ATTACHMENT (Y/N): YES ITEM # 13
RECOMMENDATION:
That the City Council, by Motion:
1) Approve the Environmental Services Agreement (Agreement) for as-needed environmental services and authorize the Public Utilities General Manager, on behalf of the City of Anaheim (City), to execute the Agreement separately with the following six consultants prequalified for a five-year term with up to two one-year extensions as needed to complete ongoing projects: Atlas Technical Consultants LLC, EFI Global, Inc., Leighton Consulting, Inc., PSOMAS, Stantec Consulting Services, Inc., Vandermost Consulting Services, Inc., and such other environmental services consultants as Anaheim Public Utilities may prequalify during the term of the Agreement;

3) Authorize the Public Utilities General Manager, or designee, on behalf of the City, to take any and all actions as are necessary to implement and administer the Agreement; and
4) Authorize de minimis changes that do not substantially change the terms and conditions of the Agreement, as determined by the City Attorney.
DISCUSSION:
At its meeting on July 27, 2022, the Public Utilities Board (PUB) recommended that City Council approve these actions.
Anaheim Public Utilities’ (APU’s) electric and water operations are required to comply with numerous federal and state environmental laws, regulations, and permits. The scope of environmental compliance work carried out to comply with these requirements is diverse, and it often requires the assistance of technical consultants with specialized education, certifications, and experience to work on behalf of the City with a variety of regulatory agencies.
Approval of Environmental Services Consulting Agreements August 9, 2022
Activities include such diverse tasks as preparing California Environmental Quality Act (CEQA) reports, conducting storm water discharge evaluations to comply with Regional Water Quality Control Board permits, preparing jurisdictional water studies to comply with U.S. Army Corps of Engineers and Clean Water Act requirements, preparing air emission calculations for the South Coast Air Quality Management District and California Air Resources Board, and completing nesting bird surveys to ensure compliance with the Migratory Bird Treaty Act for work around the Walnut Canyon Reservoir and other sensitive habitats. Due to the varied and time-sensitive nature of this work, APU is recommending retention of multiple consultants that are prequalified and available for work on short notice. This will ensure that immediate technical expertise and support are available when needed to respond to critical compliance requirements.
The process of prequalifying environmental services firms was previously approved by the City Council in 2019, and to date, 10 project awards have been issued, averaging approximately $18,000 per award.
On March 2, 2022, a Request for Qualifications (RFQ) for professional services was issued for as-needed environmental services through the City’s online procurement portal.
The RFQ requested environmental services under two Service Groups, with activities that are delineated in Exhibit A of the Agreement, and are summarized as follows:
Service Group 1: CEQA / National Environmental Policy Act, Biological Studies, and Water Compliance
Conducting biological studies
Obtaining Lake and Streambed Alteration

Consultants were allowed to request qualification in one or both Service Groups.
Responses were received from 16 companies. In accordance with the qualification-based selection procurement required by City Council Policy 4.1, APU identified the highest ranked proposals. The evaluation criteria included the ability of each consultant to perform the specific tasks outlined in the RFQ, qualifications of the specific individuals who will work on particular projects, amount of time and involvement of key personnel who will be involved in respective portions of projects, demonstrated record of success by the consultant on work previously performed, specific methods and techniques to be employed Approval of Environmental Services Consulting Agreements August 9, 2022
by the consultant on a given project or problem, and reasonableness of the fee requested to do the work. Upon evaluation of the proposals, the following consultants best met the service requirements of the RFQ and are recommended for prequalification in accordance with Council Policy 4.1:
Service Group 1: CEQA / NEPA, Biological Studies, and Water Compliance PSOMAS (Santa Ana, CA)
Vandermost Consulting Services (San Juan Capistrano, CA) Stantec Consulting Services (Irvine, CA)
Service Group 2: Hazardous Materials Management / Facility Compliance Atlas Technical Consultants (South El Monte, CA)
EFI Global (Los Angeles, CA)
Leighton Consulting (Irvine, CA)
Stantec Consulting Services (Irvine, CA)
The recommended consultants have extensive technical experience in their respective areas of expertise and proper licensing and insurance to perform the required services in the State of California. The total not-to-exceed contract amount for the five-year term of the Agreement, plus any extensions, is $500,000 per consultant. When environmental services under the Agreement are required, APU will invite the prequalified consultants to submit a proposal outlining the scope of work, fee schedule, and availability for work.
Tasks will be awarded to the consultant deemed best able to complete the scope of work within the required schedule at a reasonable cost, in accordance with Council Policy 4.1. A written Notice to Proceed establishing a not-to-exceed amount will be issued to the consultant awarded the task. As with other prequalified consulting services, a quarterly report will be prepared for the Public Utilities Board’s review of selection of consultants and status of services provided.
IMPACT ON BUDGET:
Sufficient funds are included in APU’s Fiscal Year 2022/23 restricted Utility Fund budget, with subsequent years subject to City Council approval of budget appropriations.
Respectfully submitted,
Dukku Lee
Public Utilities General Manager
