CITY COUNCIL AGENDA REPORT
City of Anaheim
DEPARTMENT OF PUBLIC WORKS
DATE: OCTOBER 4, 2022
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: DECLARE A PORTION OF CITY-OWNED PROPERTY AS EXEMPT
SURPLUS LAND IN ACCORDANCE WITH THE SURPLUS LAND
ACT AS AMENDED AND NOTICE OF INTENT TO SELL A
PORTION OF CITY-OWNED PROPERTY
ATTACHMENT (Y/N): YES ITEM # 07
RECOMMENDATION:
That the City Council, by Resolution, declare a portion of City-owned property to be Exempt Surplus Property pursuant to California Government Code Section 54222(f)(1)(B) and give Notice of Intent to sell a portion of City-owned property.
DISCUSSION:
Effective January 1, 2020, Assembly Bill (AB) 1486 amended the State Surplus Land Act (SLA) to require local agencies to formally declare public-owned property no longer used for the agency’s expressed purposes as “exempt surplus land” before beginning the disposition process.
The real property not necessary for City use is a portion of the Anaheim Hills Golf Course (AHGC) that is approximately 4,878 square feet (Site). The Site is not needed for future golf course development as it lies out of play and is generally sloped. The Site abuts a single-family residence (SFR) generally known as 543 South Paseo Ganado, and unbeknownst to the City and current owner of 543 South Paseo Ganado, the Site was improved by the former owner of the abutting SFR. The private improvements include a chain-link fence, stairs, and a 1,300-square-foot concrete pad supported by retaining walls. The current owner of the abutting SFR purchased their property under the impression that the Site was a part of the transaction. In 2017 it came to the attention of the City that the private improvements were encroaching onto AHGC property. Over several years, research yielded no clear indication of how private improvements were allowed to encroach on AHGC property. The current owner has consistently worked with the City looking for an amicable solution and is willing to purchase the Site at market value. The current owner has also worked with the Building department, wherein the private improvements are permitted. AHGC and Community Development have no use for this Site and support it going through the surplus land process. If declared surplus and later sold, the Site would be conveyed as open space, restricted from additional development of structures or buildings, and required to accept drainage from the City’s surrounding property.
Declare a portion of City-owned property as exempt surplus land in accordance with the Surplus Land Act as amended and Notice of Intent to sell a portion of City-owned property.
