CITY COUNCIL AGENDA REPORT
City of Anaheim
DEPARTMENT OF PUBLIC WORKS
DATE: AUGUST 9, 2022
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: SECOND AMENDMENT TO COOPERATIVE AGREEMENT NO.
C-4-1714 WITH ORANGE COUNTY TRANSPORTATION
AUTHORITY FOR THE ANAHEIM CANYON METROLINK
STATION IMPROVEMENT PROJECT
ATTACHMENT (Y/N): YES ITEM # 11
RECOMMENDATION:
That the City Council, by Motion, approve the Second Amendment (Amendment) to Cooperative Agreement No C-4-1714 with Orange County Transportation Authority (OCTA) for the Anaheim Canyon Metrolink Station Improvement Project (Project) increasing the reimbursable funds to the City by $70,000 for a total of $343,000, compensating OCTA $39,800 for the construction of a protective slab over a City water line, and extending the termination date to December 31, 2023; authorize the Mayor Pro Tem and City Clerk to execute the Amendment; and increase the Department of Public Works revenue and expenditure budget for FY 2022/23 in the amount of $70,000.
DISCUSSION:
On January 9, 2015, City Council approved the Cooperative Agreement No C-4-1714 between the City and OCTA to define roles and responsibilities for the Project. Under the agreement, OCTA is the lead agency responsible for all phases of the Project including the administration of grant funding, design, environmental clearance, construction, and to reimburse the City for all costs in providing support during the design and construction of the Project up to $173,000.
On December 3, 2019, City Council approved the First Amendment to Cooperative Agreement No. C-4-17114 between the City and OCTA to increase the reimbursable funds to the City by $100,000 for a total of $273,000, to extend the termination date to December 31, 2022, and to compensate OCTA $40,840 for construction costs to extend a casing to protect an existing City owned sewer line.
The Project consists of a second mainline track and platform, extending the existing platform, additional shade structures, benches, another ticket vending machine, landscaping and irrigation, water quality features, a traffic signal modification, and other appurtenant work. This Project benefits residents, visitors, and businesses of Orange County by facilitating track improvements that will allow OCTA to create a more robust service for Metrolink at the Anaheim Canyon Metrolink Station and by improving on- time service between the Inland Empire and Orange County.
Second Amendment to Cooperative Agreement No. C-4-1714 with Orange County Transportation Authority for the Anaheim Canyon Metrolink Station Improvement Project
August 9, 2022
Due to several changes during the construction phase of the project that needed to be reviewed, approved, permitted, and inspected by the City, the City’s efforts have increased since the First Amendment to the original agreement. Some of these changes were caused by unforeseen field conditions and some were triggered by value engineering proposals by OCTA’s contractor.
Additionally, there have been City overtime inspections required during weekend railroad crossing closures that were not originally accounted for. Therefore, this Amendment will provide for an increase in reimbursable funds to the City by $70,000, for a total of $374,000, to cover additional City related engineering costs, administration costs, and inspection fees.
Furthermore, OCTA has agreed to construct a protective reinforced concrete slab over an existing water line owned by the City located within the Project area along La Palma Avenue. The City is responsible to pay the cost and expenses for the protection of the water line pursuant to a separate License Agreement No. 66374, and will reimburse OCTA for these costs. The estimated cost to protect the City water line is $39,800. This compensation to OCTA for the construction of the water line protection is separate from OCTA’s reimbursement to the City.
The Amendment will also extend the termination date from December 31, 2022 to December 31, 2023 to allow for the closeout of permits and processing of final as-built plans. Construction is approximately 65% complete and construction is anticipated to be completed by the end of 2022.
IMPACT ON BUDGET:
Approval of this Amendment would increase the Department of Public Works revenue and expenditure appropriations for FY 2022/23 by $70,000 in restricted transportation funds. Adequate funding of $39,800 is available in the restricted Water Utility funds as part of the Public Utilities FY 2022/23 budget.
