COMMUNITY SERVICES DEPARTMENT
DATE: AUGUST 23, 2022
FROM: COMMUNITY SERVICES DEPARTMENT
SUBJECT: APPROVE A PROFESSIONAL DESIGN SERVICES AGREEMENT WITH PACIFIC ADVANCED CIVIL ENGINERING, INC. FOR THE

OC RIVER WALK PROJECT
ATTACHMENT (Y/N): YES ITEM # 07
RECOMMENDATION:

That the City Council, by Motion, approve a Professional Design Services Agreement (Agreement) with Pacific Advanced Civil Engineering, Inc. (PACE), in the amount of $7,930,627, to design and engineer the OC River Walk Project (Project); authorize and direct the Director of Community Services or designee, on behalf of the City, to execute the Agreement in substantial form attached hereto, and any other related documents and take such actions as are necessary to implement and administer the Agreement; authorize de minimis changes that do not substantially change the terms and conditions of the Agreement, as determined by the City Attorney; and authorize the Director of Community Services to increase the contract amount by up to 10%, if such increase is necessary.

DISCUSSION:

On March 15, 2022, City Council approved a $5,000,000 grant award from the State Coastal Conservancy (Conservancy) for Phase 1 of the Project. Phase 1 entails the development of preliminary design documents, geotechnical reports, topographic surveys, permit applications, and environmental documents for priority improvement opportunities identified by the OC River Walk Engineering Feasibility Study (Feasibility Study). As shown on Exhibit A, these priority improvement opportunities include riverbank reconfiguration, two water impoundment areas, a trail extension to Anaheim Coves, and a multi-modal bridge to be located north of Katella Avenue. The Project also includes community outreach and design of several art installations.

In May 2022, Community Services Department staff issued a Request for Proposals (RFP) to consultant firms to provide professional design services for Phase 1. In addition, firms were asked to provide cost to complete Construction Documents and Construction Administration Services (Phase 2), which will be needed to implement the Project.

Proposals were received from the three multi-disciplinary firms listed below.

Lead Consultant Phase 1 Phase 2 Total Fee
KTUA $4,249,811 $1,018,006 $5,267,817
Sherwood Design Engineers $4,915,865 $2,716,782 $7,632,647 PACE $4,938,517 $2,992,110 $7,930,627

As established by Council Policy 4.1, a diverse panel of city staff from various departments, including Community Services, Public Works, Planning and Building, Public Utilities, and Economic Development, reviewed and rated all proposals based on the RFP criteria. All three consultant teams were found to be responsive and were invited to a formal interview.

PACE was found to best meet the requirements of the RFP and was deemed the most qualified and responsive firm based on their understanding, approach, prior experience with similar projects, staff qualifications, public input strategy, and scope of work. Other firms interviewed ranked lower on this evaluating criteria. PACE was previously selected through an RFQ process to complete the Feasibility Study and has distinct familiarity and work experience with the regulatory agencies who have authority over this project. Lastly, PACE included options to expedite the construction of individual Project elements as funding becomes available.

City staff recommends the approval of an Agreement with PACE for professional services for the Project in the amount of $7,930,627. PACE will initially be directed to only proceed with Phase 1 of the Project. Phase 2 is included within the Agreement to provide the city with more opportunities for earlier project implementation as funding sources become available. Following City Council approval, staff will initiate the community input process to collaborate with partners, stakeholders, and residents to complete Phase 1 and will also seek additional funding sources for design of Phase 2 and implementation.

IMPACT ON BUDGET:

Funding for Phase 1 is included in the Community Services Department’s adopted FY 22/23 Capital Improvement Program budget. Staff will continue to seek additional funding for subsequent phases. Funding for future years are subject to City Council’s approval of budget appropriations.

Respectfully submitted,
Sjany Larson-Cash
Director of Community Services
