: FIRST AMENDMENT TO PROFESSIONAL SERVICES
AGREEMENT WITH GARY D. NELSON ASSOCIATES, DBA
NELSON
ATTACHMENT (Y/N): YES ITEM # 07
RECOMMENDATION:
That the City Council, by Motion, approve a First Amendment to the Professional Service Agreement between the City of Anaheim and Gary D. Nelson Associates, dba Nelson, for temporary employment services, on an as needed basis, increase the annual not-to-exceed amount to $800,000 until December 31, 2023 , and authorize the Human Resources Director to execute the amendment and take the necessary actions to implement and administer the amended agreement.
DISCUSSION:
On December 3, 2019, the City Council approved an agreement with Gary D. Nelson Associates (dba Nelson) to provide temporary employment services, primarily for the Anaheim Convention Center, for a two year term scheduled to expire in December 2022.
Although the current contract has not expired, the not-to-exceed limit has been exhausted and an amendment is necessary to allow the Convention Center to supplement current staff with temporary workers to avoid service interruptions or delays during periods of peak demand or long-term absences of permanent staff. Temporary workers do not replace City employees and are generally limited to six months in a calendar year unless extended for a period not to exceed 1,000 hours in a fiscal year, based on need.
During the pandemic, the Convention Center was closed due to canceled events, which also resulted in a drop in staffing levels. The reopening of the Convention Center during a time of reduced part-time staffing resulted in the need to hire more temporary staff to meet the high demand of in-person events. The Department is actively recruiting for the necessary positions, however the City continues to experience recruitment and retention challenges. Given the increased event activity and ongoing demand for staffing assistance, staff recommends amending the contract to increase the not-to-exceed limit to $800,000 until December 31, 2023. This amendment will allow temporary workers to supplement Convention Center staff to prevent and avoid service interruptions.
First Amendment to Professional Services Agreement with Gary D. Nelson Associates, dba Nelson JULY 19, 2022
IMPACT ON BUDGET:
Sufficient funds are available in the Fiscal Year 2022-2023 Convention, Sports and Entertainment budget to cover the expected costs of the temporary staffing under this contract.
Respectfully submitted, Respectfully submitted,
Linda N. Andal Tom Morton
Human Resources Director Executive Director, Conventions, Sports & Entertainment
